IN THE HIGH COURT OF JHARKHAND AT RANCHI Tax Appeal No. 45 of 2013 The Commissioner of Income Tax (Central), Patna --- --- Appellant Versus Md. Ekram --- --- Respondent --- CORAM: Hon’ble Mr. Justice Aparesh Kumar SinghHon’ble Mrs. Justice Anubha Rawat Choudhary Through: Video Conferencing --- For the Appellant: Ms. Amrita Sinha, Advocate --- 06/ 06.10.2020 Ms. Amrita Sinha for the appellant-Income Tax Department is present. 2. Office has put up a note after passing of the order dated 22.09.2020 that the instant appeal was dismissed in terms of order dated 27.09.2018 passed in C.M.P No. 133/2015 i.e. restoration application. Inadvertently, the matter was again placed under the heading ‘for orders’ earlier before the Bench for removal of defects. Notices were directed to be issued vide order dated 22.09.2020. Learned counsel for the appellant submits that requisites were not filed since by then this fact came to her notice. Office had also missed out by not placing the order passed in CMP in the instant appeal. Office has tendered unconditional apology for the inconvenience caused to the Court. 3. In those circumstances, the orders dated 24.06.2020 and 22.09.2020 passed in the instant appeal are recalled. Let the file be consigned to the records. Office to remain careful in future. (Aparesh Kumar Singh, J) (Anubha Rawat Choudhary, J)
