After making submissions for sometimecounsel on instructions wants to withdraw thewrit petition with liberty to avail remedy ofappeal available to him U/s 246A of the IncomeTax Act,1961, however, submits that since thewrit petition remained pending in this Court,the limitation may come in his way, if heproposes to file appeal before theCommissioner of Appeals.
