On 1st June, 1957 he had gifted away a part of the oil mill machinery, ,to his wife and three . minor children. A firm wss constituted by the asseasee's wife and another person to the profits of which the three minor sons of the assessee were also admitted. The mill premises as)iell as the machinery of the assessee were leased out to this firm which carried on the business of manufacture aiid sale of groundnut oil. The assessee also entered into an agree-ment with the firm under which certain services were rendered to the firm by way of management. The asseasee was entitled to get commission at the stipulated rates on the purchase of oil cake and sale of decoiled cake made by the firm. The assessee himself continued to carry on business in purchase and sale oi ground-nut cake and oil on a slilall scale, and also as an akbari contractor. The assessee had incurred huge losses in his individual business in the earlier· years which were being carried forward A B c D F G I H A frOID year to year upto the assessment year 1958-59, and the loas carried forward fraa the assessment year 1958-59 was over Rs. 7 lskhs. GOTLA, YADAGIRI [[1985] SUPP. 2 S.C.R. 711] (1985) ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਹਵਾਲੇ 'ਤੇ ਹਾਈ ਕੋਰਟ ਨੇ ਫੈਸਲਾ ਸੁਣਾਇਆ ਕਿ ਇੱਕ ਮੁਲਾਜ਼ਮ ਨੂੰ ਅਗਲੇ ਸਾਲ ਵਿੱਚ ਘਾਟਾ ਨੂੰ ਅੱਗੇ ਵਧਾਉਣ ਅਤੇ ਧਾਰਾ 24 (2) (ii) ਦੇ ਤਹਿਤ ਸੈਟ-ਆਫ ਦਾ ਦਾਅਵਾ ਕਰਨ ਦਾ ਹੱਕਦਾਰ ਹੋਣ ਲਈ ਹੇਠ ਲਿਖੇ ਹਾਲਾਤਾਂ ਨੂੰ ਪੂਰਾ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ: (1) ਘਾਟਾ ਕਿਸੇ ਕਾਰੋਬਾਰ ਵਿੱਚ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ; (1ਏ) ਜਿਸ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤੇ ਵਿੱਚ ਘਾਟਾ ਪਹਿਲਾਂ ਹੋਇਆ ਸੀ, ਉਸ ਨੂੰ ਉਸ ਸਾਲ ਵਿੱਚ ਵੀ ਜਾਰੀ ਰੱਖਣਾ ਚਾਹੀਦਾ ਹੈ ਜਿਸ ਵਿੱਚ ਅੱਗੇ ਵਧਾਇਆ ਗਿਆ ਘਾਟਾ ਸੈਟ-ਆਫ ਕੀਤਾ ਜਾਣਾ ਹੈ; ਅਤੇ (ii) ਜਿਸ "ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤੇ ਦੇ ਮੁਨਾਫਿਆਂ ਦੇ ਖਿਲਾਫ ਸੈਟ-ਆਫ ਦਾ ਦਾਅਵਾ ਕੀਤਾ ਜਾਂਦਾ ਹੈ, ਉਸ ਨੂੰ ਉਸ ਸਾਲ ਵਿੱਚ ਮੁਲਾਜ਼ਮ ਦੁਆਰਾ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ, ਅਤੇ ਕਰਨਾਟਕ ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ 'ਤੇ ਭਰੋਸਾ ਕਰਦਿਆਂ ਬੀਐਰ ਟੀਪੀ ਕਪਾਡੀਆ ਬਨਾਮ ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, 87 ਆਈਟੀਆਰ 511, ਇਹ ਫੈਸਲਾ ਸੁਣਾਇਆ ਕਿ ਜਿੱਥੇ ਮੁਲਾਜ਼ਮ ਦੀ ਕੁੱਲ ਆਮਦਨ ਦੇ ਤਹਿਤ ਮੁਲਾਜ਼ਮ ਦੀ ਪਤਨੀ ਦੁਆਰਾ ਸ਼ੁਰੂ ਕੀਤੇ ਗਏ ਕਾਰੋਬਾਰ ਤੋਂ ਪ੍ਰਾਪਤ ਵਪਾਰਕ ਆਮਦਨ ਨੂੰ ਵੇਖਿਆ ਜਾ ਸਕਦਾ ਹੈ, ਮੁਲਾਜ਼ਮ ਨੂੰ ਪਿਛਲੇ ਸਾਲ ਤੋਂ ਅੱਗੇ ਵਧਾਏ ਗਏ ਆਪਣੇ ਘਾਟੇ ਨੂੰ ਸੈਟ-ਆਫ ਕਰਨ ਦਾ ਹੱਕ ਹੈ। ਇਸ ਅਦਾਲਤ ਵਿੱਚ ਰਾਜਸੀ ਦੁਆਰਾ ਕੀਤੇ ਗਏ ਅਪੀਲਾਂ ਵਿੱਚ, ਗੁਜਰਾਤ ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ 'ਤੇ ਭਰੋਸਾ ਕਰਦਿਆਂ ਗੋਇਲ ਮਲ ਸ਼ਿਵਾਜੀ ਵਾਧੇਸ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, 60 ਆਈ.ਟੀ.