ਅਸੈਸੀ ਆਟੋਮੋਬਾਈਲਾਂ ਵਿੱਚ ਕਾਰੋਬਾਰ ਕਰਦਾ ਹੈ ਅਤੇ ਮੋਟਰ ਦੇ ਸਪੇਅਰ ਪਾਰਟਸ ਵੀ ਵੇਚਦਾ ਹੈ। ਮੁਲਾਂਕਣ ਸਾਲ 1963-64 ਲਈ ਅਸੈਸੀ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਸ ਨੇ ਉੜੀਸਾ ਸਰਕਾਰ ਦੇ ਫਲੱਡ ਲੋਨ 1972 ਨੂੰ ਸਬਸਕ੍ਰਾਈਬ ਕਰਨ 'ਤੇ ਆਪਣੇ ਆਪ ਨੂੰ ਉਠਾਏ ਗਏ ਘਾਟੇ ਦਾ ਦਾਅਵਾ ਕੀਤਾ ਜੋ ਕਿ ਰੁਪਏ 53,650 ਸੀ। ਇਸ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਸ ਨੇ ਜੋ ਘਾਟਾ ਉਠਾਇਆ ਸੀ ਉਹ ਆਮਦਨ ਘਾਟਾ ਸੀ ਅਤੇ ਇਸ ਲਈ, ਭਵਿੱਖ ਦੇ ਸਾਲਾਂ ਲਈ ਮੁਨਾਫ਼ੇ ਖਿਲਾਫ ਕਟੌਤੀ ਯੋਗ ਸੀ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਅਤੇ ਆਮਦਨ ਕਰ ਅਪੀਲੇਟ ਕਮਿਸ਼ਨਰ ਨੇ ਅਸੈਸੀ ਦੇ ਦਾਅਵੇ ਨੂੰ ਨਕਾਰ ਦਿੱਤਾ। ਪਰ ਦੂਜੀ ਅਪੀਲ 'ਤੇ, ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਇਸ ਦਲੀਲ ਦਾ ਸਮਰਥਨ ਕੀਤਾ ਕਿ ਸਰਕਾਰੀ ਲੋਨ ਨੂੰ ਸਬਸਕ੍ਰਾਈਬ ਕਰਨਾ ਇਸ ਦੇ ਕਾਰੋਬਾਰ ਲਈ ਸਹਾਇਕ ਸੀ ਅਤੇ ਕਿ ਘਾਟਾ ਕਾਰੋਬਾਰ ਦੇ ਦੌਰਾਨ ਪੈਦਾ ਹੋਇਆ ਸੀ, ਅਤੇ ਇਸ ਲਈ, ਅਸੈਸੀ ਨੂੰ ਇਸ ਦਾਅਵੇ ਦੀ ਕਟੌਤੀ ਦਾ ਹੱਕਦਾਰ ਸੀ। ਪਰ ਹਾਈ ਕੋਰਟ ਨੇ ਆਮਦਨ ਦੇ ਹਵਾਲੇ ਤੋਂ ਇਸ ਨੂੰ ਸੰਦਰਭਿਤ ਕਰਦਿਆਂ ਇਸ ਨਜ਼ਰੀਏ ਨੂੰ ਰੱਖਿਆ ਕਿ ਘਾਟਾ ਇੱਕ ਪੂੰਜੀ ਘਾਟਾ ਸੀ। ਹਾਈ ਕੋਰਟ ਦਾ ਵਿਚਾਰ ਸੀ ਕਿ ਕੇਸ ਦੀ ਤੱਥਾਤਮਕ ਅਧਾਰਸ਼ਿਲਾ ਨੂੰ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਗਲਤ ਸਮਝਿਆ ਸੀ ਅਤੇ ਇਸ ਲਈ, ਇਹ ਸਬੂਤਾਂ ਨੂੰ ਮੁੜ ਜਾਂਚਣ ਅਤੇ ਆਪਣੇ ਤੱਥਾਂ ਦੀ ਖੋਜ ਦਾ ਹੱਕਦਾਰ ਸੀ। ਇਸ ਲਈ ਇਹ ਖਾਸ ਛੁੱਟੀ ਦੁਆਰਾ ਅਪੀਲ ਕੀਤੀ ਗਈ।
ਅਪੀਲ ਨੂੰ ਮਨਜ਼ੂਰ ਕਰਦਿਆਂ, ਅਦਾਲਤ,
ਫੈਸਲਾ: 1.1 ਜੇਕਰ ਕਰਦਾਤਾ ਨੇ ਸਰਕਾਰ ਨਾਲ ਆਪਣਾ ਕਾਰੋਬਾਰ ਵਧਾਉਣ ਜਾਂ ਆਪਣੇ ਕਾਰੋਬਾਰ ਲਈ ਅਧਿਕਾਰੀਆਂ ਦੀ ਚੰਗੀ ਮਰਜੀ ਬਣਾਈ ਰੱਖਣ ਦੇ ਉਦੇਸ਼ ਨਾਲ ਸਰਕਾਰੀ ਬੌਂਡ ਜਾਂ ਸਿਕਿਊਰਿਟੀਜ਼ ਖਰੀਦੀਆਂ ਸਨ, ਤਾਂ ਅਜਿਹੇ ਬੌਂਡ ਜਾਂ ਸਿਕਿਊਰਿਟੀਜ਼ ਦੀ ਵਿਕਰੀ 'ਤੇ ਹੋਈ ਘਾਟਾ ਇਕ ਕਾਰੋਬਾਰੀ ਘਾਟੇ ਵਜੋਂ ਮੰਨਿਆ ਜਾਵੇਗਾ।
1.2. ਘਟਨਾਵਾਂ ਦੇ ਕ੍ਰਮ ਅਤੇ ਸਰਕਾਰੀ ਆਰਡਰਾਂ ਦੀ ਪ੍ਰਾਪਤੀ ਨਾਲ ਨਿਵੇਸ਼ ਦੀ ਨਜ਼ਦੀਕੀ ਨੂੰ ਦੇਖਦਿਆਂ ਇਹ ਸਪੱਸ਼ਟ ਹੈ ਕਿ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਨਿਵੇਸ਼ ਕਰਦਾਤਾ ਦੀ ਵਿਕਰੀ ਨੂੰ ਅੱਗੇ ਵਧਾਉਣ ਅਤੇ ਉਸ ਦੇ ਕਾਰੋਬਾਰ ਨੂੰ ਬੂਸਟ ਦੇਣ ਲਈ ਕੀਤਾ ਗਿਆ ਸੀ। ਹਾਲਾਤਾਂ ਵਿੱਚ, ਨਿਵੇਸ਼ ਕਾਰੋਬਾਰੀ ਸੁਵਿਧਾ ਦੇ ਤੌਰ 'ਤੇ ਕਰਦਾਤਾ ਦੇ ਕਾਰੋਬਾਰ ਨੂੰ ਚਲਾਉਣ ਦੇ ਉਦੇਸ਼ ਨਾਲ ਕੀਤਾ ਗਿਆ ਸੀ ਅਤੇ ਇਸ ਲਈ ਨਿਵੇਸ਼ ਦੀ ਵਿਕਰੀ 'ਤੇ ਹੋਈ ਘਾਟਾ ਇਕ ਆਮਦਨ ਘਾਟਾ ਮੰਨਿਆ ਜਾਵੇਗਾ।
1.3. ਕਰਦਾਤਾ ਵੱਲੋਂ ਕਰਜ਼ ਵਿੱਚ ਨਿਵੇਸ਼ ਕਰਨ ਨਾਲ ਸਰਕਾਰੀ ਵਿਭਾਗਾਂ ਤੋਂ ਆਰਡਰਾਂ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਕੋਈ ਸਥਾਈ ਲਾਭ ਨਹੀਂ ਆਇਆ। ਰਿਕਾਰਡ 'ਤੇ ਮੌਜੂਦ ਸਮੱਗਰੀ ਦਿਖਾਉਂਦੀ ਹੈ ਕਿ 30 ਅਗਸਤ, 1961 ਨੂੰ 16 ਜੀਪਾਂ, 8 ਟਰੱਕਾਂ ਅਤੇ 4 ਇੱਕ ਟਨ ਪਿਕਅੱਪ ਵੈਨਾਂ ਦੀ ਖਰੀਦ ਕਰਨ ਦਾ ਫੈਸਲਾ ਕੀਤਾ ਗਿਆ ਸੀ। ਇਹ ਦਿਖਾਉਣ ਲਈ ਕੁਝ ਵੀ ਨਹੀਂ ਸੀ ਕਿ ਕਰਦਾਤਾ ਨੂੰ ਕਰਜ਼ ਵਿੱਚ ਨਿਵੇਸ਼ ਨੂੰ ਅਣਮਿੱਥੀ ਤੌਰ 'ਤੇ ਜਾਰੀ ਰੱਖਣ ਦਾ ਕੋਈ ਕਾਰਨ ਸੀ। ਨਿਵੇਸ਼ ਨੇ ਕੋਈ ਪੂੰਜੀ ਕਿਸਮ ਦੀ ਸੰਪਤੀ ਨਹੀਂ ਲਿਆਈ, ਅਤੇ ਮਾਮਲੇ ਦੀਆਂ ਹਾਲਾਤਾਂ ਵਿੱਚ ਕਰਦਾਤਾ ਦੁਆਰਾ ਭੋਗਿਆ ਗਿਆ ਘਾਟਾ ਇਕ ਆਮਦਨ ਘਾਟਾ ਸੀ ਅਤੇ ਕੋਈ ਪੂੰਜੀ ਘਾਟਾ ਨਹੀਂ ਸੀ।

