So far as first two questions are concerned, in view of the subsequent order of the Tribunal in Miscellaneous Application, they do not survive. However, it is clarified that so far as question No.3 is concerned, the same is restored to Assessing Officer for reconsideration. It would be open for the appellant to raise all contentions even on merits. The guidelines framed by the Tribunal can be set up at appropriate stage. All questions in that behalf are kept open. Appeal accordingly stands disposed of in terms of this order. No order as to costs.