ਆਰ. 51 ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ ਸੀ ਕਿ ਤਨਖਾਹ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਕੁੱਲ ਆਮਦਨ ਵਿੱਚ ਸ਼ਾਮਲ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ, ਜਦੋਂ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਤਰਫੋਂ ਇਹ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਸੀ ਕਿ ਪਹਿਲੇ ਸਾਲ ਵਿੱਚ ਜਦੋਂ ਤਨਖਾਹ ਪਤਨੀ ਜਾਂ ਘੱਟ ਗਿਣਤੀ ਬੱਚੇ ਨੂੰ ਤਬਦੀਲ ਕੀਤੀ ਜਾਂਦੀ ਹੈ ਤਾਂ ਨੁਕਸਾਨ ਨੂੰ ਲਾਭ-ਹਾਨੀ ਦੇ ਗਣਨ ਦੇ ਤੌਰ 'ਤੇ ਲਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਜੋ ਤਬਦੀਲ ਕੀਤੇ ਗਏ ਸਰੋਤਾਂ ਦੀ ਵਰਤੋਂ ਤੋਂ ਪੈਦਾ ਹੁੰਦਾ ਹੈ, ਅਤੇ ਧਾਰਾ 16 (3) (ਏ) ਦਾ ਉਦੇਸ਼ ਵਿਅਕਤੀ ਦੇ ਉਸ ਯਤਨ ਨੂੰ ਰੋਕਣਾ ਸੀ ਜਿਸ ਵਿੱਚ ਉਹ ਆਪਣੀ ਪਤਨੀ ਜਾਂ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਨੂੰ ਸਾਊਦਾ ਕਰਨ ਲਈ ਆਪਣੀਆਂ ਸੰਪਤੀਆਂ ਤਬਦੀਲ ਕਰਕੇ ਟੈਕਸ ਦੀ ਮਾਰ ਨੂੰ ਘਟਾਉਂਦਾ ਹੈ। ਅਪੀਲਾਂ ਨੂੰ ਖਾਰਿਜ ਕਰਦਿਆਂ, ਫੈਸਲਾ: 1. ਧਾਰਾ 16(3) ਦੇ ਤਹਿਤ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਕੁੱਲ ਆਮਦਨ ਵਿੱਚ ਸ਼ਾਮਲ ਪਤਨੀ ਅਤੇ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਦੀ ਆਮਦਨ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਕਰਵਾਏ ਗਏ ਕਾਰੋਬਾਰ ਤੋਂ ਪ੍ਰਾਪਤ ਵਪਾਰਕ ਆਮਦਨ ਵਜੋਂ ਮੰਨਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ, ਅਤੇ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਪਿਛਲੇ ਸਾਲ ਤੋਂ ਆਪਣਾ ਨੁਕਸਾਨ ਅੱਗੇ ਵਧਾਉਣ ਦਾ ਅਧਿਕਾਰ ਹੈ। 2. ਜਿੱਥੇ ਧਾਰਾ 16(3) ਦੇ ਤਹਿਤ ਕੰਮ ਕਰਦਾ ਹੈ, ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਕੁੱਲ ਆਮਦਨ ਵਿੱਚ ਸ਼ਾਮਲ ਪਤਨੀ ਜਾਂ ਘੱਟ ਗਿਣਤੀ ਬੱਚੇ ਦੇ ਕਾਰੋਬਾਰ ਤੋਂ ਲਾਭ ਜਾਂ ਨੁਕਸਾਨ ਨੂੰ ਅਗਲੀ ਤਾਰੀਖ ਅਤੇ ਸੈੱਟ ਆਫ ਦੇ ਉਦੇਸ਼ਾਂ ਲਈ 'ਉਸ ਦੁਆਰਾ ਕੀਤੇ ਗਏ ਕਾਰੋਬਾਰ' ਦੇ ਲਾਭ ਜਾਂ ਨੁਕਸਾਨ ਵਜੋਂ ਮੰਨਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ। 3. (1) ਜਿੱਥੇ ਇੱਕ ਕਾਨੂੰਨੀ ਪ੍ਰਬੰਧ ਦੀ ਸਪੱਸ਼ਟ ਸਾਖਰੀ ਵਿਆਖਿਆ ਇੱਕ ਸਪੱਸ਼ਟ ਤੌਰ 'ਤੇ ਅਨਿਆਂ ਦਾ ਨਤੀਜਾ ਪੈਦਾ ਕਰਦੀ ਹੈ ਜੋ ਕਦੇ ਵੀ ਵਿਧਾਨ ਸਭਾ ਦੁਆਰਾ ਇਰਾਦਾ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ, ਅਦਾਲਤ ਵਿਧਾਨ ਸਭਾ ਦੁਆਰਾ ਵਰਤੀ ਗਈ ਭਾਸ਼ਾ ਨੂੰ ਸੋਧ ਸਕਦੀ ਹੈ ਤਾਂ ਜੋ ਵਿਧਾਨ ਸਭਾ ਦੇ ਇਰਾਦੇ ਨੂੰ ਪ੍ਰਾਪਤ ਕੀਤਾ ਜਾ ਸਕੇ ਅਤੇ ਇੱਕ ਯੁਕਤੀਯੁਕਤ ਨਤੀਜਾ ਪੈਦਾ ਕੀਤਾ ਜਾ ਸਕੇ ਇੱਕ ਨਿਰਮਾਣ। ਕਾਨੂੰਨੀ ਸੰਧਾ ਦੀ ਵਿਆਖਿਆ ਦਾ ਕੰਮ ਕਾਨੂੰਨ ਸਭਾ ਦੇ ਇਰਾਦੇ ਨੂੰ ਵਰਤੀ ਗਈ ਭਾਸ਼ਾ ਤੋਂ ਲੱਭਣ ਦਾ ਯਤਨ ਹੈ। ਇਹ ਯਾਦ ਰੱਖਣਾ ਜ਼ਰੂਰੀ ਹੈ ਕਿ ਭਾਸ਼ਾ ਮਨੁੱਖੀ ਇਰਾਦੇ ਦੇ ਪ੍ਰਗਟਾਵੇ ਲਈ ਸਭ ਤੋਂ ਵਧੀਆ ਇੱਕ ਅਪੂਰਨ ਸਾਧਨ ਹੈ। (ii) ਕਾਨੂੰਨ ਵਿੱਚ ਹਮੇਸ਼ਾਂ ਕੁਝ ਮਕਸਦ ਜਾਂ ਉਦੇਸ਼ ਹੁੰਦਾ ਹੈ ਅਤੇ ਉਸ ਮਕਸਦ ਦੀ ਸਹਾਨੁਭੂਤੀਪੂਰਨ ਅਤੇ ਕਲਪਨਾਸ਼ੀਲ ਖੋਜ ਉਨ੍ਹਾਂ ਦੇ ਅਰਥ ਤੱਕ ਪਹੁੰਚਣ ਦਾ ਸਭ ਤੋਂ ਪਕਕਾ ਰਸਤਾ ਹੈ। 4. ਆਮਦਨ ਕਰ ਐਕਟ, 1922 ਦੀ ਥਾਂ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਨੇ ਲੈ ਲਈ। ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 64 ਪਤੀ/ਪਤਨੀ ਜਾਂ ਘੱਟ ਉਮਰ ਦੇ ਬੱਚੇ ਨੂੰ ਸਿੱਧੇ ਜਾਂ ਅਸਿੱਧੇ ਤੌਰ 'ਤੇ ਸੌਂਪੇ ਗਏ ਸਰੋਤਾਂ ਤੋਂ ਪੈਦਾ ਹੋਣ ਵਾਲੀ ਆਮਦਨ ਦੀ ਗਿਣਤੀ ਨਾਲ ਸਬੰਧਤ ਹੈ। ਮਹੱਤਵਪੂਰਨ ਪਹਿਲੂਆਂ 'ਤੇ ਪ੍ਰਬੰਧ ਧਾਰਾ 64 ਦੇ 1961 ਐਕਟ ਵਿੱਚ 'ਛੱਡ ਦਿੱਤਾ ਗਿਆ ਹੈ, ਜਦੋਂ ਕਿ ਧਾਰਾ 16(3) ਵਿੱਚ 'ਪਤਨੀ' ਸ਼ਬਦ ਦੀ ਵਰਤੋਂ ਕੀਤੀ ਗਈ ਹੈ। ਧਾਰਾ 24 ਦੇ ਸੈਕਸ਼ਨ 1922 ਐਕਟ। ਸੈਕਸ਼ਨ 64 ਦੇ ਉਪ-ਧਾਰਾ (1) ਵਿੱਚ ਪ੍ਰਦਾਨ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਜੇਕਰ ਕੋਈ ਵਿਅਕਤੀ ਇਸ ਤਰ੍ਹਾਂ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਕਿਸੇ ਵੀ ਸਾਲ ਵਿੱਚ ਧਾਰਾ 6 ਵਿੱਚ ਦੱਸੇ ਗਏ ਕਿਸੇ ਵੀ ਸਿਰ ਤੋਂ ਲਾਭ ਪੈਦਾ ਹੁੰਦਾ ਹੈ, ਤਾਂ ਉਹ ਆਪਣੀ ਆਮਦਨ, ਲਾਭ ਜਾਂ ਉਸ ਸਾਲ ਵਿੱਚ ਕਿਸੇ ਹੋਰ ਸਿਰ 'ਤੇ ਲਾਭ ਦੇ ਵਿਰੁੱਧ ਨੁਕਸਾਨ ਦੀ ਰਾਸ਼ੀ ਨੂੰ ਸੈੱਟ ਕਰਨ ਦਾ ਹੱਕਦਾਰ ਹੋਵੇਗਾ। 