(ਪੀ) ਲਿਮਟਿਡ, [1979] 119 ਆਈ.ਟੀ.ਆਰ. 335 (ਮਦ); ਆਮਦਨ ਕਰ-ਕਮਿਸ਼ਨਰ, ਤਮਿਲ ਨਾਡੂ-IV ਬਨਾਮ ਧੰਦਾਯੁਥਪਾਨੀ ਫਾਉਂਡਰੀ (ਪੀ) ਲਿਮਟਿਡ, [1980] 123 ਆਈ.ਟੀ.ਆਰ. 709 (ਮਦ) ਨੂੰ ਮਨਜ਼ੂਰੀ ਦਿੱਤੀ ਗਈ।
2. ਹੁਣ ਇਹ ਅਚਰਜ ਨਾਲ ਸਥਾਪਿਤ ਹੈ ਕਿ ਆਮਦਨ ਕਰ ਐਕਟ ਅਧੀਨ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਅੰਤਿਮ ਤੱਥ ਖੋਜ ਅਥਾਰਟੀ ਹੈ ਅਤੇ ਅਦਾਲਤ ਨੂੰ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਅਪੀਲੀ ਹੁਕਮ ਵਿੱਚ ਬਿਆਨ ਕੀਤੇ ਗਏ ਤੱਥਾਂ ਪਿੱਛੇ ਜਾਣ ਦਾ ਕੋਈ ਅਧਿਕਾਰ ਨਹੀਂ ਹੈ। ਅਦਾਲਤ ਇਹ ਕੇਵਲ ਤਦ ਹੀ ਕਰ ਸਕਦੀ ਹੈ ਜੇਕਰ ਉਹਨਾਂ ਨੂੰ ਸਮਰਥਨ ਦੇਣ ਵਾਲੇ ਕੋਈ ਸਬੂਤ ਨਾ ਹੋਣ ਜਾਂ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਤੱਥਾਂ ਦੇ ਨਿਰਧਾਰਣ ਵਿੱਚ ਕਾਨੂੰਨ ਵਿੱਚ ਗਲਤ ਦਿਸ਼ਾ ਨਿਰਧਾਰਿਤ ਕੀਤੀ ਹੋਵੇ। ਪਰ ਫਿਰ ਵੀ ਅਦਾਲਤ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਦਿੱਤੇ ਗਏ ਤੱਥਾਂ ਦੇ ਨਿਰਧਾਰਣ ਨੂੰ ਉਸ ਸਮੇਂ ਤੱਕ ਪਰੇਸ਼ਾਨ ਨਹੀਂ ਕਰ ਸਕਦੀ ਜਦ ਤੱਕ ਕਿ ਇਕ ਸਵਾਲ ਨੂੰ ਇਸ ਆਧਾਰ 'ਤੇ ਚੁਣੌਤੀ ਨਾ ਦਿੱਤੀ ਗਈ ਹੋਵੇ ਕਿ ਉਹਨਾਂ ਨੂੰ ਸਮਰਥਨ ਦੇਣ ਵਾਲੇ ਕੋਈ ਸਬੂਤ ਨਹੀਂ ਹਨ ਜਾਂ ਉਹ ਕਾਨੂੰਨ ਵਿੱਚ ਗਲਤ ਦਿਸ਼ਾ ਦੇ ਨਤੀਜੇ ਹਨ।

It claimed that the loss suffered by it was revenue loss and, therefore, deductible against the profits for future years. The Income Tax Officer and the Appellate Commissioner of Income Tax negatived the claim of the assessee. But ou second appeal, the Appellate Tribunal accepted the contention that the subscription to the Government loan was conducive to its business and that the loss arose in the course of the business, and that therefore, the assessee was entitled to a deduction of the loss claimed by it. But the High Court on a reference to it at the instance of the revenue, held that the loss was a capital loss. The High Court was of the view that the factual substratum of the case had been misconceived by the Appellate Tribunal and that it was, therefore, entitled to re-examine the evidence and arrive at its own findings of fact. Hence this appeal by special leave.

HELD: 1.1 Whether Government bonds or securities were pur-chased by the assessee with a view to increasing his business with the Government or with the object of retaining the goodwill of the authorities for the purpose of his business, the loss incurred on the sale of such bonds or securities was allowable as a business loss. l212F -GI
