Later a search of the petitioner's residence revealed th'lt the re ti ti oner had suppressed certain business transactions and had kept false accounts. On the basis of the allegation that the petitioner had deli-berately filed false returns and had kept fahe accounts with the intention of using then1 11s genuine evidence under the assessn1cnt proceedings, complaints were filed againt him in the trial court for taking action against him for offences punishable under sections 276C and 277 of the ·income Tax Act and under section<> 193 and 196 of the Indian Penal Code. The petitioner moved the High Court under section 482 of the Code of Criminal Procedure for quashing the pro· ceedings contending that the launching of the prosecution was ·a premature one on the ground that the reassessment proceedings started against him under the Income Tax Act had not been completed. The High Court dismissed the peti· tions. The petitioner filed this petition for special leave to appeal. The petitio· ner did not urge any legal bar for the institution of the proceedings except stating that in the event of the petitioner being exonerated in the reassessment proceedings, the prosecutions may have to be dropped. Dismissing the petition for special leave, • HELD : The pendcncy of the reassessment proceedings cannot act as a bar to the institution of the criminal prosecution for offences punishable under section 276C or section 277 of the Act. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) ਪੀ. ਜਯਾਪਪਨ ਬਨਾਮ ਐਸ.ਕੇ. ਪੇਰੂਮਲ, ਪਹਿਲਾ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਤੂਤੀਕੋਰਿਨ 17 ਅਗਸਤ, 1984 [ਓ. ਚਿੰਨੱਪਾ ਰੈੱਡੀ, ਏ.ਪੀ. ਸੇਨ ਅਤੇ ਈ.ਐਸ. ਵੈਂਕਟਰਮਨੀਆ, ਜੇਜੇ.] ਅਪਰਾਧਿਕ ਪ੍ਰਕਿਰਿਆ ਦਾ ਸੰਹਿਤਾ, 1973—ਧਾਰਾ 482—ਆਰਟੀਸੀਜ਼ 276ਸੀ ਅਤੇ 277 ਦੇ ਤਹਿਤ ਆਮਦਨ ਕਰ ਦੀ ਜਾਣਬੁੱਝ ਕੇ ਤੋਂ ਬਚਣ ਲਈ ਝੂਠੇ ਰਿਟਰਨਾਂ ਦੇ ਆਧਾਰ ਤੇ ਮੁਲਾਂਕਣਕਰਤਾ ਵਿਰੁੱਧ ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕੀਤੀ ਗਈ—ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ—ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ ਦੀ ਰਿਟਰਨ ਅਤੇ ਮੁੜ ਮੁਲਾਂਕਣ ਦੇ ਬਾਅਦ ਸ਼ੁਰੂ ਕੀਤੀ ਗਈ—ਨਿਯਮ ਕਿ ਕੋਈ ਮੁੜ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈ—ਅਪਰਾਧਿਕ ਪ੍ਰਕਿਰਿਆ ਅਪਰਾਧਿਕ ਮਾਮਲਿਆਂ ਦੀ ਲਟਕਣ ਦੌਰਾਨ ਮੁਅੱਤਲ ਕਰਨ, ਰੋਕਣ ਜਾਂ ਰੱਦ ਕਰਨ ਦੇ ਅਧੀਨ ਨਹੀਂ ਹੈ। ਅਪਰਾਧਿਕ ਪ੍ਰਕਿਰਿਆ ਦਾ ਸੰਹਿਤਾ, 1973—ਧਾਰਾ 309—ਨਿਆਂਇਕ ਅਧਿਕਾਰੀ ਦੇ ਵਿਚਾਰ ਅਦਾਲਤ ਵਿੱਚ ਦਾਇਰ ਕੀਤੇ ਜਾਣ ਤੋਂ ਬਾਅਦ, ਨਿਆਂਇਕ ਤੌਰ 'ਤੇ ਵਿਚਾਰ ਕੀਤਾ ਗਿਆ ਅਤੇ ਅਪਰਾਧਿਕ ਸੰਹਿਤਾ ਦੇ ਉਦੇਸ਼ ਨੂੰ ਨਾਕਾਮ ਨਹੀਂ ਕੀਤਾ ਗਿਆ। ਆਮਦਨ ਕਰ ਐਕਟ, 1961, ਧਾਰਾ 276ਸੀ ਅਤੇ 277 ਧਾਰਾ 276ਸੀ ਅਤੇ 277 ਦੇ ਤਹਿਤ ਅਪਰਾਧਾਂ ਲਈ ਮੁਲਾਂਕਣ ਤੋਂ ਪਹਿਲਾਂ ਜਾਂ ਦੌਰਾਨ ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕਰਨ ਲਈ ਕੋਈ ਰੋਕ ਨਹੀਂ ਹੈ। ਪ੍ਰਾਰਥੀ, ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੇ ਤਹਿਤ ਮੁਲਾਂਕਣਕਰਤਾ, ਨੇ ਆਮਦਨ ਕਰ ਰਿਟਰਨ ਦਾਇਰ ਕੀਤੇ ਜੋ ਸਵੀਕਾਰ ਕੀਤੇ ਗਏ ਸਨ। ਬਾਅਦ ਵਿੱਚ ਪ੍ਰਾਰਥੀ ਦੇ ਨਿਵਾਸ ਦੀ ਭਾਲ ਦੌਰਾਨ ਇਹ ਪਾਇਆ ਗਿਆ ਕਿ ਰਿਟਰਨਾਂ ਵਿੱਚ ਕੁਝ ਕਾਰੋਬਾਰੀ ਲੈਣ-ਦੇਣ ਨੂੰ ਛੁਪਾਇਆ ਗਿਆ ਸੀ ਅਤੇ ਝੂਠੇ ਹਿਸਾਬ ਰੱਖੇ ਗਏ ਸਨ। ਇਸ ਦੇ ਆਧਾਰ ਤੇ ਕਿ ਪ੍ਰਾਰਥੀ ਨੇ ਜਾਣਬੁੱਝ ਕੇ ਝੂਠੇ ਰਿਟਰਨ ਦਾਇਰ ਕੀਤੇ ਸਨ ਅਤੇ ਝੂਠੇ ਹਿਸਾਬ ਰੱਖੇ ਸਨ, ਉਸ ਵਿਰੁੱਧ ਸੈਕਸ਼ਨ 276ਸੀ ਅਤੇ 277 ਤਹਿਤ ਸ਼ਿਕਾਇਤਾਂ ਦਾਇਰ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ। ਪ੍ਰਾਰਥੀ ਨੇ ਅਦਾਲਤ ਵਿੱਚ ਅਪਰਾਧਿਕ ਪ੍ਰਕਿਰਿਆ ਸੰਹਿਤਾ ਦੀ ਧਾਰਾ 482 ਤਹਿਤ ਕਾਰਵਾਈ ਨੂੰ ਰੱਦ ਕਰਨ ਲਈ ਅਰਜੀ ਦਾਇਰ ਕੀਤੀ, ਇਹ ਕਹਿੰਦਿਆਂ ਕਿ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕਰਨਾ ਉਸ ਦੇ ਵਿਰੁੱਧ ਪਰੇਸ਼ਾਨੀ ਸੀ ਅਤੇ ਮੇਰਿਟ ਤੇ ਨਹੀਂ ਸੀ। ਇਸ ਨੇ ਇਹ ਵੀ ਕਿਹਾ ਕਿ ਮੁੜ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈ ਵੀ ਪ੍ਰਾਰਥੀ ਦੁਆਰਾ ਦਾਇਰ ਅਰਜੀ ਦੁਆਰਾ ਰੱਦ ਕੀਤੀ ਜਾਵੇਗੀ, ਅਤੇ ਜੇਕਰ ਪ੍ਰਾਰਥੀ ਮੁੜ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈ ਵਿੱਚ ਬਰੀ ਹੋ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਵੀ ਛੱਡ ਦਿੱਤਾ ਜਾਵੇਗਾ। ਵਿਸ਼ੇਸ਼ ਇਜਾਜ਼ਤ ਲਈ ਅਰਜੀ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ, ਫੈਸਲਾ : ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਦਾ ਲੰਬਿਤ ਹੋਣਾ ਸੈਕਸ਼ਨ 276C ਜਾਂ ਸੈਕਸ਼ਨ 277 ਦੇ ਤਹਿਤ ਸਜ਼ਾਯੋਗ ਅਪਰਾਧਾਂ ਲਈ ਅਪਰਾਧਿਕ ਮੁਕੱਦਮਾ ਦੀ ਸ਼ੁਰੂਆਤ ਨੂੰ ਰੋਕ ਨਹੀਂ ਸਕਦਾ। ਅਪਰਾਧਿਕ ਕਾਰਵਾਈਆਂ ਦੀ ਸ਼ੁਰੂਆਤ ਹਾਲਾਤਾਂ ਵਿੱਚ ਅਦਾਲਤ ਦੀ ਪ੍ਰਕਿਰਿਆ ਦੀ ਦੁਰਵਰਤੋਂ ਨਹੀਂ ਹੋ ਸਕਦੀ। ਕਾਨੂੰਨ ਵਿੱਚ ਕੋਈ ਵਿਵਸਥਾ ਨਹੀਂ ਹੈ ਜੋ ਇਹ ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ ਕਿ ਮੁੜ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈਆਂ ਸ਼ੁਰੂ ਕੀਤੀਆਂ ਜਾਣ ਤੱਕ ਮਲਜ਼ਮਾਂ ਵਿਰੁੱਧ ਮੁਕੱਦਮਾ ਚਲਾਇਆ ਨਹੀਂ ਜਾ ਸਕਦਾ। ਸੈਕਸ਼ਨ 276C(1) ਵਿੱਚ ਸ਼ਾਮਲ ਅਪਵਾਦ ਵਿੱਚ ਅਪਰਾਧਿਕ ਕਾਰਵਾਈਆਂ ਦੀ ਸਥਾਪਨਾ ਲਈ ਇੱਕ ਤੱਥ ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ ਹੈ ਕਿ ਇੱਕ ਸੁਤੰਤਰ ਅਪੀਲ ਵਿੱਚ ਅਪਰਾਧ ਦੇ ਤੱਥਾਂ ਨੂੰ ਸਥਾਪਤ ਕਰਨਾ ਪੈਂਦਾ ਹੈ ਤਾਂ ਜੋ ਮੁਲਜ਼ਮ ਦੇ ਦੋਸ਼ੀ ਠਹਿਰਾਇਆ ਜਾ ਸਕੇ। ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਕੋਲ ਕਾਨੂੰਨ ਤਹਿਤ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਦੇ ਨਤੀਜੇ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਣ ਦਾ ਕੋਈ ਆਧਾਰ ਨਹੀਂ ਹੈ, ਪਰ ਇੱਕ ਉਚਿਤ ਮਾਮਲੇ ਵਿੱਚ ਇਹ ਕਾਨੂੰਨ ਤਹਿਤ ਪਾਸ ਕੀਤੇ ਗਏ ਹੁਕਮ ਦੇ ਚਾਨਣ ਵਿੱਚ ਕਾਰਵਾਈ ਨੂੰ ਰੱਦ ਕਰ ਸਕਦੀ ਹੈ। ਇਸਦਾ ਮਤਲਬ ਇਹ ਨਹੀਂ ਹੈ ਕਿ ਕਾਨੂੰਨ ਤਹਿਤ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਦਾ ਨਤੀਜਾ ਅਪਰਾਧਿਕ ਅਦਾਲਤ 'ਤੇ ਬੰਨ੍ਹਦਾ ਹੈ। ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਨੂੰ ਆਪਣੇ ਆਪ ਨੂੰ ਸਬੂਤਾਂ 'ਤੇ ਅਧਾਰਤ ਇੱਕ ਸੁਤੰਤਰ ਫੈਸਲਾ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ। ਨਹੀਂ ਤਾਂ ਇੱਕ ਤਰਕ ਪੇਸ਼ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਜਦੋਂ ਵੀ ਮੁਲਾਜ਼ਮ ਜਾਂ ਕਾਨੂੰਨ ਤਹਿਤ ਜ਼ਿੰਮੇਵਾਰ ਕਿਸੇ ਵੀ ਹੋਰ ਸ਼ਖਸ ਨੇ ਕਾਨੂੰਨ ਤਹਿਤ ਕਾਰਵਾਈਆਂ ਵਿੱਚ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਇਹ ਸਾਬਤ ਕਰਨ ਵਿੱਚ ਅਸਫਲ ਰਿਹਾ ਕਿ ਉਸਨੇ ਜਾਣਬੁੱਝ ਕੇ ਕੋਈ ਗ਼ਲਤ ਬਿਆਨ ਨਹੀਂ ਦਿੱਤਾ ਜਾਂ ਉਸਨੇ ਕੋਈ ਸਬੂਤ ਨਹੀਂ ਬਣਾਇਆ, ਅਜਿਹੇ ਸ਼ਖਸ ਦੀ ਸਜ਼ਾ ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਵਿੱਚ ਲਾਜ਼ਮੀ ਤੌਰ 'ਤੇ ਹੋਣੀ ਚਾਹੀਦੀ ਹੈ। ਰਾਮ ਚੰਦ ਅਤੇ ਹੋਰ ਬਨਾਮ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਕੇਂਦਰੀ ਸਰਕਲ, ਅੰਮ੍ਰਿਤਸਰ, (1982) 131 ਆਈ.ਟੀ.ਆਰ. 90, ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ। ਮਿਸਟਰ ਤੁਲਾ ਰਾਮ ਰੰਗੂ ਰਾਮ ਅਤੇ ਹੋਰ ਬਨਾਮ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, 'ਏ' ਵਾਰਡ, ਹੁਸ਼ਿਆਰਪੁਰ ਦਿਨਾਂਕ 4ਵੀਂ (1984) 145 ਆਈ.ਟੀ.ਆਰ. 141, ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ। ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦਾ ਜਿਉਟੀ ਪ੍ਰਕਾਸ਼ ਮਿੱਤਰ ਬਨਾਮ ਹਰਾ ਮੋਹਨ ਚੌਧਰੀ ਦਾ ਵਿਚਾਰ ਸੈਕਸ਼ਨ 279(1A) ਦੇ ਪ੍ਰਾਵਧਾਨਾਂ ਲਈ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਮਿਸਟਰ ਜਸਟਿਸ ਗੁਪਤਾ ਦੇ ਸਾਹਮਣੇ ਮੁਕੱਦਮੇ ਦੇ ਪੂਰਾ ਹੋਣ ਦੀ ਜ਼ਰੂਰਤ ਨੂੰ ਸਥਾਪਿਤ ਕਰਦਾ ਹੈ ਅਤੇ ਇਸ ਲਈ ਜਦ ਤਕ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈਆਂ ਲੰਬਿਤ ਹਨ, ਅਪਰਾਧਿਕ ਕਾਰਵਾਈਆਂ ਦੀ ਸ਼ੁਰੂਆਤ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ। [277A] ਸਿੱਧੇ ਤੌਰ 'ਤੇ ਸ਼ਾਮਲ ਨਹੀਂ ਹੁੰਦਾ ਕਿਉਂਕਿ ਸੈਕਸ਼ਨ 259(4) ਦੁਆਰਾ ਨਿਰਧਾਰਤ ਸੈਕਸ਼ਨ 273A ਦੇ ਤਹਿਤ ਇੱਕ ਹੁਕਮ ਦੁਆਰਾ ਮਨ੍ਹਾ ਕੀਤਾ ਗਿਆ ਹੈ, ਮੁਕੱਦਮਾ ਚਲਾਇਆ ਨਹੀਂ ਜਾ ਸਕਦਾ। ਜਿਉਟੀ ਪ੍ਰਕਾਸ਼ ਮਿੱਤਰ ਬਨਾਮ ਹਰਾ ਮੋਹਨ ਚੌਧਰੀ, (1978) 112 ਆਈ.ਟੀ.ਆਰ. 384, ਨੂੰ ਉਲਟਾਇਆ ਗਿਆ। ਕਿਸੇ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਇਸ ਤੋਂ ਪਹਿਲਾਂ ਅਨਿਸ਼ਚਿਤ ਕਾਲ ਲਈ ਜਾਂ ਬਹੁਤ ਲੰਬੇ ਸਮੇਂ ਲਈ ਸਿਰਫ਼ ਇਸ ਲਈ ਕਿ ਕੁਝ ਕਾਰਵਾਈਆਂ ਜੋ ਕਿਸੇ ਸਵਾਲ ਨੂੰ ਸੰਭਾਲਣ ਵਿਚ ਸ਼ਾਮਲ ਹੋ ਸਕਦੀਆਂ ਹਨ। ਪਰ ਇਹ, ਹਾਲਾਂਕਿ, ਮੁਲਜ਼ਮਾਂ ਦੀ ਆਗਿਆ ਦੀ ਆਗਿਆ ਦੇ ਸਬੰਧ ਵਿਚ ਕੋਈ ਪ੍ਰਾਸੰਗਿਕਤਾ ਨਹੀਂ ਰੱਖਦਾ। ਉਨ੍ਹਾਂ ਹਾਲਤਾਂ ਵਿਚ ਮੁਲਜ਼ਮਾਂ ਦੀ ਆਗਿਆ ਨੂੰ ਇਸ ਅਧਾਰ ਤੇ ਰੱਦ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ ਕਿ ਇਹ ਇਕ ਅਕਾਲੀ ਹੈ। Case: P. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) There is no provision in law which provides that a prosecution for the offences in question cannot be launched until reassessment proceedings initiated against the assessee are completed. [ 540 HJ A mere expectation of success in some prOceeding in appeal or reference under the Act cannot come in the way of the institution of the criminal proceed· ings under section 276C, and section 277 of the Act. In the criminal case all the ingredients of the offence in question have to be established in order to secure the conviction of the accused. The criminal cou~t no doubt has to give due regard to the result of any proceeding under the Act having a bearing on the question in issue and in an appropriate case it may drop the proceedings in the light of an order passed under the Act. It does not, however, mean that the result of a proceeding under the Act would be binding on the criminal court. The criminal court has to judge the case independently on the evidence placed before it. Otherwise there is a danger of a contention being advanced that whenever the assessee or any other person