5. ਧਨ ਕਰ ਐਕਟ, 1957 ਦੀ ਧਾਰਾ 4 ਜੋ ਪਤਨੀ ਜਾਂ ਘੱਟ ਉਮਰ ਦੇ ਬੱਚੇ ਨੂੰ ਸੌਂਪੇ ਗਏ ਸਰੋਤਾਂ ਨੂੰ ਵੀ 'ਸ਼ਾਮਲ ਕਰਦੀ ਹੈ, ਜਦੋਂ ਤੱਕ ਕਿ "ਆਮਦਨ" ਸ਼ਬਦ ਦੀ ਵਰਤੋਂ ਕੀਤੀ ਜਾਂਦੀ ਹੈ, ਤਾਂ ਉਸ ਵਿਅਕਤੀ ਦੀ ਆਮਦਨ ਵਿੱਚ ਸ਼ਾਮਲ ਕੀਤਾ ਜਾਵੇਗਾ। ਫਿਰ ਵੱਖ-ਵੱਖ ਚੀਜ਼ਾਂ, ਸਰੋਤਾਂ ਦੀ ਤਬਦੀਲੀ ਸਮੇਤ, ਦਾ ਜ਼ਿਕਰ ਕੀਤਾ ਗਿਆ ਹੈ। ਆਮਦਨ ਕਰ ਐਕਟ ਸਿਰਫ ਉਨ੍ਹਾਂ ਨੂੰ ਸ਼ਾਮਲ ਕਰਦਾ ਹੈ, ਜਦੋਂ ਕਿ ਧਨ ਕਰ ਐਕਟ ਉਨ੍ਹਾਂ ਸਭ ਨੂੰ ਮੁਲਾਜ਼ਮ ਦੀ ਮਲਕੀਅਤ ਵਾਲਾ ਬਣਾਉਂਦਾ ਹੈ। 6. 1922 ਐਕਟ ਦੀ ਧਾਰਾ 24(2) ਤਹਿਤ ਨੁਕਸਾਨ ਨੂੰ ਅੱਗੇ ਲਿਜਾਣ ਲਈ, ਦੋ ਸ਼ਰਤਾਂ ਪੂਰੀਆਂ ਕੀਤੀਆਂ ਜਾਣੀਆਂ ਸਨ, ਪਹਿਲਾਂ, ਉਸ ਸਾਲ ਵਿੱਚ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤਾ ਚੱਲ ਰਿਹਾ ਹੋਵੇ ਅਤੇ ਦੂਜਾ, ਕਿ ਜਿਸ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤੇ ਵਿੱਚ ਨੁਕਸਾਨ ਪਹਿਲਾਂ ਹੋਇਆ ਸੀ, ਉਹ ਉਸ ਸਾਲ ਵਿੱਚ ਵੀ ਮੁਲਾਜ਼ਮ ਦੁਆਰਾ ਚੱਲ ਰਿਹਾ ਹੋਵੇ। Case: THE COMMISSIONER OF INCOME TAX, BANGALORE versus SRI J.H. Similar claims for set off were made in the asseaoment years 1960-61 and 1961-62 but were rejected. c On the appeals preferred by the assessee, the Appellate Assistant Commissioner allowed the set off clsimed, on the grouwl that the assessee himself is deemed to be carrying on the D business from which the share income was derived by his wife and minor children. The revemie appealed to the Income Tax Appellate Tribunal, wb:1ch held that although the assessee was not carrying on the lnµJiness of manufacture and sale of oil during the years under E appeal, he was continuing to carry on the business of oil in general, that the firm did carry on the same business as was hitlierto being carried on by the assesaee but there waa no connection between the assessee and the business carried on by the firm and they were two different entities and, aa euch, the assessee could not be said to be carrying on the business out of F which the shru:e incoe of the wife and minor children arose. It accordingly held that the aasessee was not entitled under section 24 (2) of the Income Tax Act 1922 to cl.aim set off of his losses against the income of hia wife and minor children. D E The High Court on " reference by the Tribunal held that for G an aasessee to be entitled to carry forward the loss to the following year and to claim a set off under section 24 (2) (ii) ot the Act the following conditions should be fulfilled: (i) the loss DISC be in a business; (ii) the business, profession or vocation in ..W.ch the loss was originally sustained lllW!t be continued to be carried on by the assessee in the· year in which H the carried forward loss is ~ought to be set of; and (iii) the business, profession or vocation against the proflts of which set off is claimed 1111St be carried on by the assessee in that year, and relying on the decision of the Karnataka High Court in Dr. T.P; Kapadia v. C<wmdsatoner of IDCClllll! Tax, 87 I.T.R. 511, held that the share income of the asses3ee' s total income under section 16(3) of the Act should be regarded as business income derived from business carried en by :he assessee, llD.d the assessee was entl.tled to set off his loss carriad forward from the previons year. In the appeals by .the Revenue to this Court, it WllS contended relying on the decision of the Gujarat High Cour~ in ll!lyalbbai Hadbin-ji Vadera v. r..