1.2. Having regard to the sequence of events and the close prox-imity of the investment with the receipt of Government orders i; is clear that the investment, in the instant case, was made in order to further the sales of the assessee and boost its business. In the circumstances, the investment was made by way of commercial expediency for the purpose of carrying on the assessee's business and therefore the loss suffered by the assessee on the sale of the investment must be regarded as a revenue loss. 1.3 No enduring benefit was brou~ht about by the assessee invest-ing in the loan so far as the orders from the Government Departments were concerned. The material on record shows that on August 30, 1961 it was decided to purchase 16 jeeps, 8 trucks and 4 one.tonne pick up vans. There was nothing to show that there was any reason for the assessee to hold on to the investment in the loan indefinitely. The invest-ment did not bring in an asset of a capital nature, and that in the circumstances of the case the loss suffered by the assessee was a revenue loss and not a capital loss. l212D-F]

ਪਟਨਾਇਕ, ਨਾਇਬ ਨਿਆਂਕਾ. ਇਹ ਅਪੀਲ ਖਾਸ ਇਜਾਜ਼ਤ ਦੁਆਰਾ ਕੀਤੀ ਗਈ ਹੈ ਅਤੇ ਉੜੀਸਾ ਦੀ ਉੱਚ ਅਦਾਲਤ ਦੇ ਫੈਸਲੇ ਦੇ ਖਿਲਾਫ ਹੈ ਅਤੇ ਅੰਤਿਮ ਸਵਾਲ ਉਠਾਉਂਦੀ ਹੈ ਕਿ ਕੀ ਕਰਦਾਤਾ ਦੁਆਰਾ ਭੁਗਤੀ ਗਈ ਘਾਟਾ ਇੱਕ ਪੂੰਜੀ ਘਾਟਾ ਹੈ ਜਾਂ ਰੈਵੇਨਿਊ ਘਾਟਾ।
ਕਰਦਾਤਾ ਆਟੋਮੋਬਾਈਲਾਂ ਵਿੱਚ ਕਾਰੋਬਾਰ ਕਰਦਾ ਹੈ ਅਤੇ ਮੋਟਰ ਸਪੇਅਰ ਪਾਰਟਸ ਵੀ ਵੇਚਦਾ ਹੈ। ਅਸੈਸਮੈਂਟ ਸਾਲ 1963-64 ਲਈ, ਸੰਬੰਧਿਤ ਲੇਖਾ ਦੀ ਅਵਧੀ ਸਾਲ ਮਾਰਚ 31, 1963 ਨੂੰ ਖਤਮ ਹੋਣ ਵਾਲੀ ਹੈ, ਕਰਦਾਤਾ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਸ ਨੇ ਆਪਣੀ ਗਾਹਕੀ ਨੂੰ ਉੜੀਸਾ ਨਦੀ ਕਮਿਸ਼ਨ ਫਲੱਡ ਲਿਟੀਗੇਸ਼ਨ ਵਿੱਚ 1962 ਵਿੱਚ ਤਿਆਗ ਦਿੱਤਾ, ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਸ ਨੇ ਭੁਗਤੀ ਗਈ ਘਾਟਾ ਰੈਵੇਨਿਊ ਘਾਟਾ ਸੀ, ਅਤੇ ਇਸ ਲਈ ਇਸ ਨੂੰ ਸਾਲ ਦੇ ਲਾਭਾਂ ਖਿਲਾਫ ਕਟੌਤੀ ਯੋਗ ਹੈ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਘਾਟੇ ਨੂੰ ਨਾਮਨਜ਼ੂਰ ਕਰ ਦਿੱਤਾ ਕਿਉਂਕਿ ਇਹ "ਇੱਕ ਪੂੰਜੀ ਘਾਟਾ ਸੀ। ਕਰਦਾਤਾ ਦੀ ਅਪੀਲ ਨੂੰ ਆਮਦਨ ਕਰ ਅਪੀਲੇਟ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਖਾਰਜ ਕਰ ਦਿੱਤਾ। ਪਰ ਦੂਜੀ ਅਪੀਲ 'ਤੇ ਆਮਦਨ ਕਰ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਕਰਦਾਤਾ ਦੇ ਦਾਅਵੇ ਨੂੰ ਸਵੀਕਾਰ ਕੀਤਾ ਕਿ ਸਰਕਾਰੀ ਕਰਜ਼ ਨੂੰ ਸਬਸਕ੍ਰਾਈਬ ਕਰਨਾ ਉਸ ਦੇ ਕਾਰੋਬਾਰ ਲਈ ਸਹਾਇਕ ਸੀ ਅਤੇ ਕਿ ਘਾਟਾ ਕਾਰੋਬਾਰ ਦੇ ਦੌਰਾਨ ਪੈਦਾ ਹੋਇਆ ਸੀ, ਅਤੇ ਇਸ ਲਈ ਕਰਦਾਤਾ ਨੂੰ ਉਸ ਦੇ ਦੁਆਰਾ ਕੀਤੇ ਗਏ ਘਾਟੇ ਦੀ ਕਟੌਤੀ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਲੇਖਾ ਮੈਂਬਰ ਅਤੇ ਨਿਆਂਕਾ ਮੈਂਬਰ ਨੇ ਵੱਖਰੇ ਪਰ ਸਹਿਮਤ ਹੁਕਮ ਲਿਖੇ। ਰੈਵੇਨਿਊ ਦੇ ਉਦਾਹਰਣ 'ਤੇ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਕੇਸ ਨੂੰ ਉੜੀਸਾ ਦੀ ਉੱਚ ਅਦਾਲਤ ਦੀ ਰਾਏ ਲਈ ਭੇਜਿਆ ਇਸ ਕਾਨੂੰਨੀ ਸਵਾਲ ਉੱਤੇ:
