Learned counsel for the respondent made statement that he has receivedcommunication from the Revenue Department about its communication toearlier counsel Mr. Virender Issar standing counsel that the Department haswithdrawn the prosecution launched under Section 276(c) and 276(cc) ofIncome Tax Act, 1961 in the present case and the copy of the concernedcommunication is Mark -A. The senior standing counsel further submits that inview of the above, nothing survives to be adjudicated in the present petition.
Learned counsel appearing on behalf of the petitioners madeStatement that in light of the aforesaid statement made by the senior standingcounsel of respondent, he be allowed to withdraw the present petition withliberty to revive the same, if in future, cause of action still survives.
Accordingly, the present petition is hereby dismissed as withdrawnwith the aforesaid liberty to the petitioners.