-lnioner of Income Ta:, Gujant 60 I.T.R. 55t that the loss could not be included in the total income of the assessee, while on behalf of lhe assesse<o it was contended that in the first year when the assets are transfered to the wife or the minor child then the loss has to be taken into account is computing the profits' and gains arising out of the user of assets so transferred in order to compute the result, and that the object of section 16 (3) (a) was to foil an individusl's attempt to reduce the incidence of tax by transferring his assets to his wife or minor child or by admitting his wife as a partner or his minor child to the benefits of partnership in a firm in which he is a partner by transferring the assets directly or indirectly to them otherwise than for adequate consideration. Dismissing the Appeals, HELD: 1. The share income of the wife and minor children included in the assessef''s total income under section 16(3) of the Act should be regarded as business income derived from b1.1siness carried on by the assessee, and the assessee is entitled to set off his loss carried forward from the previous years. GOTLA, YADAGIRI [[1985] SUPP. 2 S.C.R. 711] (1985) ਕੀਤਾ ਗਿਆ ਹੈ। ਆਮਦਨ ਕਰ ਐਕਟ ਸਿਰਫ ਉਨ੍ਹਾਂ ਨੂੰ ਸ਼ਾਮਲ ਕਰਦਾ ਹੈ, ਜਦੋਂ ਕਿ ਧਨ ਕਰ ਐਕਟ ਉਨ੍ਹਾਂ ਸਭ ਨੂੰ ਮੁਲਾਜ਼ਮ ਦੀ ਮਲਕੀਅਤ ਵਾਲਾ ਬਣਾਉਂਦਾ ਹੈ। 6. 1922 ਐਕਟ ਦੀ ਧਾਰਾ 24(2) ਤਹਿਤ ਨੁਕਸਾਨ ਨੂੰ ਅੱਗੇ ਲਿਜਾਣ ਲਈ, ਦੋ ਸ਼ਰਤਾਂ ਪੂਰੀਆਂ ਕੀਤੀਆਂ ਜਾਣੀਆਂ ਸਨ, ਪਹਿਲਾਂ, ਉਸ ਸਾਲ ਵਿੱਚ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤਾ ਚੱਲ ਰਿਹਾ ਹੋਵੇ ਅਤੇ ਦੂਜਾ, ਕਿ ਜਿਸ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤੇ ਵਿੱਚ ਨੁਕਸਾਨ ਪਹਿਲਾਂ ਹੋਇਆ ਸੀ, ਉਹ ਉਸ ਸਾਲ ਵਿੱਚ ਵੀ ਮੁਲਾਜ਼ਮ ਦੁਆਰਾ ਚੱਲ ਰਿਹਾ ਹੋਵੇ। 7. ਧਾਰਾ 24(2)(ii) ਦੇ ਸਿਧਾਂਤ ਦਾ ਉਦੇਸ਼ ਸਿਰਫ ਉਸ ਸਾਲ ਦੀ ਕਾਰੋਬਾਰਕ ਆਮਦਨ ਦੇ ਵਿਰੁੱਧ ਸੈੱਟ ਆਫ ਨੂੰ ਪ੍ਰਤੀਬੰਧਤ ਕਰਨਾ ਸੀ ਤਾਂ ਜੋ ਉਸ ਕਿੱਤੇ ਦਾ ਨੁਕਸਾਨ ਦੂਜੇ ਕਾਰੋਬਾਰ, ਪੇਸ਼ਾ ਜਾਂ ਕਿੱਤੇ ਦੇ ਵਿਰੁੱਧ ਸੈੱਟ ਕੀਤਾ ਜਾ ਸਕੇ ਜੋ ਉਸ ਸਾਲ ਵਿੱਚ ਉਸ ਦੁਆਰਾ ਚੱਲ ਰਿਹਾ ਹੋਵੇ। 8. ਧਾਰਾ 16(3)(ਬੀ) ਦੇ ਉਦੇਸ਼ ਨੂੰ ਧਾਰਾ 24(2) ਦੇ ਨਾਲ ਪੜ੍ਹਨਾ ਪੈਂਦਾ ਹੈ। ਜੇਕਰ ਕਿਸੇ ਵਿਸ਼ੇਸ਼ ਪ੍ਰਬੰਧ ਦਾ ਉਦੇਸ਼ ਐਕਟ ਦੀ ਪੂਰੀ ਯੋਜਨਾ ਤੋਂ ਆਸਾਨੀ ਨਾਲ ਸਮਝਿਆ ਜਾ ਸਕਦਾ ਹੈ, ਜੋ ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਸਰੋਤਾਂ ਦੀ ਤਬਦੀਲੀ ਦੇ ਪ੍ਰਭਾਵ ਨੂੰ ਰੋਕਣਾ ਹੈ, ਜਿੱਥੇ ਆਮਦਨ ਦੀ ਗਣਨਾ ਕੀਤੀ ਜਾਂਦੀ ਹੈ, ਤਾਂ ਅੰਤ ਨੂੰ ਪਾਬੰਦੀ ਵਾਲੀ ਵਿਆਖਿਆ ਨੂੰ ਖਤਮ ਕਰ ਦਿੱਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ। ਵਿਧਾਨ ਸਭਾ ਦੁਆਰਾ ਵਰਤੀ ਗਈ ਭਾਸ਼ਾ ਤੋਂ ਇਰਾਦੇ ਨੂੰ ਲੱਭਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਜੇਕਰ ਸਖਤ ਸ਼ਬਦਾਵਲੀ ਵਾਲੀ ਵਿਆਖਿਆ ਅਜੀਬ ਨਤੀਜੇ ਵੱਲ ਲੈ ਜਾਂਦੀ ਹੈ, ਤਾਂ ਉਸ ਨਤੀਜੇ ਨੂੰ ਪ੍ਰਾਪਤ ਨਹੀਂ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ, ਤਾਂ ਜੇਕਰ ਹੋਰ ਵਿਆਖਿਆ ਸੰਭਵ ਹੈ, ਤਾਂ ਸਖਤ ਸ਼ਬਦਾਵਲੀ ਵਾਲੀ ਵਿਆਖਿਆ ਨੂੰ ਤਰਜੀਹ ਦਿੱਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ। ਹਾਲਾਂਕਿ ਬੰਦੋਬਸਤ ਅਤੇ ਕਰਾਰ ਅਕਸਰ ਅਣਜਾਣ ਹੁੰਦੇ ਹਨ, ਇਸ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ ਕਿ ਉਹ ਹਮੇਸ਼ਾਂ ਅਣਜਾਣ ਨਾ ਰਹਿਣ। ਜੇਕਰ ਕੋਈ ਵਿਆਖਿਆ ਅਨਿਆਂ ਦੀ ਬਜਾਏ ਨਿਆਂ ਵਿੱਚ ਸਮਾਪਤ ਹੁੰਦੀ ਹੈ, ਤਾਂ ਅਜਿਹੀ ਵਿਆਖਿਆ ਨੂੰ ਸ਼ਬਦਾਵਲੀ ਵਾਲੀ ਵਿਆਖਿਆ ਨਾਲੋਂ ਤਰਜੀਹ ਦਿੱਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ। 