“ਕੀ, ਮਾਮਲੇ ਦੇ ਤੱਥਾਂ ਅਤੇ ਹਾਲਾਤਾਂ ਵਿੱਚ, ਸਰਕਾਰੀ ਕਰਜ਼ ਦੀ ਵਿਕਰੀ 'ਤੇ ਕਰਦਾਤਾ ਦੁਆਰਾ ਝੱਲੀ ਗਈ 53,650 ਰੁਪਏ ਦੀ ਹਾਨੀ ਇੱਕ ਪੂੰਜੀ ਹਾਨੀ ਹੈ ਜਾਂ ਰਾਜਸਵ ਹਾਨੀ।”
ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਨਿਰਣਿਆਂ ਨਾਲ ਅਸਹਿਮਤ ਹੋਂਦਿਆਂ ਹਾਈ ਕੋਰਟ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਹਾਨੀ ਇੱਕ ਪੂੰਜੀ ਹਾਨੀ ਹੈ ਅਤੇ ਇਸ ਤਰ੍ਹਾਂ ਰੈਫਰੈਂਸ ਨੂੰ ਰਾਜਸਵ ਦੇ ਹੱਕ ਵਿੱਚ ਅਤੇ ਕਰਦਾਤਾ ਦੇ ਖਿਲਾਫ ਜਵਾਬ ਦਿੱਤਾ।
ਸ਼ੁਰੂਆਤ ਵਿੱਚ, ਸਾਨੂੰ ਇਹ ਨੋਟ ਕਰਨਾ ਜ਼ਰੂਰੀ ਲੱਗਦਾ ਹੈ ਕਿ ਹਾਈ ਕੋਰਟ ਨੇ ਇਹ ਵਿਚਾਰ ਪ੍ਰਗਟਾਇਆ ਹੈ ਕਿ ਮਾਮਲੇ ਦੀ ਤੱਥਾਤਮਕ ਅਧਾਰਸ਼ਿਲਾ ਨੂੰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਗਲਤ ਸਮਝਿਆ ਗਿਆ ਹੈ ਅਤੇ ਇਸ ਲਈ, ਇਹ ਸਬੂਤਾਂ ਨੂੰ ਮੁੜ ਜਾਂਚਣ ਅਤੇ ਆਪਣੇ ਤੱਥਾਂ ਦੇ ਨਿਰਣੇ ਤੱਕ ਪਹੁੰਚਣ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਸਾਨੂੰ ਲੱਗਦਾ ਹੈ ਕਿ ਹਾਈ ਕੋਰਟ ਇਸ ਵਿੱਚ ਗੰਭੀਰ ਗਲਤੀ ਕਰ ਬੈਠਾ ਹੈ। ਹੁਣ ਇਹ ਚੰਗੀ

2. It is now well settled that the Appellate Tribunal is the final
fact-finding authority under the Income-tax Act and that the Court has no jurisdiction to go behind the statements of fact made by the Tribunal in tis appellate order. The Court may do so only if there is no evide~ce to support them or the Appellate Tribunal has misdirected itself in law in arriving at the findings of fact. But even there the Court cannot disturb the findings of fact given by the Appellate Tribunal unless a challenge is directed specifically by a question framed in a reference agiiinst the validity of the impugned findings of fact on the gronnd that there is no evidence to support them or they are the result of a misdirection in law. A a capital loss. The assessee's appeal was dismissed by the Appellate Assistant Commissioner of Income-tax. But on second appeal the Income-tax Appellate Tribunal accepted the contention of the asses-see that the subscription to the Government Loan was conducive to its business and that the toss arose m the course of the business, and that therefore, the assessee was entitled to a deduction of the loss claimed B by it. ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਨਿਰਣਿਆਂ ਨਾਲ ਅਸਹਿਮਤ ਹੋਂਦਿਆਂ ਹਾਈ ਕੋਰਟ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਹਾਨੀ ਇੱਕ ਪੂੰਜੀ ਹਾਨੀ ਹੈ ਅਤੇ ਇਸ ਤਰ੍ਹਾਂ ਰੈਫਰੈਂਸ ਨੂੰ ਰਾਜਸਵ ਦੇ ਹੱਕ ਵਿੱਚ ਅਤੇ ਕਰਦਾਤਾ ਦੇ ਖਿਲਾਫ ਜਵਾਬ ਦਿੱਤਾ।
