Revenue has filed this appeal to challenge the order of theIncome Tax Appellate Tribunal dated 18.01.2018. Question relatesto deletion of penalty on the additions of Rs.3.62 crores (roundedoff) made by the assessing officer declining the assessee’s claimunder Section 80IA of the Income Tax Act, 1961. It emerges fromthe record that the quantum of additions has been deleted and thesame was also confirmed by the High Court. The second questionis in relation to penalty of disallowance of interest. Here also itappears that the issue was referred back to the assessing officer.
In that view of the matter no question of law arises. Appealis dismissed.