liable under the Act has failed to convince the authorities in the proceedings under the Act that he has not c'eliberately made any false statement or that he has not fabricated any material evidence, the con-viction of such person should invariably follow in the criminal court. The view of the Calcutta High Court in Jyoti Prakash Mitter V• Haramohan Chowdhury that the provisions of section 279( I A) of the Income Tax Act establi-shed the necessity for the completion of the penalty proceedings before the insti-tution of the prosecution and therefore as Jong as the penalty proceedings were pending the criminal proceedings could not be instituted was erroneous. Section 279(1A) does not provide that merely because there is a possibility of the Commissioner passing an order undc-r section 273A, the prosecution shall not be instituted. [542 D ; H ; 543 Al Jyoti Prakash Mitter v. Haran1ohan Chowdhury, (1978) 112 I.T.R. 384. overruled. It may be that in an appropriate case the criminal Court may adjourn or postpone the hearing of a criminal case in exercise of its discretionary power under section 309 of the Code of Criminal Procedure if the disposal of any proceeding under the Act which has a bearing on the proceedings before it is imminent so that it may take also into consideration the order to be passed therein. Even here the discretion should be exercised judicially and in such a way as not to frustrate the object of the criminal proceedings. There is no rigid rule which makes it necessary for a criminal court to adjourn or postpone the A B c D E H A hearing of a case before it indefinitely or for an unduly Jong period only because some proceeding which may have some bearing on it is pending elsewhere. But this, however, has no relevance to lhe question of maintainability of the pro· sccution. The prosecution in those circumstances cannot be quashed on the ground that it is a premature one. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) ਜਿਉਟੀ ਪ੍ਰਕਾਸ਼ ਮਿੱਤਰ ਬਨਾਮ ਹਰਾ ਮੋਹਨ ਚੌਧਰੀ, (1978) 112 ਆਈ.ਟੀ.ਆਰ. 384, ਨੂੰ ਉਲਟਾਇਆ ਗਿਆ। ਕਿਸੇ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਇਸ ਤੋਂ ਪਹਿਲਾਂ ਅਨਿਸ਼ਚਿਤ ਕਾਲ ਲਈ ਜਾਂ ਬਹੁਤ ਲੰਬੇ ਸਮੇਂ ਲਈ ਸਿਰਫ਼ ਇਸ ਲਈ ਕਿ ਕੁਝ ਕਾਰਵਾਈਆਂ ਜੋ ਕਿਸੇ ਸਵਾਲ ਨੂੰ ਸੰਭਾਲਣ ਵਿਚ ਸ਼ਾਮਲ ਹੋ ਸਕਦੀਆਂ ਹਨ। ਪਰ ਇਹ, ਹਾਲਾਂਕਿ, ਮੁਲਜ਼ਮਾਂ ਦੀ ਆਗਿਆ ਦੀ ਆਗਿਆ ਦੇ ਸਬੰਧ ਵਿਚ ਕੋਈ ਪ੍ਰਾਸੰਗਿਕਤਾ ਨਹੀਂ ਰੱਖਦਾ। ਉਨ੍ਹਾਂ ਹਾਲਤਾਂ ਵਿਚ ਮੁਲਜ਼ਮਾਂ ਦੀ ਆਗਿਆ ਨੂੰ ਇਸ ਅਧਾਰ ਤੇ ਰੱਦ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ ਕਿ ਇਹ ਇਕ ਅਕਾਲੀ ਹੈ। ਫੌਜਦਾਰੀ ਅਪੀਲ ਅਧਿਕਾਰ ਖੇਤਰ: 1984 ਦੀ ਵਿਸ਼ੇਸ਼ ਛੁੱਟੀ ਅਪੀਲ (ਫੌਜਦਾਰੀ) ਲਈ ਪਟੀਸ਼ਨ ਨੰ. 1923। ਮਦਰਾਸ ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮ ਅਤੇ ਹੁਕਮ ਦੀ ਤਾਰੀਖ 19 ਜੂਨ, 1984 ਕ੍ਰਿਮੀਨਲ ਮਿਸਕੇਲੇਨੀ ਪਟੀਸ਼ਨ ਨੰਬਰ 8164/83, 8168, 8166 ਅਤੇ 8170/83 ਤੋਂ। ਸੀ.ਐਸ. ਵੈਦਿਆਨਾਥਨ ਪਟੀਸ਼ਨਰ ਲਈ। ਕੋਰਟ ਦਾ ਹੁਕਮ ਦਿੱਤਾ ਗਿਆ ਸੀ ਵੈਂਕਟਰਮਈਆ, ਜੇ. ਪਟੀਸ਼ਨਰ ਐਮ/ਸੀ ਰਤਨਮ ਫੂਡ ਸਟੱਫ ਕੰਪਨੀ, ਟਿਊਟੀਓਂਕ ਦਾ ਮਾਲਕ ਹੈ। ਉਹ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 (ਹੇਠਾਂ 'ਐਕਟ' ਕਿਹਾ ਜਾਵੇਗਾ) ਤਹਿਤ ਇਕ ਮੁਲਾਂਕਣਕਰਤਾ ਹੈ। 1978 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ, ਉਸਨੇ 20 ਜਨਵਰੀ, 1978 ਨੂੰ ਐਕਟ ਤਹਿਤ ਆਪਣੀ ਰਿਟਰਨ ਦਾਇਰ ਕੀਤੀ ਜਿਸ ਵਿਚ ਰੁਪਏ ਦੀ ਆਮਦਨੀ ਦਾ ਖੁਲਾਸਾ ਕੀਤਾ ਗਿਆ ਸੀ। 13,380 / - ਲਾਭ ਅਤੇ ਨੁਕਸਾਨ ਦੇ ਖਾਤੇ, ਟ੍ਰਾਇਲ ਬੈਲੈਂਸ, ਆਮਦਨ ਕਰ ਰਿਟਰਨ ਢੰਗ ਬਿਆਨ ਅਤੇ ਪੂੰਜੀ ਖਾਤੇ ਦੀ ਇਕ ਨਕਲ ਸਮੇਤ। ਉਥੇ ਰਿਟਰਨ ਨੂੰ ਸਵੀਕਾਰ ਕਰ ਲਿਆ ਗਿਆ ਸੀ। 20 ਅਤੇ 21 ਅਗਸਤ, 1981 ਨੂੰ, ਪਟੀਸ਼ਨਰ ਦੇ ਨਿਵਾਸ ਸਥਾਨ ਤੇ ਐਕਟ ਦੀ ਧਾਰਾ 132 ਤਹਿਤ ਇਕ ਭਾਲ ਕੀਤੀ ਗਈ ਸੀ ਜਿਸ ਦੇ ਨਤੀਜੇ ਵਜੋਂ ਕਈ ਦਸਤਾਵੇਜ਼ਾਂ ਅਤੇ ਖਾਤਾ ਕਿਤਾਬਾਂ ਦੀ ਜਪਤ ਕਰ ਲਈ ਗਈ ਸੀ ਜਿਸ ਵਿਚ ਇਨਵੈਂਟਰੀ ਬੀਜਾਂ ਦੀ ਖਰੀਦ ਦੀ ਦਬਾਈ, ਉਸਦੀ ਪਤਨੀ ਅਤੇ ਧੀਆਂ ਦੇ ਨਾਮ ਤੇ ਕਈ ਬੈਂਕ ਖਾਤਿਆਂ ਦੀ ਮੌਜੂਦਗੀ ਅਤੇ ਰਿਟਰਨ ਦੇ ਨਾਲ ਦਾਇਰ ਕੀਤੇ ਬਿਆਨਾਂ ਵਿਚ ਸਪਸ਼ਟ ਤੌਰ ਤੇ ਦਰਸਾਈ ਗਈ ਸੀ। ਮੁਲਾਂਕਣ ਸਾਲ 1977-78 ਲਈ ਰਿਟਰਨ ਦੇ ਨਾਲ ਦਾਇਰ ਕੀਤਾ ਗਿਆ ਵਪਾਰਕ ਅਤੇ ਲਾਭ ਅਤੇ ਨੁਕਸਾਨ ਦਾ ਖਾਤਾ ਦਰਸਾਉਂਦਾ ਹੈ ਕਿ ਉਸਨੇ ਰੁਪਏ ਦੇ ਮੁੱਲ ਦੇ ਪਰਕਲੋਰਿਕ ਬੀਜ ਦੀ ਖਰੀਦ ਕੀਤੀ ਸੀ। 65,797 / - ਜਦੋਂ ਕਿ ਦਾਇਰ ਕੀਤੇ ਗਏ ਖਾਤਿਆਂ ਅਨੁਸਾਰ ਰੁਪਏ। 