Learned counsel for the respondents has submitted that therefund of the petitioner, was withheld by the Income TaxDepartment regarding calculation of interest, in view of the factthat demand was pending against the petitioner, however later on,the respondent-Income Tax Department has rectified the orderand released the refund in favour of the petitioner as per her claimvide Annexure-R/1 annexed with the reply to the writ petition.
No counter reply has been filed on behalf of the petitioner
Hence, in view of the submissions made by learned counselfor the respondents, this writ petition is dismissed as havingbecome infructuous with liberty to the petitioner to availappropriate remedy in accordance with law, if occasion so arises.
