Heard on I.A. No.11290/2018 for condonation of delay infiling this M.C.C.
Though the application is vehemently opposed by thelearned counsel appearing for the respondents, for the reasonsmentioned therein, the same is allowed and the delay in filingthis M.C.C. is hereby condoned.
Also, heard on the question of admission.
This application has been filed seeking restoration of ITANo.08/2018 which has been dismissed for non compliance of thecommon conditional order dated 19.3.2018.
It is submitted by the learned counsel for the applicantsthat the aforesaid Income Tax appeal stood dismissed onaccount of the fact that the counsel for the applicants could notcomply with the common conditional order dated 19.3.2018.The application is supported by an afÏdavit of the learnedcounsel for the applicants. It is submitted that the applicationfor restoration deserves to be allowed.
Having heard the learned counsel for the parties andlooking to the fact that the reasons stated in the application forrestoration of ITA No.08/2018 are bonafide, the same is allowedand ITA No.08/2018 is directed to be restored to its originalnumber.
This MCC stands disposed of.
