1. Heard the learned counsel for the appellant
and the learned counsel for the respondents.
2. We have perused the order of this Court dated
10th July, 2008 passed in Income Tax Appeal No. 369
of 2005, arising out of assessment year 1994-95 with
regard to the same assessee. Both learned counsel for
the appellant and the respondents have placed the copy
of the order dated 10.7.2008 on record. The aforesaid
appeal squarely covers the present appeal also, as
similar questions of law are involved. In view
thereof, for the same reasons indicated and for the
reasons in the order of this Court dated 7.10.2008 the
aforesaid Appeal No. 369 of 2005 the present appeal
stands dismissed.