9. ਇਹ ਬਿਨਾਂ ਕਿਸੇ ਸ਼ੱਕ ਦੇ ਸਵੀਕਾਰ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਆਮਦਨ ਵਿੱਚ ਸ਼ਾਮਲ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ ਜੇ ਇਹ ਪਤਨੀ ਜਾਂ ਨਾਬਾਲਗ ਬੱਚੇ ਦੀ ਆਮਦਨ ਦੇ ਸ਼ਾਮਲ ਕਰਨ ਦਾ ਸਵਾਲ ਨਹੀਂ ਹੈ ਜਿਸਦੀਆਂ ਸੰਪਤੀਆਂ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਜਨਮ ਲੈਣ ਵਾਲੀਆਂ ਸਨ ਅਤੇ ਜਿਸ ਨਾਲ ਕਾਰੋਬਾਰ ਚਲਾਇਆ ਗਿਆ ਸੀ ਜਾਂ ਜਿਸ ਨਾਲ ਪਤਨੀ ਜਾਂ ਨਾਬਾਲਗ ਬੱਚੇ ਦੀ ਆਮਦਨ ਪੈਦਾ ਹੋਈ ਸੀ, ਤਾਂ ਪਤਨੀ ਜਾਂ ਨਾਬਾਲਗ ਬੱਚੇ ਦੀ ਆਮਦਨ ਦਾ ਅਨੁਮਾਨ ਲਗਾਉਣ ਵਿੱਚ ਇਹ ਪ੍ਰਦਾਨ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਅਜਿਹੀ ਆਮਦਨ ਨੂੰ ਧਾਰਾ 10 ਅਤੇ ਕਾਨੂੰਨ ਦੀਆਂ ਹੋਰ ਵਿਵਸਥਾਵਾਂ ਦੇ ਅਨੁਸਾਰ ਗਣਨਾ ਕੀਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ, ਜਿਸ ਵਿੱਚ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 24(1) ਅਤੇ ਧਾਰਾ 24(2) ਸ਼ਾਮਲ ਹਨ। ਪਰ ਜੋ ਸਵਾਲ ਇੱਥੇ ਉੱਠਦਾ ਹੈ ਉਹ ਇਹ ਹੈ ਕਿ ਕੀ ਅਜਿਹੀ ਆਮਦਨ ਦੇ ਸ਼ਾਮਲ ਕਰਨ ਦੇ ਵਿਰੁੱਧ ਮੁਲਾਂਕਣਕਰਤਾ (ਪਿਛਲੇ ਸਾਲ ਵਿੱਚ ਜੋ ਧਾਰਾ 24(1) ਦੇ ਤਹਿਤ ਅੱਗੇ ਲਿਜਾਇਆ ਗਿਆ ਸੀ) ਦੁਆਰਾ ਪੈਦਾ ਹੋਈ ਨੁਕਸਾਨ ਨੂੰ ਸੈੱਟ ਆਫ ਕਰਨ ਦੀ ਆਗਿਆ ਦਿੱਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ ਜਾਂ ਨਹੀਂ। ਸੀ.ਆਈ.ਟੀ. ਬਨਾਮ ਲਖਮੀਚੰਦ ਬਾਈਜਨਾਥ 44 ਆਈ.ਟੀ.ਆਰ. 667 ਵੱਖਰਾ ਕੀਤਾ ਗਿਆ। ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਬੰਬਈ ਬਨਾਮ ਮਨੀਲਾਲ ਧਨ 11 44 ਆਈ.ਟੀ.ਆਰ. 876, ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਕੇਰਲਾ II ਬਨਾਮ ਸ਼੍ਰੀਮਤੀ ਮੈਰੀ ਇਗਨੇਸ਼ੀਅਸ 141 ਆਈ.ਟੀ.ਆਰ. 954, ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਕੇਰਲਾ ਬਨਾਮ ਪੀ.ਕੇ. ਕੋਚਾਊ ਆ ਪੇਰੋਕ 125 ਆਈ.ਟੀ.ਆਰ. 624, ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ ਬਨਾਮ ਐਸ.ਏ.ਐਸ. ਮਰੀਮਾਥੂ ਨਾਦਰ 44 ਆਈ.ਟੀ.ਆਰ. 1, ਦੇਸ਼ ਬੰਧੂ ਗੁਪਤਾ ਐਡ ਕੰਪਨੀ ਅਤੇ ਹੋਰ ਬਨਾਮ ਦਿੱਲੀ ਸਟਾਕ ਐਕਸਚੇਂਜ ਐਸੋਸੀਏਸ਼ਨ ਲਿਮਟਿਡ [1979] 4 ਐਸ.ਸੀ.ਸੀ. 565 ਅਤੇ ਮਨੀਕਮ ਐਡ ਕੰਪਨੀ ਬਨਾਮ ਤਾਮਿਲਨਾਡੂ ਰਾਜ 39 ਐਸ.ਟੀ.ਸੀ. 12 ਤੇ 18 ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ ਹੈ। ਸਿਵਲ ਅਪੀਲੀ ਅਧਿਕਾਰ ਖੇਤਰ : ਸਿਵਲ ਅਪੀਲ ਨੰਬਰ 1596-1598 (ਐਨਟੀ) ਦੀ 1973। 1970 ਦੇ ਆਈ.ਟੀ.ਆਰ.ਸੀ. ਨੰਬਰ 33, 34 ਅਤੇ 35 ਵਿੱਚ ਬੰਗਲੌਰ ਵਿਖੇ ਮੈਸੂਰ ਹਾਈ ਕੋਰਟ ਦੇ 21 ਮਾਰਚ, 1973 ਦੇ ਫੈਸਲੇ ਅਤੇ ਆਦੇਸ਼ ਤੋਂ ਭਾਰਤੀ ਆਮਦਨ ਕਰ ਐਕਟ, 1922 ਦੀ ਧਾਰਾ 66ਏ (2) ਦੇ ਤਹਿਤ ਅਪੀਲਾਂ। ਅਪੀਲਕਰਤਾ ਵੱਲੋਂ ਐਸ.ਸੀ. ਮਨਚੰਦਾ, ਬੀ.ਬੀ. ਆਹੂਜਾ ਅਤੇ ਮਿਸ ਏ. ਸੁਭਾਸ਼ਿਨੀ। ਜੇ. ਰਾਮਚੰਦਰਨ ਅਤੇ ਸ਼੍ਰੀਮਤੀ ਜੇ. ਰਾਮਚੰਦਰ ਪ੍ਰਤੀਵਾਦੀ ਵੱਲੋਂ। ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ ਸਬਿਆਸਾਚੀ ਮੁਖਰਜੀ, ਨਾਇਬ ਨਿਆਂਕਾ ਇਹ ਅਪੀਲਾਂ ਕਰਨਾਟਕ ਦੀ ਉੱਚ ਅਦਾਲਤ ਦੇ 10ਵੇਂ ਅਗਸਤ, 1973 ਦੇ ਹੁਕਮਾਂ ਤੋਂ ਉੱਭਰਦੀਆਂ ਹਨ ਜੋ 1959-60, 1960-61 ਅਤੇ 1961-62 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲਾਂ ਲਈ ਆਮਦਨ ਕਰ ਐਕਟ, 1962 (ਪੁਰਤੀ) ਦੇ ਸੈਕਸ਼ਨ 66ਏ(2) ਦੇ ਤਹਿਤ ਸਰਟੀਫਿਕੇਟ ਦੁਆਰਾ ਦਿੱਤੇ ਗਏ ਹਨ ਜਿਸ ਨੂੰ "ਐਕਟ" ਵਜੋਂ ਜਾਣਿਆ ਜਾਂਦਾ ਹੈ। Case: THE COMMISSIONER OF INCOME TAX, BANGALORE versus SRI J.H. The Income Tax Act, 1922 was replaced by the Income Tax Act, 1961. Section 64 of the Income Tax Act, 1961, deals with inclusion of income of the assessee arising out of the assets transferred directly or indirectly to the spouse or the minor child. The provisions on significant aspects are similar to the Act except that in section 64 of 1961 Act, the expression 'spouse' has been used unlike 'wife' used in section 16(3) of the Act. Sections 70 to 72 of 1961 Act contain provisions similar to section 24 of 1922 Act. Sub-section (l) of section 24, provides that where any assessee sustains a loss of profits or gains in any year ·under any of the heads ..,ntioned in section 6, he shall be entitled to have the amount of the loss set off against his income, profits or g&ins under any or.her head in that year. (723 D-E). 5. Section 4 of the Wealth Tax Act, 1957 which also makes assets transferred to the wife or the minor child includible in the net wealth of the assessee uses the expression " in computing the net wealth of an individual, there shall be included, as beJongfng to that individual•. Then the different items including the items of assets transferred have been ..,ntioned. The Income Tax Act only makes these as includible as such while the Wealth Tax Act miikes includible as belonging to the asseuee. ( 724 E) 6. To set off the carried forward loss of the assessee, two conditions were required to be fulfilled under section 24(2) of 1922 Act, firstly, business, profession or vocation must be carried on by him in that year awl secondly, that the business profession or vocation in which loss was originally sustained must continue to be carried on by the assessee in the year in question. If the purpose of a particular pr->viaion is easily discernible from the whole scheme of the Act which in this case is, to counter-act, the ef~ect of the transfer of assets so far aa computation of inco:ne of the aasessee is concerned, then bearing that purpose in mind, the intention should be fonnd out from the language used by the legislature and 1£ strict literal construction leads to. an absurd result i.e. result not intended to be subserved by the object of the legisla-tion, then 1£ other construction is possible apert from strict literal construction then that construction should be preferred to the strict literal construction. Though equity and taxation are often strSDgP.rs, attempts should be made that these do not remain so always, and if a construction results in equity rather than.in in-justice then such construction should be preferred to the literal construction. If it were a question of inclusion of the income of the wife or minor child to whom assets have been transferred by the assessee and with which blisiness was carried on or by which income waa derived by the wife or the minor child, then in including that income either of the wife or minor child such income should be computed in accordance with section 10 and other provisions of the Act including section 24(1) and section 24 (2) of the Act. GOTLA, YADAGIRI [[1985] SUPP. 2 S.C.R. 711] (1985) ਅਪੀਲਕਰਤਾ ਵੱਲੋਂ ਐਸ.