learned Counsel for both the parties categorically state
that the questions of law raised in this Appeal have
already been answered by this Court by an order dated
8th October, 2008 passed in ITXA No.916 of 2008 in the
case of The CIT V/s.M/s.Penwalt India Ltd.
The CIT V/s.M/s.Penwalt India Ltd., against the
Revenue and in favour of the Assessee. Hence, for the
same reasons as stated in the aforesaid order dated 8th
Octoaber, 2008 the present Appeal also stands dismissed.
