1.This is an application for condonation of delay of 213days in filing the present appeal. In the application hardly anyreasons much less substantial cause has been made out forcondonation of delay. Nobody is present on behalf of theapplicant. The non-applicant has brought to our notice ajudgment of another Division Bench of this court in Notice ofMotion No. 1709 of 2008 in Income Tax Appeal (L) No.1219 of2008, wherein delay of 213 days was caused which was notcondoned and the Notice of Motion and appeal involving samequestion was also dismissed.
2.We have no reason to take a view different than theone taken by the Division Bench in M/s. K.K.C. Case (supra).Following the same view, we dismiss the Notice of Motion No.1815/08 while declining to condone the delay in filing the appeal.As a result of dismissal of Notice of Motion, the appeal does notsurvive for consideration and is accordingly dismissed. Both theNotice of Motion and Appeal stands dismissed.
