1.This Motion has been taken out for condonation of

16 days delay in filing an accompanying Appeal against orderdated 29 July 2016 passed by the Income Tax AppellateTribunal.
2.We have perused the Affidavit dated 14 September2017 of Mr. Rajeev Singh the Deputy Commissioner of IncomeTax, in support of the Motion and are satisfied with the reasonsfor the delay as indicated therein. We have also perused theadditional Affidavit of Mr. Anil Gupta, an Advocate's Clerk,dated 18 January 2018, which states that the time of removal ofoffice objection stands extended upto 25 January 2018 by theProthonotary & Senior Master. This in response to thecontention of the Respondent on the last occasion that theAppeal is already dismissed for non-removal of office objection.
3.In the above view, the Notice of Motion is allowed interms of prayer clause (a).
