IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR -------------------------------------------------------- CIVIL WRIT No. 5612 of 2006 M/S.S.K.CONSTRUCTION CO.HANUMANGARH JN. V/S INCOME TAX OFFICER & ANR. Mr. BK VYAS, for the appellant / petitioner Date of Order : 11.1.2007 HON'BLE SHRI N P GUPTA,J. ORDER ----- Heard learned counsel for the petitioner. The impugned order was passed way-back on 12.6.06under Section 142(1) of the Income Tax Act directing thepetitioner to produce certain documents and the case wasfixed for hearing on 26.6.06. This writ was filed on 6.7.06and till now, there is no interim order. In thesecircumstances, it is reasonable to assume that theassessment proceedings must have been finalised by the ITO,against which the petitioner may have alternative remedy. In that view of the matter, I am not inclined to entertainthe present writ petition. The same is, therefore, dismissed summarily. /tarun/
