It appears that the appeal filed before the Commissioner
of Income Tax (Appeals) is still pending despite the fact that on 29.2.2012, this Court had passed an interim order not to make any coercive recovery pursuant to the assessment order and the notice of demand dated 30[th] December, 2010. It is high time that the said appeal is disposed of expeditiously.
We, accordingly, dispose of the writ petition with a direction to the Commissioner of Income Tax (Appeals) to dispose of the appeal in question within a period of three months from the date of receipt/production of a copy of this order before him by learned counsel for the Income Tax Department.
Until the decision on the appeal filed by the petitioner is
taken, the interim order passed on 29.2.2012 shall continue.
