IN THE HIGH COURT OF JUDICATURE AT BOMBAYORDINARY ORIGINAL CIVIL JURISDICTIONNOTICE OF MOTION NO.1516 OF 2008in The Commissioner of Income Tax12 .. Appellant Mr.A.S.Rao for AppellantMr.Pankaj Toprani for Respondents P.C. 1. Heard the learned counsel for the parties. Bythis notice of motion, the appellant is seekingcondonation of 296 delay caused in filing theappeal. 2. Perused the affidavit in support of the Noticeof motion. It appears that though the last datefor filing the appeal was 18.6.07 and theCommissioner of Income Tax had granted approval on14.6.07 the appeal came to be filed belatedly on9.4.08. However, almost more than 9 months wastaken for drafting the memo of appeal and further15 days to get the court fee stamps for filing theappeal. We are not at all satisfied with thereasons given for condonation of delay. Nosufficient cause is made out for condonation of delay. Hence, Notice of motion stands dismissed. 3. In view of dismissal of the Notice of Motion,Income Tax Appeal (L) No.1071 of 2008 also standsdismissed. {A.V.Nirgude, J) (Dr.S.Radhakrishnan, J)
