1. This is a Motion for condoning 938 days delay in
filing of the main appeal. On perusal of the
affidavit-in-support, we find that the matter was
sent to the Govt. Advocate on 24.2.2005 for
preparing appeal memo and the appeal ultimately came
to be filed more than 2 years & 6 months later on
22.8.2007. No dates have been given in respect of
events which occurred between aforesaid 2 dates.
Therefore, the cause shown does not amount to
sufficient cause. Hence, Motion stands dismissed.
INCOME TAX APPEAL (L) NO.1917 OF 2007
