1. This is a Motion for condoning 1155 days delay
in filing of the main appeal. A perusal of the
affidavit-in-support indicates that CCIT-2 approved
filing of the appeal on 4.6.2004 and thereafter the
appeal came to be filed on 2.8.2007. A period of
more than 3 years for drafting appeal memo cannot be
said to be reasonable. Therefore, the cause shown
does not amount to sufficient cause. Hence, Motion
stands dismissed.
INCOME TAX APPEAL (L) NO.1757 OF 2007
. As the Motion for condoning delay is dismissed,
appeal also stands dismissed.