2,15,729 / -। ਕਈ ਹੋਰ ਗਲਤ ਬਿਆਨ ਸਪਸ਼ਟ ਤੌਰ ਤੇ ਦਰਜ ਕੀਤੇ ਗਏ ਸਨ। ਇਸ ਇਲਜ਼ਾਮ ਦੇ ਆਧਾਰ ਤੇ ਕਿ ਪਟੀਸ਼ਨਰ ਨੇ ਜਾਣਬੁੱਝ ਕੇ ਇਕ ਝੂਠੀ ਰਿਟਰਨ ਦਾਇਰ ਕੀਤੀ ਸੀ ਅਤੇ ਟੈਕਸ ਈਵੇਸ਼ਨ ਨੂੰ ਬਰਕਰਾਰ ਰੱਖਣ ਦੇ ਇਰਾਦੇ ਨਾਲ ਆਮਦਨ ਕਰ ਤੋਂ ਬਚਿਆ ਸੀ। ਉਸਨੇ ਝੂਠੇ ਖਾਤੇ ਰੱਖੇ ਸਨ ... ਚੀਫ ਜੂਡੀਸ਼ੀਅਲ ਮੈਜਿਸਟਰੇਟ (ਆਰਥਿਕ ਅਪਰਾਧਾਂ ਦੀ ਅਦਾਲਤ), ਮਦੁਰਾਈ ਉਸ ਦੇ ਖਿਲਾਫ ਕਾਰਵਾਈ ਕਰਨ ਲਈ ਐਕਟ ਦੀ ਧਾਰਾ 276 ਸੀਸੀ ਅਤੇ ਐਕਟ ਦੀ ਧਾਰਾ 277 ਅਤੇ ਭਾਰਤੀ ਦੰਡ ਵਿਧਾਨ ਦੀਆਂ ਧਾਰਾਵਾਂ 193 ਅਤੇ 196 ਤਹਿਤ ਦੰਡਨੀਯ ਅਪਰਾਧ ਲਈ। ਇਸੇ ਤਰ੍ਹਾਂ ਪਟੀਸ਼ਨਰ ਦੇ ਖਿਲਾਫ ਤਿੰਨ ਹੋਰ ਸ਼ਿਕਾਇਤਾਂ ਦਾਇਰ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ ਜਿਨ੍ਹਾਂ ਵਿਚ ਉਸ ਦੁਆਰਾ ਤਿੰਨ ਲਗਾਤਾਰ ਮੁਲਾਂਕਣ ਸਾਲਾਂ 1978-79, 1979-80 ਅਤੇ 1980-81 ਦੇ ਸਬੰਧ ਵਿਚ ਕੀਤੇ ਗਏ ਉਸੇ ਅਪਰਾਧਾਂ ਬਾਰੇ ਦੱਸਿਆ ਗਿਆ ਸੀ।1980-81 ਉਸੇ ਮੈਜਿਸਟਰੇਟ ਦੇ ਸਾਹਮਣੇ। ਬਾਅਦ ਵਿੱਚ ਪਟੀਸ਼ਨਰ ਨੇ ਕੋਡ ਆਫ਼ ਕ੍ਰਿਮੀਨਲ ਪ੍ਰੋਸੀਜਰ ਦੀ ਧਾਰਾ 482 ਤਹਿਤ ਚਾਰ ਪਟੀਸ਼ਨਾਂ ਮਦਰਾਸ ਦੀ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਦਾਇਰ ਕੀਤੀਆਂ, ਜਿਸ ਵਿੱਚ ਉਸਨੇ ਕਿਹਾ ਕਿ ਹਰੇਕ ਮਾਮਲੇ ਵਿੱਚ ਮੁਕੱਦਮਾ ਚਲਾਉਣਾ ਇੱਕ ਅਣਗਹਿਲੀ ਗੱਲ ਹੈ, ਕਿਉਂਕਿ ਉਸ ਵਿਰੁੱਧ ਐਕਟ ਤਹਿਤ ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਸ਼ੁਰੂ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ ਅਤੇ ਅਜੇ ਤੱਕ ਪੂਰੀਆਂ ਨਹੀਂ ਹੋਈਆਂ ਸਨ। ਹਾਈ ਕੋਰਟ ਨੇ 19 ਜੂਨ, 1984 ਨੂੰ ਚਾਰ ਵੱਖਰੇ ਹੁਕਮਾਂ ਰਾਹੀਂ ਚਾਰੇ ਪਟੀਸ਼ਨਾਂ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ। ਪਟੀਸ਼ਨਰ ਨੇ ਇਸ ਕੋਰਟ ਵਿੱਚ ਸੰਵਿਧਾਨ ਦੇ ਆਰਟੀਕਲ 136 ਤਹਿਤ ਉਪਰੋਕਤ ਚਾਰ ਹੁਕਮਾਂ ਦੇ ਵਿਰੁੱਧ ਅਪੀਲ ਦੀ ਇਜਾਜ਼ਤ ਲਈ ਇਹ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਹੈ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਵਿਚਾਰ ਲਈ ਇੱਕ ਹੀ ਗੱਲ ਹੈ ਕਿ ਕੀ ਐਕਟ ਦੀ ਧਾਰਾ 276C ਅਤੇ ਧਾਰਾ 277 ਅਤੇ ਭਾਰਤੀ ਦੰਡ ਵਿਧਾਨ ਦੀਆਂ ਧਾਰਾਵਾਂ 193 ਅਤੇ 196 ਤਹਿਤ ਅਪਰਾਧਾਂ ਲਈ ਵਿਭਾਗ ਦੁਆਰਾ ਸ਼ੁਰੂ ਕੀਤੀਆਂ ਗਈਆਂ ਮੁਕੱਦਮੇਬਾਜ਼ੀਆਂ ਜਦੋਂ ਕਿ ਐਕਟ ਤਹਿਤ ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਲੰਬਿਤ ਹਨ, ਉਹ ਇਸ ਅਧਾਰ ਤੇ ਰੱਦ ਕਰਨ ਯੋਗ ਹਨ ਕਿ ਉਹ ਕਾਇਮ ਨਹੀਂ ਕੀਤੀਆਂ ਜਾ ਸਕਦੀਆਂ। ਐਕਟ ਦੀਆਂ ਧਾਰਾ 276C ਅਤੇ 277 ਦੇ ਮਹੱਤਵਪੂਰਨ ਭਾਗ ਇਸ ਤਰ੍ਹਾਂ ਹਨ: Case: P. D E F G The Order of the Court. was delivered by VENKATARAMIAH, J. The petitioner is the proprietor of M/s. Ratnam Food Stuff Co., Tuticorin. He is an assessee under the Income-tax Act, 1961 (hereinafter called 'the Act'). For the assess-ment year 1977-78, he filed his return under the Act on January 20, 1978 disclosing an income of Rs. 13,380/- alongwith the profit and Joss account, trial balance, income tax adjustment statement and a copy of the capital account. The return was accepted. On August 20 and 21, 1981, a search was conducted at the residence of the peti-tioner under section 132 of the Act which resulted in the seizure of several documents and account books which revealed the suppression of purchase of chicory seeds, the existence of several bank accounts. fixed deposits, investments in the names of his wife and daughters and several bank accounts not disclosei in the statements filed alongwith the return. The trading and profit and Joss account for the assessment year 1977-78 filed alongwith the return showed that be had purchased chicory seeds of the value of Rs. 65,797/- as against Rs. 2,15,729/- as per the seized accounts. i here were several other wrong statements in the accounts. On the basis of the allegation that the petitioner had deliberately filed a false return and had kept false accounts with the intention of using them as genuine evidence in the assessment proceed-ings, a complaint was filed against him in the Court of the Additional Chief Judicial Magistrate (Economic Offences), Madurai for taking action against him for offence punishable under section 276C and sec-tion 277 of the Act and under sections 193 and 196 of the Indian Penal Code. Similarly three other complaints were filed against the petitioner for the same offences said to have been comitted by him in respect of three succeeding assessment years 1978-79, 1979-80 and 1980-81 before the same Magistrate. The petitioner thereupon filed four petitions under section 482 of the Code of Criminal Procedure before the High Court of Madras requesting it to quash the said pro-ceedings contending that the launching of the prosecution in each of the four cases was a premature one on the ground that the reassess-ment proceedings started against him under the Act had not been completed. All the four petitions were dismissed by the High Court by four separate orders dated June 19, 1984. The petitioner has filed this petition before this Court under Article 136 of the Constitution for leave to appeal against the above said four orders of the High Court. The only point which arises for consideration in this case is whether prosecutions for offences punishable under section 276C and section 277 of the Act and under sections. 