2.Though the reasons given for delay are not satisfactory, in our view interest of justice would be met if the delay is condoned subject to payment of cots of Rs. 5000/-.
3.Accordingly, Notice of Motion is made absolute in terms of prayer clause (a) subject to payment of costs of Rs. 5000/- to be paid by the appellant to the respondent within 2 weeks from today.