ਸ਼ੁਰੂਆਤ ਵਿੱਚ, ਸਾਨੂੰ ਇਹ ਨੋਟ ਕਰਨਾ ਜ਼ਰੂਰੀ ਲੱਗਦਾ ਹੈ ਕਿ ਹਾਈ ਕੋਰਟ ਨੇ ਇਹ ਵਿਚਾਰ ਪ੍ਰਗਟਾਇਆ ਹੈ ਕਿ ਮਾਮਲੇ ਦੀ ਤੱਥਾਤਮਕ ਅਧਾਰਸ਼ਿਲਾ ਨੂੰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਗਲਤ ਸਮਝਿਆ ਗਿਆ ਹੈ ਅਤੇ ਇਸ ਲਈ, ਇਹ ਸਬੂਤਾਂ ਨੂੰ ਮੁੜ ਜਾਂਚਣ ਅਤੇ ਆਪਣੇ ਤੱਥਾਂ ਦੇ ਨਿਰਣੇ ਤੱਕ ਪਹੁੰਚਣ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਸਾਨੂੰ ਲੱਗਦਾ ਹੈ ਕਿ ਹਾਈ ਕੋਰਟ ਇਸ ਵਿੱਚ ਗੰਭੀਰ ਗਲਤੀ ਕਰ ਬੈਠਾ ਹੈ। ਹੁਣ ਇਹ ਚੰਗੀ
ਤਰ੍ਹਾਂ ਸਥਾਪਿਤ ਹੈ ਕਿ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਆਮਦਨ ਕਰ ਐਕਟ ਅਧੀਨ ਅੰਤਿਮ ਤੱਥ ਖੋਜ ਅਥਾਰਟੀ ਹੈ ਅਤੇ ਕੋਰਟ ਨੂੰ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਆਪਣੇ ਅਪੀਲੀ ਹੁਕਮ ਵਿੱਚ ਬਣਾਏ ਗਏ ਤੱਥ ਬਿਆਨਾਂ ਪਿੱਛੇ ਜਾਣ ਦਾ ਕੋਈ ਅਧਿਕਾਰ ਨਹੀਂ ਹੈ। ਕੋਰਟ ਇਹ ਸਿਰਫ ਤਦ ਹੀ ਕਰ ਸਕਦਾ ਹੈ ਜੇਕਰ ਉਹਨਾਂ ਨੂੰ ਸਮਰਥਨ ਦੇਣ ਵਾਲੇ ਕੋਈ ਸਬੂਤ ਨਾ ਹੋਣ ਜਾਂ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਤੱਥਾਂ ਦੇ ਨਿਰਣੇ ਪਹੁੰਚਣ ਵਿੱਚ ਕਾਨੂੰਨ ਵਿੱਚ ਗਲਤ ਦਿਸ਼ਾ ਨਿਰਧਾਰਿਤ ਕੀਤੀ ਹੋਵੇ। ਪਰ ਫਿਰ ਵੀ ਕੋਰਟ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਦਿੱਤੇ ਗਏ ਤੱਥਾਂ ਦੇ ਨਿਰਣਿਆਂ ਨੂੰ ਪਰੇਸ਼ਾਨ ਨਹੀਂ ਕਰ ਸਕਦਾ ਜਦ ਤੱਕ ਕਿ ਇੱਕ ਸਵਾਲ ਨੂੰ ਰੈਫਰੈਂਸ ਵਿੱਚ ਫਰੇਮ ਕੀਤਾ ਗਿਆ ਹੋਵੇ ਜੋ ਇਹ ਚੁਣੌਤੀ ਦਿੰਦਾ ਹੋਵੇ ਕਿ ਉਹਨਾਂ ਦੇ ਸਮਰਥਨ ਵਿੱਚ ਕੋਈ ਸਬੂਤ ਨਹੀਂ ਹੈ ਜਾਂ ਉਹ ਕਾਨੂੰਨ ਵਿੱਚ ਗਲਤ ਦਿਸ਼ਾ ਦੇ ਨਤੀਜੇ ਹਨ। ਇਸ ਕੋਰਟ ਦੁਆਰਾ ਫੈਸਲਾ ਕੀਤੇ ਗਏ ਇੱਕ ਲੰਬੀ ਕਤਾਰ ਦੇ ਮਾਮਲੇ ਹਨ ਜੋ ਇਸ ਪ੍ਰਸਤਾਵ ਨੂੰ ਬਿਆਨ ਕਰਦੇ ਹਨ। ਦੇਖੋ ਸਾਹਾ ਰਾਮ ਕਮਰਸ ਲਿਮਿਟੇਡ ਖਿਲਾਫ ਸੀ.ਆਈ.ਟੀ. ਜੀ.ਓ.ਆਈ. 52; 64; ਹਜਾਰੀਮਲ ਛੋਟਮਲ ਬਨਾਮ ਇਨੀ ਇੰਡੀਆ ਕਮੇਕੋ ਲਿਮਿਟੇਡ, ਕੋਲੂਟ ਬਨਾਮ ਸੀ.ਆਈ.ਟੀ. 63 ਆਈ.ਟੀ.ਆਰ. 490, 495-6; ਪੀ.ਐਲ.ਐਮ. ਐਲ. ਗ੍ਰੀਵ ਕਾਟਨ & ਕੋ. ਲਿਮਿਟੇਡ, ਬਨਾਮ ਕੋਲਟਰਨ 602 ਆਈ.ਟੀ.ਆਰ. ਕੋਲਟਰ, ਬਨਾਮ ਮੇਟਾਕ੍ਰਿਸ਼ ਮਿਲਸ ਲਿਮਿਟੇਡ, 633 ਆਈ.ਟੀ.ਆਰ. 693; ਸੀ.ਆਈ.ਟੀ. ਬਨਾਮ ਐਮ.ਐਲ.ਟੀ.ਟੀ. 639 ਆਰ&ਪੀ 645; ਐਲ.ਜੇ. ਐਲ.ਟੀ.ਆਰ. 662, 656; ਹੋਮਲੀਵੁਡਸ ਲਿਮਿਟੇਡ ਬਨਾਮ ਸੀ.ਆਈ.ਟੀ., 643 ਆਈ.ਟੀ.ਆਰ. 708, 697; ਸੀ.ਆਈ.ਟੀ ਬਨਾਮ ਇੰਪੀਰੀਅਲ ਕੈਮੀਕਲ ਇੰਡਸਟਰੀਜ਼ (ਇੰਡੀਆ) ਲਿਮਿਟੇਡ, 74 ਆਈ.ਟੀ.ਆਰ. 17 ਅਤੇ ਐਲਮੀਨੀਅਮ ਕਾਰਪੋਰੇਸ਼ਨ ਆਫ ਇੰਡੀਆ ਲਿਮਿਟੇਡ ਬਨਾਮ ਸੀ.ਆਈ.ਟੀ., 86 ਆਈ.ਟੀ.ਆਰ. 11. ਹਾਈ ਕੋਰਟ ਨੇ ਕੋਮ- ਪਟਨਾਇਕ & ਕੋ. ਬਨਾਮ ਸੀ.ਆਈ.ਟੀ. ਪਾਠਕ, ਨਾਇਬ ਨਿਆਂਕਾ ਉੱਤੇ ਭਰੋਸਾ ਕੀਤਾ। ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਬਿਹਾਰ ਅਤੇ ਉੜੀਸਾ ਬਨਾਮ ਐਸ. ਪੀ. ਜੈਨ, 87 ਆਈ.ਟੀ.ਆਰ. 370 ਨੇ ਸਬੂਤਾਂ ਦੀ ਮੁੜ ਜਾਂਚ ਦੀ ਉਚਿਤਤਾ ਨੂੰ ਸਾਬਤ ਕਰਨ ਲਈ ਅਤੇ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਦਿੱਤੇ ਗਏ ਤੱਥਾਂ ਦੇ ਨਿਰਧਾਰਨ ਨੂੰ ਆਪਣੇ ਦੁਆਰਾ ਪਹੁੰਚੇ ਤੱਥਾਂ ਦੇ ਨਿਰਧਾਰਨ ਨਾਲ ਬਦਲਣ ਲਈ ਜਾਇਜ਼ ਠਹਿਰਾਇਆ। ਪਰ, ਉਸ ਕੇਸ ਵਿੱਚ, ਹਾਈ ਕੋਰਟ ਅੱਗੇ ਰੈਫਰੈਂਸ ਵਿੱਚ ਉਠਾਏ ਗਏ ਸਵਾਲਾਂ ਵਿੱਚ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਪਹੁੰਚੇ ਤੱਥਾਂ ਦੇ ਨਿਰਧਾਰਨ ਨੂੰ ਕਾਨੂੰਨੀ ਤੌਰ 'ਤੇ ਅਵੈਧ ਕਰਾਰ ਦੇਣ ਦੀ ਵਿਸ਼ੇਸ਼ ਚੁਣੌਤੀ ਸ਼ਾਮਲ ਸੀ। ਮੌਜੂਦਾ ਕੇਸ ਵਿੱਚ ਹਾਈ ਕੋਰਟ ਨੂੰ ਭੇਜੇ ਗਏ ਸਵਾਲ ਨੂੰ ਇਸ ਧਾਰਣਾ 'ਤੇ ਫਰੇਮ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਇਸ ਨੂੰ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਖਾਕਾ ਬਣਾਏ ਗਏ ਤੱਥਾਂ ਦੇ ਸੰਦਰਭ ਵਿੱਚ ਫੈਸਲਾ ਕਰਨਾ ਸੀ: ਇਸ ਸੰਦਰਭ ਵਿੱਚ, ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਵਿੱਚ ਬਿਆਨ ਕੀਤੇ ਗਏ ਤੱਥਾਂ ਨੂੰ ਖਾਰਜ ਕਰਨਾ ਪਵੇਗਾ। ਅਸੀਂ ਕੇਸ ਨੂੰ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਵਾਪਸ ਭੇਜਣ ਦੀ ਬਜਾਏ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਲੱਭੇ ਗਏ ਤੱਥਾਂ ਦੇ ਆਧਾਰ 'ਤੇ ਕਾਨੂੰਨੀ ਸਵਾਲ ਦਾ ਜਵਾਬ ਦੇਣ ਦੀ ਮੰਗ ਕਰਨ ਦੀ ਬਜਾਏ ਅਸੀਂ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਅਪੀਲੇਟ ਆਰਡਰ ਵਿੱਚ ਸ਼ਾਮਲ ਤੱਥਾਂ ਦੇ ਬਿਆਨ 'ਤੇ ਆਧਾਰਿਤ ਰੈਫਰੈਂਸ ਨੂੰ ਖੁਦ ਨਿਪਟਾਉਣ ਦਾ ਪ੍ਰਸਤਾਵ ਕਰਦੇ ਹਾਂ। ਕੇਸ ਪਿਛਲੇ 20 ਸਾਲਾਂ ਤੋਂ ਇਸ ਦੇ ਲਗਾਤਾਰ ਪੜਾਅਾਂਾਂ ਵਿੱਚ ਲਟਕਿਆ ਹੋਇਆ ਹੈ, ਅਤੇ ਹੁਣ ਹੋਰ ਦੇਰੀ ਤੋਂ ਬਿਨਾਂ ਇਸ ਨੂੰ ਨਿਪਟਾਉਣਾ ਉਚਿਤ ਹੈ।
ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਅਪੀਲੇਟ ਆਰਡਰ ਦੇ ਆਧਾਰ 'ਤੇ ਤਿਆਰ ਕੀਤੇ ਗਏ ਕੇਸ ਦੇ ਬਿਆਨ ਅਨੁਸਾਰ ਕਰਦਾਤਾ ਨੂੰ ਦੱਸਿਆ ਗਿਆ ਸੀ ਕਿ ਜੇਕਰ ਉਹ ਸਰਕਾਰੀ ਲੋਨ ਵਿੱਚ ਸ਼ਾਮਲ ਹੁੰਦਾ ਹੈ ਤਾਂ ਉਸ ਨੂੰ ਮੋਟਰ ਵਾਹਨਾਂ ਦੇ ਆਰਡਰ ਲਾਉਣ ਵਿੱਚ ਤਰਜੀਹੀ ਇਲਾਜ ਦਿੱਤਾ ਜਾਵੇਗਾ ਜੋ ਕਿ ਵੱਖ-ਵੱਖ ਸਰਕਾਰੀ ਵਿਭਾਗਾਂ ਵੱਲੋਂ ਲੋੜੀਂਦਾ ਸੀ ਅਤੇ ਆਰਡਰ ਲਾਏ ਗਏ ਮੁੱਲ ਦੇ 50 ਪ੍ਰਤੀਸ਼ਤ ਤੱਕ ਦੀ ਅਗਾਊ ਰਕਮ ਸਰਕਾਰ ਵੱਲੋਂ ਦਿੱਤੀ ਜਾਵੇਗੀ। ਇਸ ਸਮਝੌਤੇ ਅਨੁਸਾਰ, ਕਰਦਾਤਾ ਨੇ ਰੁਪਏ 1,837,067 ਦੀ ਅਗਾਊ ਰਕਮ ਪ੍ਰਾਪਤ ਕੀਤੀ ਅਤੇ ਰਾਜ ਸਰਕਾਰ ਵੱਲੋਂ ਵੱਖ-ਵੱਖ ਵਿਭਾਗਾਂ ਨੂੰ ਉਨ੍ਹਾਂ ਦੁਆਰਾ ਲੋੜੀਂਦੇ ਵਾਹਨਾਂ ਦੀ ਖਰੀਦ ਕਰਦਾਤਾ ਤੋਂ ਕਰਨ ਲਈ ਇੱਕ ਸਰਕੁਲਰ ਕਾਨੂੰਨ ਵੀ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਸੀ। ਸਰਕਾਰ ਵੱਲੋਂ ਪ੍ਰਾਪਤ ਅਗਾਊ ਰਕਮ ਕਾਰਨ ਕਰਦਾਤਾ ਨੇ ਬੈਂਕ ਵਿਆਜ ਵਿੱਚ ਰੁਪਏ 45,000 ਬਚਾਏ। ਸਾਲ 1 ਵਿੱਚ, ਇਹ ਵੀ ਨੋਟ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ

At the outset, we find it necessary to note that the High Court has taken the view that the factual substratum of the case has been misconceived by !he Appellate Tribunal and that it is, therefore, en-titled to re-examine the evidence and arrive at its own findings of fact. We think the High Court fell into serious error in doing so. It is now well settled that the Appellate Tribunal is the final fact-finding author-ity under the Income-tax Act and that the Court has·no jurisdiction to go behind the statements of fact made. by the Tribunal in its appellate order. The Court may do so only if there is no evidence to support them or the Appellate Tribunal has misdirected itself in law in arriving at the