DATED : 30TH JULY, 2007. P.C. : 1. The reasons given in para 17 to explain delay in filing the petition after 5 years would not amount to sufficient reasons as the impugned order was passed on 26th November, 2002 and there were directors incharge of the Company. To contend that the professional directors were not interested in the affairs of the company would amount to non performing of their duties. That cause would not amount to sufficient cause. No case is made out for condoning the latches in preferring the petition. 2. No interference is called for. Petition is dismissed. (F.I. REBELLO, J.) (J.P. DEVADHAR, J.)