ਸੀ. ਮਨਚੰਦਾ, ਬੀ.ਬੀ. ਆਹੂਜਾ ਅਤੇ ਮਿਸ ਏ. ਸੁਭਾਸ਼ਿਨੀ। ਜੇ. ਰਾਮਚੰਦਰਨ ਅਤੇ ਸ਼੍ਰੀਮਤੀ ਜੇ. ਰਾਮਚੰਦਰ ਪ੍ਰਤੀਵਾਦੀ ਵੱਲੋਂ। ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ ਸਬਿਆਸਾਚੀ ਮੁਖਰਜੀ, ਨਾਇਬ ਨਿਆਂਕਾ ਇਹ ਅਪੀਲਾਂ ਕਰਨਾਟਕ ਦੀ ਉੱਚ ਅਦਾਲਤ ਦੇ 10ਵੇਂ ਅਗਸਤ, 1973 ਦੇ ਹੁਕਮਾਂ ਤੋਂ ਉੱਭਰਦੀਆਂ ਹਨ ਜੋ 1959-60, 1960-61 ਅਤੇ 1961-62 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲਾਂ ਲਈ ਆਮਦਨ ਕਰ ਐਕਟ, 1962 (ਪੁਰਤੀ) ਦੇ ਸੈਕਸ਼ਨ 66ਏ(2) ਦੇ ਤਹਿਤ ਸਰਟੀਫਿਕੇਟ ਦੁਆਰਾ ਦਿੱਤੇ ਗਏ ਹਨ ਜਿਸ ਨੂੰ "ਐਕਟ" ਵਜੋਂ ਜਾਣਿਆ ਜਾਂਦਾ ਹੈ। ਮੁਲਾਂਕਣਕਰਤਾ ਇੱਕ ਵਿਅਕਤੀ ਵਜੋਂ ਸੀ। ਉਹ ਸੰਬੰਧਿਤ ਮੁਲਾਂਕਣ ਸਾਲਾਂ ਦੌਰਾਨ ਮੂੰਗਫਲੀ ਤੇਲ ਦੀ ਖਰੀਦ ਅਤੇ ਵੇਚ ਦੇ ਕਾਰੋਬਾਰ ਨੂੰ ਚਲਾ ਰਿਹਾ ਸੀ ਅਤੇ ਉਹ ਇੱਕ ਤੇਲ ਮਿੱਲ ਵੀ ਚਲਾ ਰਿਹਾ ਸੀ। ਉਹ ਇੱਕ ਅਬਕਾਰੀ ਠੇਕੇਦਾਰ ਵੀ ਸੀ। 1ਵੇਂ ਜੂਨ, 1957 ਨੂੰ, ਉਸਨੇ ਅਬਕਾਰੀ ਮਿੱਲ ਅਤੇ ਮਸ਼ੀਨਰੀ ਵਿੱਚ ਨਵੀਆਂ ਪੌਦਿਆਂ ਨੂੰ ਲਗਾਇਆ ਸੀ, ਜੋ ਪਹਿਲਾਂ ਉਸਦੀ ਪਤਨੀ ਦੇ ਤਿੰਨ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਦੁਆਰਾ ਉਸਨੂੰ ਤੋਹਫੇ ਵਿੱਚ ਦਿੱਤੀਆਂ ਗਈਆਂ ਸਨ। ਮੁਲਾਂਕਣਕਰਤਾ ਅਤੇ ਤਿੰਨ ਹੋਰ ਵਿਕਰੇਤਾਵਾਂ ਦੁਆਰਾ ਇੱਕ ਫਰਮ ਬਣਾਈ ਗਈ ਸੀ, ਜਿਸਦੇ ਲਾਭਾਂ ਵਿੱਚ ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਤਿੰਨ ਘੱਟ ਗਿਣਤੀ ਪੁੱਤਰਾਂ ਨੂੰ ਵੀ ਸ਼ਾਮਲ ਕੀਤਾ ਗਿਆ ਸੀ। ਫਰਮ ਨੇ ਵੀ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਫਰਮ ਅਤੇ ਮਸ਼ੀਨਰੀ ਨੂੰ ਕਿਰਾਏ 'ਤੇ ਦੇ ਦਿੱਤਾ ਸੀ ਅਤੇ ਬਾਕੀ ਮਸ਼ੀਨਰੀ ਦੁਆਰਾ ਮੂੰਗਫਲੀ ਤੇਲ ਦੇ ਨਿਰਮਾਣ ਅਤੇ ਵੇਚ ਦਾ ਕਾਰੋਬਾਰ ਕੀਤਾ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਫਰਮ ਨਾਲ ਇੱਕ ਸਮਝੌਤੇ 'ਤੇ ਹਸਤਾਖਰ ਕੀਤੇ ਸਨ, ਜਿਸ ਤਹਿਤ ਕੁਝ ਸੇਵਾਵਾਂ ਪ੍ਰਬੰਧਨ ਦੁਆਰਾ ਫਰਮ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪ੍ਰਦਾਨ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਫਰਮ ਦੁਆਰਾ ਬਣਾਈ ਗਈ ਤੇਲ ਕੇਕ ਦੀ ਖਰੀਦ ਅਤੇ ਵੇਚ ਦੇ ਨਿਰਧਾਰਤ ਦਰਾਂ 'ਤੇ ਕਮਿਸ਼ਨ ਪ੍ਰਾਪਤ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਮੂੰਗਫਲੀ ਕੇਕ ਅਤੇ ਤੇਲ ਦੀ ਖਰੀਦ ਅਤੇ ਵੇਚ ਦਾ ਕਾਰੋਬਾਰ ਇੱਕ ਛੋਟੇ ਪੱਧਰ 'ਤੇ ਸ਼ੁਰੂ ਕੀਤਾ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਅਬਕਾਰੀ ਠੇਕੇਦਾਰ ਵਜੋਂ ਆਪਣਾ ਕਾਰੋਬਾਰ ਵੀ ਜਾਰੀ ਰੱਖਿਆ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਪਿਛਲੇ ਸਾਲਾਂ ਵਿੱਚ ਆਪਣੇ ਵਿਅਕਤੀਗਤ ਕਾਰੋਬਾਰ ਵਿੱਚ ਵੱਡੇ ਨੁਕਸਾਨ ਸਹਿਤ ਸਨ, ਜੋ 1958-59 ਤੱਕ ਸਾਲ-ਦਰ-ਸਾਲ ਅੱਗੇ ਵਧਾਏ ਜਾ ਰਹੇ ਸਨ। 1959-59 ਤੋਂ ਅੱਗੇ ਵਧਾਏ ਗਏ ਨੁਕਸਾਨ 7,88,734 ਸੀ, 1959-60 ਲਈ ਆਪਣੇ ਕਾਰੋਬਾਰ ਤੋਂ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਤਰ੍ਹਾਂ ਦੀ ਆਮਦਨ 14,324 ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਪਤਨੀ ਅਤੇ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਦੀ ਫਰਮ ਤੋਂ 1959-60 ਲਈ ਸ਼ੇਅਰ ਆਮਦਨ 24,592 ਸੀ। ਉਹ ਆਮਦਨ ਐਕਟ ਦੀ ਧਾਰਾ 16(3) ਦੇ ਤਹਿਤ 1959-60 ਲਈ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਕੁੱਲ ਆਮਦਨ ਦੀ ਗਣਨਾ ਵਿੱਚ ਸ਼ਾਮਲ ਕੀਤੀ ਗਈ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ 1958-59 ਤੋਂ ਅੱਗੇ ਵਧਾਏ ਗਏ ਨੁਕਸਾਨ ਨੂੰ ਆਪਣੇ ਕਾਰੋਬਾਰ ਦੀ ਆਮਦਨ ਦੇ ਨਾਲ-ਨਾਲ ਆਪਣੀ ਪਤਨੀ ਅਤੇ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਦੀ ਸ਼ੇਅਰ ਆਮਦਨ ਦੇ ਵਿਰੁੱਧ ਸੈੱਟ ਆਫ ਦਾ ਦਾਅਵਾ ਕੀਤਾ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਆਪਣੀ ਪਤਨੀ ਅਤੇ ਘੱਟ ਗਿਣਤੀ ਬੱਚਿਆਂ ਦੀ ਸ਼ੇਅਰ ਆਮਦਨ ਨਾਲ ਸਬੰਧਤ ਸੈੱਟ ਆਫ ਦੇ ਦਾਅਵੇ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ। 