findings of fact. But even there the Court cannot disturb the findings of fact given by the Appellate Tribunal unless a challenge is directed specifically by a question framed in a reference against the validity of the impugned findings of fact on the ground that there is no evidence to support them or they are the result of a misdirection in law. ਅਸੀਂ ਇਸ ਗੱਲ ਦਾ ਫੈਸਲਾ ਕਰਦੇ ਹਾਂ ਕਿ ਉੱਚ ਅਦਾਲਤ ਨੇ ਜੋ ਦ੍ਰਿਸ਼ਟੀਕੋਣ ਅਪਣਾਇਆ ਹੈ ਉਸ ਵਿੱਚ ਗਲਤੀ ਕੀਤੀ ਹੈ ਅਤੇ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਅਪੀਲ ਨੂੰ ਮਨਜ਼ੂਰ ਕਰਨ ਵਿੱਚ ਸਹੀ ਫੈਸਲਾ ਕੀਤਾ ਹੈ।

According to the statement of the case drawn up on the basis of the appellate order of the Appellate Tribunal the assessee was told that if it subscribed for the Government Loan preferential treatment would be granted to it in the placing of orders for motor vehicles required by the various Government Departments and to the further benefit of an advance from the Government up to 50 per cent of the value of the orders placed. Pursuant to that understanding, an advance to the extent of Rs.18,37,062 was received by the assessee and a Circu-lar was also issued by the State Government to various Departments to make purchases of the vehicles required by them from the assessee. Because of the advance received from the Government, the assessee was able to save Rs.45,000 as bank interest during the year. It was also noticed that the sales shot up substantially. On September 4, 1961 the assessee made a deposit of Rs.5 Lakhs consequent upon a Resolution of the Board of Directors passed about 6 weeks before after a state-ment made by the Chairman during the Board meeting that the Gov-ernment had approached him to subscribe to the Government Loan and that the Company should do so as good orders could be expected. The purchase of the loan was approved by the Board of Directors and was ratified in the Annual General Meeting of the shareholders held on December 31, 1961. The Appellate Tribunal found that having regard to the sequence of events and the close proximity of the invest-l)lent with the receipt of Government orders the conclusion was ines-

