-CM APPL. 39470/2016 (delay of 756 days in refiling of the appeal)1. There is an extraordinary delay of 756 days in re-filing of theappeal. The excuse that is given for this delay is the standard one -about the introduction of e-filing system in this Court.
2. As already explained in several orders of this Court, the difficulty ifany in that regard was adequately taken care of by the organisingorientation sessions for the lawyers on several dates. In any event, thequestion of there being more than two years’ delay in re-filing of theappeal on that score is not acceptable.
3. In the absence of any satisfactory reason for the delay, the Court isnot inclined to condone the extraordinary delay of 756 days in re-
filing the appeals. The application is dismissed.
ITA 732/2016
4. The appeal is accordingly dismissed. However, the question of lawraised by the Revenue is left open for decision in an appropriate case.
