1.This Notice of Motion is taken out seeking condonation of 513
days delay in filing the Review Petition. The Review Petition is taken out seeking review of the order passed on 14[th] October 2009, whereby the appeal filed by the Revenue has been dismissed.
2.The reasons for the delay set out in the affidavit in support of the Notice of Motion is that considerable time was taken in obtaining the approval for filing the Review Petition and getting the Review Petition
drafted. In every case, the approval for filing appeal / review is required to be obtained and the appeal / review is required to be got drafted and filed within the time stipulated. In the absence of any specific reason for the inordinate delay, we see no reason to condone the delay of 513 days in filing the Review Petition.
3.In this view of the matter, the Notice of Motion is dismissed with no order as to costs.
4.In view of dismissal of the Notice of Motion, the Review Petition be consigned to the records.
