1. The Revenue has preferred the present appeal in respect of an order dated 09.12.2019 passed by the learned Income Tax Appellate Tribunal (hereafter the ITAT) in two separate appeals.
2.In view of our order passed today in W.P(C) 6097/2021, the Revenue‟s appeal in respect of ITA No. 5958/Del/2014 does not survive. Accordingly, the Revenue is required to amend its appeal to confine the same to the order passed by the learned ITAT in ITA No.5411/Del/2014 for the assessment year (AY) 2011-12.
3. The appeal is accordingly disposed of with liberty to the appellant to file afresh.
4.It is clarified that in the event, the said appeal is filed within a period
of four weeks from date, this Court would consider the same un-influenced by the delay in filing the petition.