19:1 and 196 of the Indian Penal Code instituted by the Department while the reassessment pro-ceedings under the Act are pending arc liable to be quashed on the ground that they were not maintainable. The material parts of section 276C and 277 of the Act read as follows : B c D "276C. Wilful attempt to evade tax etc.-(1) If a person wil-fully attempts in any manner whatsoever to evade any tax, penalty or interest chargeable or imposable under this Act, 'he shall, without prejudice to any penalty that may be imposable on him under any other provision of this Act, be punishable,- E (i) in a case where the amount sought to be evaded exceeds one hundred thousand rupees, with rigorous imprisonment for a term which shall not be less than six months but which may extend to seven years and with fine ; (ii) in any other case, with rigorous imprisonment for a term which shall not be Jess than three months but which may extend to three years and with fine. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਵਿਚਾਰ ਲਈ ਇੱਕ ਹੀ ਗੱਲ ਹੈ ਕਿ ਕੀ ਐਕਟ ਦੀ ਧਾਰਾ 276C ਅਤੇ ਧਾਰਾ 277 ਅਤੇ ਭਾਰਤੀ ਦੰਡ ਵਿਧਾਨ ਦੀਆਂ ਧਾਰਾਵਾਂ 193 ਅਤੇ 196 ਤਹਿਤ ਅਪਰਾਧਾਂ ਲਈ ਵਿਭਾਗ ਦੁਆਰਾ ਸ਼ੁਰੂ ਕੀਤੀਆਂ ਗਈਆਂ ਮੁਕੱਦਮੇਬਾਜ਼ੀਆਂ ਜਦੋਂ ਕਿ ਐਕਟ ਤਹਿਤ ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਲੰਬਿਤ ਹਨ, ਉਹ ਇਸ ਅਧਾਰ ਤੇ ਰੱਦ ਕਰਨ ਯੋਗ ਹਨ ਕਿ ਉਹ ਕਾਇਮ ਨਹੀਂ ਕੀਤੀਆਂ ਜਾ ਸਕਦੀਆਂ। ਐਕਟ ਦੀਆਂ ਧਾਰਾ 276C ਅਤੇ 277 ਦੇ ਮਹੱਤਵਪੂਰਨ ਭਾਗ ਇਸ ਤਰ੍ਹਾਂ ਹਨ: “276C. ਟੈਕਸ ਆਦਿ ਤੋਂ ਬਚਣ ਦਾ ਜਾਣਬੁੱਝ ਕੇ ਯਤਨ—(1) ਜੇ ਕੋਈ ਵਿਅਕਤੀ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਇਸ ਐਕਟ ਤਹਿਤ ਚਾਰਜ ਕੀਤੇ ਜਾਣ ਵਾਲੇ, ਲਗਾਏ ਜਾਣ ਵਾਲੇ ਜਾਂ ਅਦਾ ਕਰਨ ਵਾਲੇ ਟੈਕਸ, ਜੁਰਮਾਨਾ ਜਾਂ ਵਿਆਜ ਤੋਂ ਬਚਣ ਦਾ ਜਾਣਬੁੱਝ ਕੇ ਯਤਨ ਕਰਦਾ ਹੈ, ਤਾਂ ਉਸਨੂੰ ਇਸ ਐਕਟ ਦੇ ਕਿਸੇ ਹੋਰ ਉਪਬੰਧ ਤਹਿਤ ਲਾਗੂ ਹੋ ਸਕਣ ਵਾਲੇ ਕਿਸੇ ਵੀ ਜੁਰਮਾਨੇ ਤੋਂ ਬਿਨਾਂ,(i) ਜੇ ਬਚਾਇਆ ਜਾਣ ਵਾਲੀ ਰਾਸ਼ੀ ਇੱਕ ਲੱਖ ਰੁਪਏ ਤੋਂ ਵੱਧ ਹੈ, ਤਾਂ ਸਖ਼ਤ ਕੈਦ ਦੀ ਸਜ਼ਾ ਹੋਵੇਗੀ, ਜੋ ਛੇ ਮਹੀਨਿਆਂ ਤੋਂ ਘੱਟ ਨਹੀਂ ਹੋਵੇਗੀ, ਪਰ ਸੱਤ ਸਾਲ ਤੱਕ ਹੋ ਸਕਦੀ ਹੈ ਅਤੇ ਜੁਰਮਾਨਾ;(ii) ਹੋਰ ਕਿਸੇ ਵੀ ਮਾਮਲੇ ਵਿੱਚ, ਸਖ਼ਤ ਕੈਦ ਦੀ ਸਜ਼ਾ ਹੋਵੇਗੀ, ਜੋ ਤਿੰਨ ਮਹੀਨਿਆਂ ਤੋਂ ਘੱਟ ਨਹੀਂ ਹੋਵੇਗੀ, ਪਰ ਤਿੰਨ ਸਾਲ ਤੱਕ ਹੋ ਸਕਦੀ ਹੈ ਅਤੇ ਜੁਰਮਾਨਾ।(2) ਜੇ ਕੋਈ ਵਿਅਕਤੀ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਇਸ ਐਕਟ ਤਹਿਤ ਟੈਕਸ, ਜੁਰਮਾਨਾ ਜਾਂ ਵਿਆਜ ਦੇ ਭੁਗਤਾਨ ਤੋਂ ਬਚਣ ਦਾ ਜਾਣਬੁੱਝ ਕੇ ਯਤਨ ਕਰਦਾ ਹੈ, ਤਾਂ ਉਸਨੂੰ ਇਸ ਐਕਟ ਦੇ ਕਿਸੇ ਹੋਰ ਉਪਬੰਧ ਤਹਿਤ ਲਾਗੂ ਹੋ ਸਕਣ ਵਾਲੇ ਕਿਸੇ ਵੀ ਜੁਰਮਾਨੇ ਤੋਂ ਬਿਨਾਂ, ਸਖ਼ਤ ਕੈਦ ਦੀ ਸਜ਼ਾ ਹੋਵੇਗੀ, ਜੋ ਤਿੰਨ ਮਹੀਨਿਆਂ ਤੋਂ ਘੱਟ ਨਹੀਂ ਹੋਵੇਗੀ, ਪਰ ਤਿੰਨ ਸਾਲ ਤੱਕ ਹੋ ਸਕਦੀ ਹੈ ਅਤੇ ਜੁਰਮਾਨਾ।” ਸਭ ਤੋਂ ਪਹਿਲਾਂ ਇਹ ਕਿਹਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਕਾਨੂੰਨ ਵਿੱਚ ਕੋਈ ਵੀ ਉਪਬੰਧ ਨਹੀਂ ਹੈ ਜੋ ਇਹ ਪ੍ਰਦਾਨ ਕਰਦਾ ਹੋਵੇ ਕਿ ਅਸੈਸੀ ਵਿਰੁੱਧ ਸ਼ੁਰੂ ਕੀਤੀਆਂ ਗਈਆਂ ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਪੂਰੀਆਂ ਹੋਣ ਤੱਕ ਸਵਾਲ ਵਿੱਚ ਅਪਰਾਧਾਂ ਲਈ ਮੁਕੱਦਮਾ ਚਲਾਇਆ ਨਹੀਂ ਜਾ ਸਕਦਾ। ਐਕਟ ਦੀ ਧਾਰਾ 279 ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ ਕਿ ਕਿਸੇ ਵਿਅਕਤੀ ਨੂੰ ਧਾਰਾ 276C ਜਾਂ ਧਾਰਾ 277 ਦੇ ਤਹਿਤ ਦੰਡਨੀਯ ਅਪਰਾਧ ਲਈ ਕਮਿਸ਼ਨਰ ਦੇ ਹੁਕਮ ਤੋਂ ਬਿਨਾਂ ਮੁਕੱਦਮਾ ਨਹੀਂ ਚਲਾਇਆ ਜਾ ਸਕਦਾ। ਇਹ ਵੀ ਪ੍ਰਦਾਨ ਕਰਦਾ ਹੈ ਕਿ ਜੇ ਕੋਈ ਵਿਅਕਤੀ ਵਿਰੁੱਧ ਧਾਰਾ 271 ਦੇ ਉਪ-ਧਾਰਾ (1) ਦੇ ਕਲਾਜ (iii) ਤਹਿਤ ਜੁਰਮਾਨਾ ਲਗਾਇਆ ਜਾਂਦਾ ਹੈ ਜਾਂ ਲਗਾਇਆ ਜਾ ਸਕਦਾ ਹੈ, ਤਾਂ ਧਾਰਾ 273A ਤਹਿਤ ਹੁਕਮ ਦੁਆਰਾ ਘਟਾਇਆ ਜਾਂਦਾ ਹੈ ਜਾਂ ਮਾਫ਼ ਕੀਤਾ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਉਸ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ ਉਸ ਵਿਅਕਤੀ ਵਿਰੁੱਧ ਕੋਈ ਕਾਰਵਾਈ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਕਮਿਸ਼ਨਰ ਨੂੰ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਹੋਣ ਤੋਂ ਪਹਿਲਾਂ ਜਾਂ ਬਾਅਦ ਵਿੱਚ ਵੀ ਅਜਿਹੇ ਕਿਸੇ ਵੀ ਅਪਰਾਧ ਨੂੰ ਸੌਦਾ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਹੈ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਇਹ ਦਾਅਵਾ ਨਹੀਂ ਕੀਤਾ ਜਾਂਦਾ ਕਿ ਕਮਿਸ਼ਨਰ ਨੇ ਸ਼ਿਕਾਇਤਾਂ ਦੀ ਸ਼ੁਰੂਆਤ ਲਈ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਨਹੀਂ ਕੀਤੀ। ਕਾਰਵਾਈ ਦੀ ਸ਼ੁਰੂਆਤ ਵਿੱਚ ਕੋਈ ਹੋਰ ਕਾਨੂੰਨੀ ਰੁਕਾਵਟ ਨਹੀਂ ਹੈ, ਸਿਵਾਏ ਇਸ ਗੱਲ ਤੋਂ ਕਿ ਜੇ ਪਟੀਸ਼ਨਰ ਮੁੜ ਮੁਲਾਂਕਣ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਵਿੱਚ ਬਰੀ ਹੋ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਮੁਕੱਦਮੇਬਾਜ਼ੀ ਨੂੰ ਰੱਦ ਕਰਨਾ ਪਵੇਗਾ। ਇਹ ਸੱਚ ਹੈ ਕਿ ਜਿਵੇਂ ਕਿ ਇਸ ਅਦਾਲਤ ਨੇ ਉਮਾ ਚਰਨ ਅਤੇ ਹੋਰ ਬਨਾਮ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਕੇਂਦਰੀ ਸਰਕਲ, ਅੰਮ੍ਰਿਤਸਰ ਵਿੱਚ ਟਿੱਪਣੀ ਕੀਤੀ, ਮੁਕੱਦਮਾ ਚਲਾਉਣਾ ਐਕਟ ਤਹਿਤ ਸੰਬੰਧਿਤ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈਆਂ ਵਿੱਚ ਅਸੈਸੀ ਦੇ ਹੱਕ ਵਿੱਚ ਰਿਕਾਰਡ ਕੀਤੀ ਗਈ ਖੋਜ ਦੇ ਪ੍ਰਕਾਸ਼ ਵਿੱਚ ਰੱਦ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ, ਪਰ ਉਹ ਫੈਸਲਾ ਇਸ ਸਿੱਧੇ ਦਾ ਅਧਾਰ ਨਹੀਂ ਹੈ ਕਿ ਜਦ ਤੱਕ ਐਕਟ ਦੇ ਤਹਿਤ ਕੋਈ ਕਾਰਵਾਈ ਲੰਬਿਤ ਹੈ, ਧਾਰਾ 276C ਅਤੇ ਧਾਰਾ 277 ਤਹਿਤ ਕੋਈ ਵੀ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਐਕਟ ਦੇ ਤਹਿਤ ਕਿਸੇ ਵੀ ਅਪੀਲ ਜਾਂ ਹਵਾਲੇ ਵਿੱਚ ਸਫਲਤਾ ਦੀ ਉਮੀਦ ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ ਦੀ ਸ਼ੁਰੂਆਤ ਵਿੱਚ ਰੁਕਾਵਟ ਨਹੀਂ ਪਾ ਸਕਦੀ। ਅਪਰਾਧਿਕ ਮਾਮਲੇ ਵਿੱਚ, ਸਵਾਲ ਵਿੱਚ ਅਪਰਾਧ ਦੇ ਸਾਰੇ ਤੱਤਾਂ ਨੂੰ ਸਥਾਪਤ ਕਰਨਾ ਪੈਂਦਾ ਹੈ ਤਾਂ ਜੋ ਦੋਸ਼ੀ ਨੂੰ ਦੋਸ਼ੀ ਠਹਿਰਾਇਆ ਜਾ ਸਕੇ। ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਨੂੰ ਐਕਟ ਤਹਿਤ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਦੇ ਨਤੀਜੇ ਨੂੰ ਢੁਕਵਾਂ ਧਿਆਨ ਦੇਣਾ ਚਾਹੀਦਾ ਹੈ, ਪਰ ਇਹ ਨਹੀਂ ਮਤਲਬ ਕਿ ਐਕਟ ਤਹਿਤ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਦਾ ਨਤੀਜਾ ਅਪਰਾਧਿਕ ਅਦਾਲਤ 'ਤੇ ਬੰਨ੍ਹਦਾਰ ਹੋਵੇਗਾ। ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਨੂੰ ਆਪਣੇ ਵੱਲੋਂ ਸੁਤੰਤਰ ਤੌਰ 'ਤੇ ਮਾਮਲੇ ਦਾ ਫੈਸਲਾ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ। ਨਹੀਂ ਤਾਂ ਇਸ ਵਿੱਚ ਇੱਕ ਅਜਿਹੀ ਸਥਿਤੀ ਪੈਦਾ ਹੋ ਸਕਦੀ ਹੈ ਜਿੱਥੇ ਕੋਈ ਵੀ ਵਿਅਕਤੀ ਜੋ ਐਕਟ ਤਹਿਤ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਵਿੱਚ ਦੋਸ਼ੀ ਠਹਿਰਾਇਆ ਜਾਂਦਾ ਹੈ, ਉਹ ਅਪਰਾਧਿਕ ਮੁਕੱਦਮੇ ਤੋਂ ਬਚ ਜਾਵੇਗਾ। Case: P. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) E (i) in a case where the amount sought to be evaded exceeds one hundred thousand rupees, with rigorous imprisonment for a term which shall not be less than six months but which may extend to seven years and with fine ; (ii) in any other case, with rigorous imprisonment for a term which shall not be Jess than three months but which may extend to three years and with fine. G (2). If a person wilfully attempts in any manner whatso-ever to evade the payment of any tax, penalty or interest under this Act, he shall, without prejudice to any penalty that may be imposable on him under any other provision of this Act, be punishable with rigorous imprisonment for a -term which shall not be less than three months but which may extend to three. lI A B c D E F GI years and shall in the discretion of the court, also be liable to fine. False statement in verification etc.-Jf a person makes a statement in any verification under this Act or under any rule made thereunder, or delivers an account or statement which is false, and which he either knows or believes to be false, or does not believe to be true, he shall be punishable,- (i) in a case where the amount of tax, which would have been evaded if the statement or account had been accepted as true, exceeds one hundred thousand rupees, with rigorous imprisonment for a term which shall not be less then six months but which may extend to seven years and with fine. (ii) in any other case, with rigorous imprisonment for a term which shall not be Jess than three months but which may extend to three years and with fine." The relevant parts of sections 193 and 196 of the Indian Penal Code read thus : "193. Punishment for false evidence.-Whoever intentionally gives false evidence in any stage of a judicial proceeding, or fabricates false evidence for the purpose of being used in any stage of a judicial proceeding, shall be punished with imprison-ment of either description for a term which may extend to seven years, and shall also be liable to fine ; and whoever intentionally gives or fabricates false evidence in any other case, shall be punished with imprisonment of either description for a term which extend to three years, and shall also be liable to fine. PERUMAL, FIRST INCOME-TAX OFFICER, TUTICORIN [[1985] 1 S.C.R. 536] (1985) ਜਿਵੇਂ ਕਿ ਅਪਰਾਧਿਕ ਅਦਾਲਤ ਵਿੱਚ ਹੁੰਦਾ ਹੈ, ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਦੀ ਹਾਈ ਕੋਰਟ ਨੇ ਅਜਿਹੀਆਂ ਪਰਿਸਥਿਤੀਆਂ ਵਿੱਚ ਸੰਜਨਾਵਾਂ ਦੀ ਬਣਤਰ ਬਾਰੇ ਨਿਯਮਾਂ ਨੂੰ ਸਹੀ ਢੰਗ ਨਾਲ ਲਾਗੂ ਕੀਤਾ ਹੈ ਸ਼੍ਰੀ ਆਈ.