The Revenue has filed Income-tax
Appeal (Lodging) No.1100 of 2008 but
belatedly and hence this Motion for
condonation of delay. The appeal is beyond
time by 169 days and we have perused the
affidavit filed by the Dy.Commissioner of
Income-tax, Mumbai in support of the Motion.
Having regard to the dates mentioned in
para.4 of the affidavit, we are satisfied
that good and sufficient case has been made
out to condone the delay. Hence, the Motion
is allowed in terms of prayer clause (a).
The appeal be placed for admission
before the Regular Bench.