capable that the investment was made in order to further the sales of the assessee and boost its business. In the circumstances, the Appel-late Tribunal held that the investment was made by way of commercial expediency for the purpose of carrying on the assessee's business and that therefore, the loss suffered by the assessee on the sale of the investment must be regarded as a revenue loss. We are .of opinion that the Appellate Tribunal is right.
The.High Court, as has been mentioned, re-examined the facts on the record and found that the investment was not connected with the orders placed by. the Govermnent with the assessee and the advance payment made by the Government Departments to the asses-see, and it was in that context that the High Court held that the investment in the Loan was a capital asses! and the loss was a capital loss. The High Court took the view that the investment was of endur-ing benefit to the assessee and therefore it could not be allowed. We find it difficult to hold that an enduring benefit was brought about by the assessee investing in the Loan. So far as orders from the Govern·-ment Departments were concerned the material on record shows that .on August 30, 1961 it was decided to purchase 16 jeeps, 8 trucks and 4 one-tonne pick-up vans. There is nothing to show that there was any reason for the asscssee to hold on to the investment in the loan indefi-nitely. There was no enduring advantage. Accordingly we hold that the investment did not bring in an asset of a capital nature, and that in the circumstances of the case the loss suffered by the assessee was a revenue loss and not a capital loss. It was held by the Orissa High Court in Commissioner of Income-tax v. Industry and Commerce En-terprises (P) Ltd., [1979] 118 ITR 606 and by the Madras High Court in Additional Commissioner of Income-tax, Madras-II v. B.M.S. (P) Ltd., [1979] 119 ITR 321 and again in Commissioner of Income-tax, Tamil Nadu-V v. Dhandayuthapani Foundry (P) Ltd, [1980] 123 ITR 709, that where Government bonds or securities were purchased by the assessee with a view to increasing his business with the Govern-ment or with the object of retaining the goodwill of the authorities for the purpose of his business, the loss incurred on the sale of such bonds or securities was allowable as a business loss.
We hold that the High Court has erred in the view taken by it and that the Tribunal was right in allowing the appeal.
