ਮੁਲਾਂਕਣਕਰਤਾ ਇੱਕ ਹਿੰਦੂ ਅਣ-ਵੰਡ ਪਰਿਵਾਰ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਕਰਤਾ ਦੇ ਪਿਤਾ ਦੀ ਇੱਕ ਹਵਾਈ ਹਾਦਸੇ ਵਿੱਚ ਮੌਤ ਹੋ ਗਈ। ਉਸਦੀ ਮੌਤ ਤੋਂ ਬਾਅਦ ਕਰਤਾ ਨੂੰ ਉਸਦੇ ਪਿਤਾ ਦੀ ਜ਼ਿੰਦਗੀ ਨੂੰ ਕਵਰ ਕਰਨ ਵਾਲੀ ਬੀਮਾ ਪੋਲਸੀ ਦੇ ਸਬੰਧ ਵਿੱਚ ਜ਼ਿੰਦਗੀ ਬੀਮਾ ਕੰਪਨੀ ਤੋਂ 2 ਲੱਖ ਰੁਪਏ ਤੋਂ ਵੱਧ ਦੀ ਰਕਮ ਪ੍ਰਾਪਤ ਹੋਈ। ਕਹਿੰਦੇ ਹਨ ਕਿ ਕਿਹਾ ਸੀ ਉਸ ਰਕਮ ਤੋਂ ਪ੍ਰਾਪਤ ਆਮਦਨ ਨੂੰ ਉਸਦੀ ਨਿੱਜੀ ਆਮਦਨ ਵਜੋਂ ਸਮਝਿਆ ਗਿਆ ਸੀ ਅਤੇ ਉਸਨੂੰ ਉਸਦੀ ਨਿੱਜੀ ਮੁਲਾਂਕਣ ਵਿੱਚ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਸੀ, ਅਤੇ ਇਹ ਕਰਤਾ ਦੇ ਵਿਆਹ ਅਤੇ ਇੱਕ ਪੁੱਤਰ ਦੇ ਜਨਮ ਤੋਂ ਬਾਅਦ ਹੁਣ ਬਣੇ ਹੁਫ ਦੇ ਨਿੱਜੀ ਮੁਲਾਂਕਣ ਵਿੱਚ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਸੀ। ਇਹ ਸਥਿਤੀ 1959-60 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲ ਤੱਕ ਜਾਰੀ ਰਹੀ।
ਪਹਿਲੀ ਵਾਰ 1960-61 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲ ਵਿੱਚ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਬੀਮਾ ਰਕਮ ਤੋਂ ਪ੍ਰਾਪਤ ਆਮਦਨ ਨੂੰ ਹੁਫ ਦੀ ਆਮਦਨ ਵਜੋਂ ਸਮਝਿਆ ਅਤੇ ਹੁਫ ਦੇ ਹੱਥਾਂ ਵਿੱਚ ਆਮਦਨ ਦਾ ਮੁਲਾਂਕਣ ਕੀਤਾ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਇਸ ਫੈਸਲੇ ਦੇ ਖਿਲਾਫ ਅਪੀਲ ਕੀਤੀ ਅਤੇ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਮੁਲਾਂਕਣ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਫੈਸਲਾ ਸੁਣਾਇਆ ਕਿ ਆਮਦਨ ਕਰਤਾ ਦੀ ਨਿੱਜੀ ਆਮਦਨ ਸੀ ਅਤੇ ਹੁਫ ਦੀ ਨਹੀਂ ਸੀ।
ਰਾਜਸੀ ਨੇ ਆਮਦਨ ਕਰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਵਿੱਚ ਅਪੀਲ ਕੀਤੀ। 1962-63 ਦੇ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ ਵੀ ਰਾਜਸੀ ਦੁਆਰਾ ਟ੍ਰਿਬਿਊਨਲ ਵਿੱਚ ਇੱਕ ਸਮਾਨ ਅਪੀਲ ਕੀਤੀ ਗਈ ਸੀ। ਦੋਵੇਂ ਅਪੀਲਾਂ ਇੱਕ ਸਾਂਝੀ ਹੁਕਮ ਦੁਆਰਾ ਨਿਪਟਾਏ ਗਏ ਸਨ, ਜਿਸ ਵਿੱਚ ਇਹ ਫੈਸਲਾ ਸੁਣਾਇਆ ਗਿਆ ਸੀ ਕਿ ਸਵਾਲ ਵਿੱਚ ਆਮਦਨ ਹੁਫ ਦੀ ਸੀ ਅਤੇ ਇਸਨੂੰ ਅਜਿਹੇ ਮੁਲਾਂਕਣ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਸੀ।
ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਮੁਲਾਂਕਣਕਰਤਾ-ਹੁਫ ਦੇ ਕਹਿਣ 'ਤੇ ਉੱਚ ਅਦਾਲਤ ਨੂੰ ਸਵਾਲ ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ, "ਕੀ ਮ੍ਰਿਤਕ ਕਰਤਾ ਦੇ ਪਿਤਾ ਦੇ ਜੀਵਨ ਬੀਮੇ ਤੋਂ ਪ੍ਰਾਪਤ ਰਕਮ ਕਰਤਾ ਦੀ ਨਿੱਜੀ ਆਮਦਨ ਸੀ ਜਾਂ ਹੁਫ ਦੀ?"
ਰੋਕ ਲਈ ਅਰਜ਼ੀਆਂ ਵਿੱਚ ਇਹ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਸੀ ਕਿ ਬਾਅਦ ਦੇ ਸਾਲਾਂ 1963-64 ਅਤੇ 1964-65 ਲਈ ਇਹੋ ਜਿਹੀਆਂ ਅਪੀਲਾਂ ਰਾਜਸੀ ਦੁਆਰਾ ਟ੍ਰਿਬਿਊਨਲ ਦੇ ਸਾਹਮਣੇ ਦਾਇਰ ਕੀਤੀਆਂ
ਗਈਆਂ ਸਨ ਅਤੇ ਲੰਬਿਤ ਸਨ, ਕਿ ਮੁਲਾਂਕਣ ਸਾਲ 1965-66 ਤੋਂ 1969-70 ਲਈ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਦੇ ਹੁਕਮ ਮੁਲਾਂਕਣਕਰਤਾ ਵਿਰੁੱਧ ਸਨ ਅਤੇ ਮੁਲਾਂਕਣਕਰਤਾ-ਐਚਯੂਐਫ ਨੇ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲਾਂ ਪਾਈਆਂ ਸਨ ਜੋ ਵੀ ਲੰਬਿਤ ਸਨ, ਪਰ ਮੁਲਾਂਕਣਕਰਤਾ ਐਚਯੂਐਫ ਦੁਆਰਾ ਪਾਈਆਂ ਗਈਆਂ ਉਹ ਅਪੀਲਾਂ ਵਿੱਚ, ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਅਰਜ਼ੀ 'ਤੇ, ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਟੈਕਸ ਦੀ ਮੰਗ ਦੀ ਰਿਕਵਰੀ ਦੀ ਰੋਕ ਦਿੱਤੀ ਸੀ ਇਸ ਸ਼ਰਤ 'ਤੇ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਕਾਫੀ ਸੁਰੱਖਿਆ ਪ੍ਰਦਾਨ ਕਰੇਗਾ, ਕਿ ਦੋ ਮੁਲਾਂਕਣ ਸਾਲਾਂ (1960-61 ਅਤੇ 1962-63) ਨਾਲ ਸਬੰਧਤ ਗੱਲਾਂ ਇਸ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਭਾਰਤੀ ਆਮਦਨ ਕਰ ਐਕਟ, 1922/ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 66(1) ਦੇ ਤਹਿਤ ਸਨ। ਸੈਕਸ਼ਨ 256(1) ਅਨੁਸਾਰ ਰੋਕ ਦਾ ਹੁਕਮ ਦੇਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿਉਂਕਿ ਜੇ ਰੋਕ ਦਾ ਹੁਕਮ ਨਹੀਂ ਦਿੱਤਾ ਗਿਆ ਤਾਂ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਨੁਕਸਾਨ ਹੋਵੇਗਾ ਕਿਉਂਕਿ ਕਾਰਤਾ ਦੁਆਰਾ ਉਸਦੀ ਨਿੱਜੀ ਮੁਲਾਂਕਣ ਵਿੱਚ ਪੂਰਾ ਟੈਕਸ ਅਦਾ ਕੀਤੇ ਜਾਣ ਦੇ ਬਾਵਜੂਦ, ਐਚਯੂਐਫ ਨੂੰ ਉਸੇ ਆਮਦਨ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਮੁੜ ਟੈਕਸ ਦਾ ਭੁਗਤਾਨ ਕਰਨ ਲਈ ਕਿਹਾ ਜਾਵੇਗਾ।

The Assesse•. was a Hindu Undivided Family. The father of the Karta of the HUF died in an air crash. On his death a swn of over Rs. 2 lakhs was received by the Karta from the Insurance Company on account of the insurance policy covering the life of his father. The income ·derived from the said amount was treated as his personal income and assessed in his personal assessment, and it continued to be assessed in the personal assessment of the Karta even after formation of the HUF on his marriage and the birth of a son. This position continued till the assessment year 1959-60.