ਐਸ. ਰਹਿਮਾਨ ਰਾਜਾਜੀ ਏ.ਡੀ. ਪ੍ਰੋਡ. ਬਨਾਮ ਆਮਦਨ-ਕਰ ਅਧਿਕਾਰੀ, ਵਾਰਡ ਹੁਸ਼ਿਆਰਪੁਰ ਅਤੇ ਹੋਰ। ਪਰ ਅਸੀਂ ਕੋਲਕਾਤਾ ਦੀ ਹਾਈ ਕੋਰਟ ਦੁਆਰਾ ਪ੍ਰਗਟ ਕੀਤੀ ਗਈ ਰਾਇ ਨਾਲ ਸਹਿਮਤ ਨਹੀਂ ਹਾਂ। ਉਸ ਕੇਸ ਵਿੱਚ ਮੁਲਜ਼ਮ ਵਿਰੁੱਧ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 277 ਤਹਿਤ ਦੰਡਨੀਯ ਅਪਰਾਧ ਲਈ ਸ਼ਿਕਾਇਤ ਕੀਤੀ ਗਈ ਸੀ, ਮੁੱਖ ਮੈਟਰੋਪੋਲੀਟਨ ਮੈਜਿਸਟਰੇਟ ਨੇ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕੀਤੀ ਸੀ। ਇਸ ਤੋਂ ਬਾਅਦ ਮੁਲਜ਼ਮ ਨੇ ਕੋਲਕਾਤਾ ਦੀ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਉਸ ਸਮੇਂ ਦੌਰਾਨ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 271(1)(c) ਤਹਿਤ ਸ਼ੁਰੂ ਕੀਤੀ ਗਈ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈ ਦੇ ਅੰਤ ਤੱਕ ਕੋਈ ਵੀ ਸ਼ਿਕਾਇਤ ਦਾਇਰ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ ਸੀ। ਮੁਲਜ਼ਮ ਦਾ ਦਾਅਵਾ ਸੀ ਕਿ ਮੁਕੱਦਮਾ ਕੁਦਰਤੀ ਨਿਆਂ ਦੇ ਸਿਧਾਂਤਾਂ ਦੇ ਵਿਰੁੱਧ ਸੀ ਕਿਉਂਕਿ ਉਸ ਨੂੰ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈ ਵਿੱਚ ਉਸਦੇ ਹੱਕ ਵਿੱਚ ਰਿਕਾਰਡ ਕੀਤੇ ਜਾਣ ਵਾਲੇ ਫੈਸਲੇ ਦੇ ਫਾਇਦੇ ਤੋਂ ਵਾਂਜਿਆ ਜਾਵੇਗਾ। ਵਿਭਾਗ ਦੀ ਤਰਫੋਂ ਇਹ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਸੀ ਕਿ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 271(1)(c) ਤਹਿਤ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈ ਦਾ ਅਦਾਲਤ ਦੇ ਚੈਪਟਰ XXII ਤਹਿਤ ਸ਼ੁਰੂ ਕੀਤੇ ਗਏ ਮੁਕੱਦਮੇ ਦੀ ਬਣਤਰ 'ਤੇ ਕੋਈ ਸਿੱਧਾ ਅਸਰ ਨਹੀਂ ਪੈਂਦਾ। ਹਾਈ ਕੋਰਟ ਨੇ ਇਹ ਰਾਇ ਦਿੱਤੀ ਕਿ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 279(1A) ਦੇ ਪ੍ਰਾਵਧਾਨ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈ ਪੂਰੀ ਹੋਣ ਤੋਂ ਪਹਿਲਾਂ ਮੁਕੱਦਮਾ ਸ਼ੁਰੂ ਕਰਨ ਦੀ ਜ਼ਰੂਰਤ ਨੂੰ ਸਥਾਪਿਤ ਕਰਦੇ ਹਨ ਅਤੇ ਇਸ ਲਈ ਜਦ ਤੱਕ ਜੁਰਮਾਨਾ ਕਾਰਵਾਈ ਲੰਬਿਤ ਹੈ, ਅਪਰਾਧਿਕ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 279(1A) ਸਿਰਫ ਇਹ ਕਹਿੰਦੀ ਹੈ ਕਿ ਜੇਕਰ ਕਿਸੇ ਵਿਅਕਤੀ 'ਤੇ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 271 ਦੇ ਉਪ-ਧਾਰਾ (1) ਦੇ ਕਲਾਮ (iii) ਤਹਿਤ ਲਗਾਇਆ ਗਿਆ ਜੁਰਮਾਨਾ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 273A ਤਹਿਤ ਇੱਕ ਹੁਕਮ ਦੁਆਰਾ ਘਟਾਇਆ ਜਾਂਦਾ ਹੈ ਜਾਂ ਰਦ ਕੀਤਾ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 276C ਜਾਂ ਧਾਰਾ 277 ਦੇ ਸਬੰਧ ਵਿੱਚ ਉਸ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ ਜਿਸ ਸਬੰਧ ਵਿੱਚ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਹੈ, ਉਸ ਵਿਅਕਤੀ ਵਿਰੁੱਧ ਕੋਈ ਕਾਰਵਾਈ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 273A(1)(ii) ਪ੍ਰਾਵਧਾਨ ਕਰਦੀ ਹੈ ਕਿ ਕਾਨੂੰਨ ਵਿੱਚ ਦਰਸਾਏ ਗਏ ਕਿਸੇ ਵੀ ਵਿਵਸਥਾ ਤੋਂ ਬਿਨਾਂ, ਕਮਿਸ਼ਨਰ ਆਪਣੀ ਵਿਚਾਰਧਾਰਾ ਵਿੱਚ, ਚਾਹੇ ਉਹ ਆਪਣੀ ਪਹਿਲ ਤੇ ਹੋਵੇ ਜਾਂ ਕਿਸੇ ਹੋਰ ਤਰ੍ਹਾਂ, ਜੇਕਰ ਉਥੇ ਦਰਸਾਏ ਗਏ ਹਾਲਾਤ ਪੂਰੇ ਹੋ ਜਾਣ ਤਾਂ ਜੁਰਮਾਨਾ ਨੂੰ ਘਟਾ ਸਕਦਾ ਹੈ ਜਾਂ ਰਦ ਕਰ ਸਕਦਾ ਹੈ। ਕਮਿਸ਼ਨਰ ਨੂੰ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 273A ਤਹਿਤ ਦਿੱਤੀ ਗਈ ਸ਼ਕਤੀ ਇੱਕ ਉੱਚਤਮ ਸ਼ਕਤੀ ਹੈ ਜਿਸ ਨੂੰ ਉਹ ਆਪਣੀ ਵਿਚਾਰਧਾਰਾ ਵਿੱਚ ਵਰਤ ਸਕਦਾ ਹੈ। ਇਹ ਸਿਰਫ ਉਸ ਸਥਿਤੀ ਵਿੱਚ ਹੁੰਦਾ ਹੈ ਜਦੋਂ ਕਮਿਸ਼ਨਰ ਆਪਣੀ ਵਿਚਾਰਧਾਰਾ ਦੇ ਅਧੀਨ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 271(1)(iii) ਤਹਿਤ ਲਗਾਇਆ ਗਿਆ ਜਾਂ ਲਾਗੂ ਕੀਤਾ ਗਿਆ ਜੁਰਮਾਨਾ ਘਟਾਉਂਦਾ ਹੈ ਜਾਂ ਰਦ ਕਰਦਾ ਹੈ, ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 279(1A) ਕਾਰਵਾਈ ਵਿੱਚ ਆਉਂਦੀ ਹੈ ਅਤੇ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 276C ਜਾਂ ਧਾਰਾ 277 ਤਹਿਤ ਮੁਕੱਦਮਾ ਚਲਾਉਣ 'ਤੇ ਇੱਕ ਕਾਨੂੰਨੀ ਰੋਕ ਵਜੋਂ ਕੰਮ ਕਰਦੀ ਹੈ। ਇਹ ਇਹ ਨਹੀਂ ਕਹਿੰਦਾ ਕਿ ਸਿਰਫ ਇਹ ਸੰਭਾਵਨਾ ਹੈ ਕਿ ਕਮਿਸ਼ਨਰ ਇਸ ਵਿਚਾਰਧਾਰਾ ਦੀ ਵਰਤੋਂ ਕਰ ਸਕਦਾ ਹੈ ਕਿ ਇੱਕ ਸੰਭਾਵਨਾ ਹੈ। ਧਾਰਾ 271A ਤਹਿਤ ਇੱਕ ਹੁਕਮ ਪਾਸ ਕਰਦਿਆਂ, ਮੁਕੱਦਮਾ ਦੀ ਸ਼ੁਰੂਆਤ ਨਹੀਂ ਕੀਤੀ ਜਾਵੇਗੀ। ਕਲਕੱਤਾ ਦੀ ਹਾਈ ਕੋਰਟ ਦੁਆਰਾ ਦਿੱਤਾ ਗਿਆ ਕਾਰਨ, ਇਸ ਲਈ, ਸਾਨੂੰ ਪਸੰਦ ਨਹੀਂ ਆਉਂਦਾ। ਇਹ ਹੋ ਸਕਦਾ ਹੈ ਕਿ ਕਿਸੇ ਉਪਯੁਕਤ ਮਾਮਲੇ ਵਿੱਚ ਫੌਜਦਾਰੀ ਅਦਾਲਤ ਆਪਣੀ ਵਿਚਾਰਧੀਨ ਸ਼ਕਤੀ ਦੇ ਤਹਿਤ ਕੋਡ ਆਫ ਕ੍ਰਿਮੀਨਲ ਪ੍ਰੋਸੀਜਰ ਦੀ ਧਾਰਾ 309 ਦੇ ਅਧੀਨ ਇੱਕ ਫੌਜਦਾਰੀ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਮੁਲਤਵੀ ਕਰ ਸਕਦੀ ਹੈ ਜਾਂ ਮੁਲਤਵੀ ਕਰ ਸਕਦੀ ਹੈ, ਜੇ ਕੋਈ ਕਾਰਵਾਈ ਜੋ ਕਿ ਇਸ ਤੋਂ ਪਹਿਲਾਂ ਉਸਦੇ ਸਾਹਮਣੇ ਚੱਲ ਰਹੀ ਕਾਰਵਾਈ ਦਾ ਸੰਬੰਧ ਰੱਖਦੀ ਹੈ, ਬਹੁਤ ਜਲਦੀ ਹੋਣ ਵਾਲੀ ਹੈ, ਤਾਂ ਜੋ ਇਹ ਉਸ ਵਿੱਚ ਪਾਸ ਕੀਤੇ ਜਾਣ ਵਾਲੇ ਹੁਕਮ ਨੂੰ ਵੀ ਵਿਚਾਰ ਵਿੱਚ ਲਿਆ ਸਕੇ। ਇੱਥੇ ਵੀ ਵਿਚਾਰਧੀਨ ਸ਼ਕਤੀ ਨੂੰ ਨਿਆਂਇਕ ਤੌਰ 'ਤੇ ਅਤੇ ਇਸ ਤਰ੍ਹਾਂ ਵਰਤਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਫੌਜਦਾਰੀ ਕਾਰਵਾਈਆਂ ਦੇ ਉਦੇਸ਼ ਨੂੰ ਨਾ ਖ਼ਤਮ ਕੀਤਾ ਜਾਵੇ। ਕੋਈ ਸਖ਼ਤ ਨਿਯਮ ਨਹੀਂ ਹੈ ਜੋ ਇੱਕ ਫੌਜਦਾਰੀ ਅਦਾਲਤ ਨੂੰ ਇੱਕ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਨੂੰ ਅਨਿਸ਼ਚਿਤ ਕਾਲ ਲਈ ਜਾਂ ਬਹੁਤ ਲੰਬੇ ਸਮੇਂ ਲਈ ਮੁਲਤਵੀ ਕਰਨ ਲਈ ਮਜਬੂਰ ਕਰਦਾ ਹੈ, ਸਿਰਫ਼ ਇਸ ਲਈ ਕਿ ਕੋਈ ਕਾਰਵਾਈ ਜੋ ਕਿ ਇਸ ਨਾਲ ਕੁਝ ਸੰਬੰਧ ਰੱਖਦੀ ਹੈ ਕਿਤੇ ਹੋਰ ਲੰਬਿਤ ਹੈ। ਪਰ ਇਹ, ਹਾਲਾਂਕਿ, ਮੁਕੱਦਮਾ ਨੂੰ ਬਰਕਰਾਰ ਰੱਖਣ ਦੇ ਸਵਾਲ ਨਾਲ ਕੋਈ ਸੰਬੰਧ ਨਹੀਂ ਹੈ। ਉਨ੍ਹਾਂ ਹਾਲਾਤਾਂ ਵਿੱਚ ਮੁਕੱਦਮਾ ਇਸ ਅਧਾਰ 'ਤੇ ਰੱਦ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ ਕਿ ਇਹ ਇੱਕ ਅਕਾਲ ਵਾਲਾ ਹੈ। ਕਾਨੂੰਨ ਦੀਆਂ ਸੰਬੰਧਤ ਵਿਵਸਥਾਵਾਂ ਦੇ ਸਾਵਧਾਨੀਪੂਰਵਕ ਵਿਚਾਰ ਕਰਨ ਤੋਂ ਬਾਅਦ, ਅਸੀਂ ਇਸ ਨਜ਼ਰੀਏ 'ਤੇ ਹਾਂ ਕਿ ਮੁੜ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈਆਂ ਦੀ ਲੰਬਿਤਤਾ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 276C ਜਾਂ ਧਾਰਾ 277 ਤਹਿਤ ਦੰਡਨੀਯ ਅਪਰਾਧਾਂ ਲਈ ਫੌਜਦਾਰੀ ਮੁਕੱਦਮਾ ਦੀ ਸ਼ੁਰੂਆਤ ਦਾ ਰੁਕਾਵਟ ਨਹੀਂ ਬਣ ਸਕਦੀ। ਫੌਜਦਾਰੀ ਕਾਰਵਾਈਆਂ ਦੀ ਸ਼ੁਰੂਆਤ ਇਸ ਹਾਲਤ ਵਿੱਚ ਅਦਾਲਤ ਦੀ ਕਾਰਵਾਈ ਦਾ ਦੁਰੂਪਯੋਗ ਨਹੀਂ ਹੋ ਸਕਦਾ। ਹਾਈ ਕੋਰਟ ਨੇ, ਇਸ ਲਈ, ਫੌਜਦਾਰੀ ਪ੍ਰੋਸੀਜਰ ਕੋਡ ਦੀ ਧਾਰਾ 482 ਤਹਿਤ ਪਟੀਸ਼ਨਰ ਵਿਰੁੱਧ ਸ਼ੁਰੂ ਕੀਤੇ ਗਏ ਮਾਮਲਿਆਂ ਵਿੱਚ ਮੁਕੱਦਮਾ ਕਾਰਵਾਈਆਂ ਨੂੰ ਰੱਦ ਕਰਨ ਤੋਂ ਇਨਕਾਰ ਕਰਨ ਵਿੱਚ ਸਹੀ ਸੀ। ਵਿਸ਼ੇਸ਼ ਛੱਡ ਪੱਤਰ, ਇਸ ਲਈ, ਰੱਦ ਕਰ ਦਿੱਤਾ ਜਾਂਦਾ ਹੈ। ਐਚ.ਐਸ.ਕੇ. 。ਪਟੀਸ਼ਨ ਰੱਦ ਕਰ ਦਿੱਤੀ ਗਈ ਹੈ Case: P. At the outset it has to be stated that there is no provision in law which provides th.at a prosecution !'or the offences in questiol! ca11not _>, 1AYAPPAN v. S.K. PERUMAL (Venkataramiah, J.) be launched until reassessment proceedings initiated against the asses-see are completed. Section 279 of the Act provides that a person shall not be proceeded against for an offence punishable under section 276C or section 277 of the Act except at the instance of the Com-missioner. It further provides that a person shall not be proceeded against for an offence punishable under those provisions in relation to the assessment for an assessment year in respect of which penalty is imposed or imposable on him under clause (iii) of sub-section (I) of section 271 has been reduced or waived by an order under section 273A. The Commissioner has the power either before or after the institution of proceedings to compound any such offence. In this case it is not claimed that the Commissioner has not initiated the proceed-ings for instituting the complaints. No other legal bar for the institution of the proceedings is urged except stating that in the event of the petitioner being exonerated in the reassessment proceedings, the pro-secutions may have to be dropped. It is true that as observed by this Court in Uttam Chand & Ors. v. Income-tax Officer, Central Circle, Amritsar(') the prosecution once initiated may be quashed in the light of a finding favourable to the assessec recorded by an authority under the A.ct subsequently in respect of the relevant assessment proceedings but that decision is no authority for the proposition that no proceed-ings can be initiated at all under section 276C and section 277 as long as some proceeding under the Act in which there is a chance of success of the assessee is pending. A mere expectation of success in some proceeding in appeal or reference under the Act cannot come in the way of the institution of the criminal proceedings under section 276C and section 277 of the Act. f n the criminal case all the ingredients of the offence in question have to be established in order to secure the conviction of the accused. The criminal court no doubt has to give due regard to the result of any pro-ceeding under the Act having a bearing on the question in issue and in an appropriate case it may drop the proceedings in the light of an order passed under the Act. It does not, however, mean that the result of a proceeding under the Act would be binding on the criminal court. The criminal court has to judge the case in-dependently on the evidence placed before it. Otherwise there is a danger of a contention being advanced that whenever the assessee or any other person liable under the Act has failed to convince the authorities in the proceedings under the Act that he ha> not delibera-tely made any false statement or that he has not fabricated any material evidence, the conviction of such person should invariably A B c D E F G A B c D E F .G Case: P.
