This petition is filed under Article 226 of the Constitution of India challenges an order dated 31 May 2012 passed by the Income Tax Appellate Tribunal (Tribunal) dismissing the petitioner's application for rectification filed under Section-254(2) of the Income Tax Act,1961 (“the Act”).
2)At the out set Mr. Pardiwala learned Senior Counsel fairly states that the petitioner has filed appeal against the original order of the Tribunal dated 25 January 2012 being Income Tax Appeal Lodging No. 872 of 2012. In view of the above, the petitioner does not press the present writ petition. We have not examined the merits of the petition and make it clear that all contentions of the petitioner in Income Tax Appeal Lodging No.872/2012 are left open.
3)Accordingly, the petition is dismissed as withdrawn. No order as to costs.