1960-61 ਅਤੇ 1961-62 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲਾਂ ਵਿੱਚ ਵੀ ਇਸੇ ਤਰ੍ਹਾਂ ਦੇ ਦਾਅਵੇ ਕੀਤੇ ਗਏ ਸਨ ਪਰ ਉਨ੍ਹਾਂ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਗਿਆ ਸੀ। ਅਪੀਲਾਂ ਦੇ ਸਬੰਧ ਵਿੱਚ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪਸੰਦ ਕੀਤੀ ਗਈ, ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਸੈੱਟ ਆਫ ਦਾ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਆਪ ਹੀ ਉਹ ਕਾਰੋਬਾਰ ਕਰਨ ਦਾ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ ਜਿਸ ਤੋਂ ਉਸਦੀ ਪਤਨੀ ਅਤੇ ਨਾਬਾਲਗ ਬੱਚਿਆਂ ਦੀ ਸ਼ੇਅਰ ਆਮਦਨ ਪ੍ਰਾਪਤ ਹੁੰਦੀ ਹੈ। ਆਮਦਨ ਕਰ ਵਿਭਾਗ ਨੇ ਹੈਦਰਾਬਾਦ ਬੈਂਚ ਦੇ ਆਮਦਨ ਕਰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਕੋਲ ਅਪੀਲ ਕੀਤੀ। ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਭਾਵੇਂ ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਅਪੀਲ ਦੇ ਸਾਲਾਂ ਦੌਰਾਨ ਤੇਲ ਦੇ ਨਿਰਮਾਣ ਅਤੇ ਵੇਚਣ ਦਾ ਕਾਰੋਬਾਰ ਨਹੀਂ ਕੀਤਾ, ਉਹ ਆਮ ਤੌਰ 'ਤੇ ਤੇਲ ਦਾ ਕਾਰੋਬਾਰ ਜਾਰੀ ਰੱਖ ਰਿਹਾ ਸੀ; ਕਿ ਫਰਮ ਨੇ ਉਹੀ ਕਾਰੋਬਾਰ ਕੀਤਾ ਜੋ ਪਹਿਲਾਂ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਕੀਤਾ ਗਿਆ ਸੀ ਪਰ ਮੁਲਾਂਕਣਕਰਤਾ ਅਤੇ ਫਰਮ ਦੁਆਰਾ ਕੀਤੇ ਗਏ ਕਾਰੋਬਾਰ ਵਿਚਕਾਰ ਕੋਈ ਸਬੰਧ ਨਹੀਂ ਸੀ, ਅਤੇ, ਇਸ ਲਈ, ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਇਹ ਨਹੀਂ ਕਿਹਾ ਜਾ ਸਕਦਾ ਕਿ ਉਹ ਉਸ ਕਾਰੋਬਾਰ ਨੂੰ ਜਾਰੀ ਰੱਖ ਰਿਹਾ ਹੈ ਜਿਸ ਤੋਂ ਪਤਨੀ ਅਤੇ ਨਾਬਾਲਗ ਬੱਚਿਆਂ ਦੀ ਸ਼ੇਅਰ ਆਮਦਨ ਪੈਦਾ ਹੁੰਦੀ ਹੈ। ਇਸ ਲਈ ਇਸਨੇ ਇਹ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 24 (2) ਤਹਿਤ ਆਪਣੀ ਪਤਨੀ ਅਤੇ ਨਾਬਾਲਗ ਬੱਚਿਆਂ ਦੀ ਆਮਦਨ ਦੇ ਵਿਰੁੱਧ ਆਪਣੀਆਂ ਘਾਟਾਵਾਂ ਦਾ ਸੈੱਟ ਆਫ ਕਰਨ ਦਾ ਹੱਕਦਾਰ ਨਹੀਂ ਸੀ। ਅਦਾਲਤ: ਹੇਠ ਲਿਖੀ ਕਾਨੂੰਨੀ ਸਵਾਲ ਹਾਈ ਕੋਰਟ ਨੂੰ ਰਿਫਰ ਕੀਤੀ ਗਈ ਸੀ: "ਕੀ, ਕੇਸ ਦੇ ਤੱਥਾਂ ਅਤੇ ਹਾਲਾਤਾਂ ਵਿੱਚ, ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ 1959-60 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ ਆਪਣੀ ਪਤਨੀ ਅਤੇ ਨਾਬਾਲਗ ਬੱਚਿਆਂ ਦੀ ਸ਼ੇਅਰ ਆਮਦਨ ਦੇ ਵਿਰੁੱਧ ਘਾਟਾਵਾਂ ਨੂੰ ਅੱਗੇ ਲਿਜਾਣ ਅਤੇ ਸੈੱਟ ਆਫ ਕਰਨ ਦਾ ਹੱਕ ਹੈ ਜਾਂ ਨਹੀਂ, ਆਮਦਨ ਕਰ ਐਕਟ, 1922 ਦੀ ਧਾਰਾ 24(2) ਤਹਿਤ?" ਇਸੇ ਤਰ੍ਹਾਂ ਦੇ ਨਤੀਜੇ 1960-61 ਅਤੇ 1961-62 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲਾਂ ਲਈ ਵੀ ਹੋਏ। ਇਹਨਾਂ ਸਾਰੇ ਸਾਲਾਂ ਲਈ, ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 66(1) ਤਹਿਤ ਹਾਈ ਕੋਰਟ ਨੂੰ ਰਿਫਰੈਂਸ ਕੀਤੇ ਗਏ ਸਨ। ਹਾਈ ਕੋਰਟ ਨੇ ਪਹਿਲਾਂ ਉਪਰੋਕਤ ਤੱਥਾਂ ਦਾ ਜ਼ਿਕਰ ਕੀਤਾ ਅਤੇ ਫਿਰ ਕਾਨੂੰਨ ਦੀ ਧਾਰਾ 24(2)(11) ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਜਿਵੇਂ ਕਿ ਉਸ ਸਮੇਂ ਇਹ ਸੀ। ਇਸ ਧਾਰਾ ਤੋਂ ਇਹ ਜਾਪਦਾ ਹੈ, ਜਿਵੇਂ ਕਿ ਹਾਈ ਕੋਰਟ ਨੇ ਕਿਹਾ ਹੈ, ਕਿ ਇੱਕ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਅਗਲੇ ਸਾਲ ਤੱਕ ਨੁਕਸਾਨ ਨੂੰ ਅੱਗੇ ਵਧਾਉਣ ਅਤੇ ਸੈੱਟ ਆਫ ਦਾ ਦਾਅਵਾ ਕਰਨ ਦੇ ਹੱਕਦਾਰ ਹੋਣ ਲਈ, ਹੇਠ ਲਿਖੀਆਂ ਸ਼ਰਤਾਂ ਪੂਰੀਆਂ ਕਰਨੀਆਂ ਪੈਂਦੀਆਂ ਸਨ। (1) ਘਾਟਾ ਕਿਸੇ ਕਾਰੋਬਾਰ ਵਿੱਚ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ; Case: THE COMMISSIONER OF INCOME TAX, BANGALORE versus SRI J.H.
