CORAM : F.I. REBELLO &
J.P. DEVADHAR, JJ.
DATED : 9TH JULY, 2007.
P.C. :
1. In support of the affidavit for condonation
of delay, it is pointed out that the approval for
preferring Appeal was granted on 8th January, 2007.
The Appeal Memo was received on 27th January, 2004
i.e. nearly after one year and the Appeal was filed
on 3rd June, 2004 i.e. nearly after five months. No
explanation has been given for both the long delay in
the Ministry of Law as also as to why the Appeal was
not preferred after draft Appeal Memo was received.
In our opinion, cause shown would not amount to
sufficient cause.
2. The notice of motion is dismissed.
