1. This appeal is directed against an order dated 14[th] February
2013 passed by the Income Tax Appellate Tribunal, Cuttack Bench, Cuttack (ITAT) in IT (SS) A No.76/CTK/2012 for the assessment year (AY) 2009-10. In allowing the Assessee’s appeal, the ITAT held that the addition made by the Assessing Officer (AO) on account of un-explained loans and advances as well as on account of capital reserve was unjustified.
2. Having heard learned Senior Standing Counsel for the Appellant and having perused the impugned order of the ITAT, the Court finds that there is no substantial question of law that arises for consideration. The appeal is accordingly dismissed. An urgent certified copy of this order be issued as per rules.