For the first time in the assessment yesr 1960-61 the Income Tax Officer treated the income from the insurance amount as that of the Hlff and assessed the income in the hands of the HUF. Being aggrieved the assessee appealed and the Appellate Assistant Commissioner set aside the assessment holding that the income was the personal income of the Karta and not of the HUF.
The Revenue preferred an appeal to the Income Tax Appellate Tribunal. A similar appeal was also pref erred to the Tribunal by the Revenue for assessmev.t year 1962-63. Buth the appeals were disposed of by a common order, whereby it was held that the income in question was that of the HUF and was liable to be assessed as such.
The Tribunal referred to the High Court at the instance of the assessee-HUF the question, "whether the amount received from
the Insurance Company on account of the accident Insurance Policy covering the risk of his father was correctly treated as ancestral property." The assessee also filed applications for injunction and stay under section 151 of the Code of Civil Procedure invoking the inherent jurisdiction of the High Court.
In the applications for stay it was contended that for the subsequent years 1963-64 & 1964-65 similar appeals had been filed by the Revenue, before the Tribunal and were pending, that for the assessment years 1965-66 to 1969-70 the orders of the Appellate Assistant Colmlissioner were against the assessee and the asseasee-HUF had preferred appeals to the Tribunal which were also pending, that in the said appeals preferred by the assessee HUF, on application by the assessee the Tribunal had granted stay of recovery of the tax demanded, on the condition that the assessee should furnish adequate security, that since the matter relating to the two assessment years (1960-61 and 1962-63) were before the High Court under section 66(1) of the Indian Income Tax Act, 1922/section 256(1) of the Income Tax Act, 1961 similar order of stay should be granted by the High Court because prejudice would be caused to the assessee if in spite of full tax being paid by the karta in his personal assessment, the HUF is asked to pay tax over again in respect of the same income.
The Revenue opposed the aforesaid applications for stay, contending in its counter-affidavit that under the provisions of the Income Tax Acts of 1922 and· 1961 the High Court exercised only an advisory or consultative jurisdiction, and consequently had no jurisdiction or power to grant stay of the recovery of tax as prayed for in the application, and that grant of stay by the High Court and this court had in fact been prohibited by the two Acts of 1922 and 1961.
The High Court rejected the preliminary objections raised by the Revenue and granted stay of realisation of taxes. It found that there should be stay on terms and granted stay on condition that the assessee should furnish adequate security for the said amount to the satisfaction of the concerned Income Tax Officer.

JIKLD : 1. The High Court in answering a question under section 66 of 1922 Act or section 256 of 1961 Act does not exercise original, appellate or revisional jurisdiction but only advisory jurisdiction. [866 C; 870 C]
2. Rendering advice on the question of law referred to the courts has nothing to do with the recovery of tax or granting stay in respect of the same. [870 G]
3. It cannot be said that the High Court has inherent power or incidental power in the matter of a reference pending before it to grant stay of realisation or to grant an injunction. That must remain within the jurisdiction of the appellate authority and pendency of a reference does not detract from that jurisdiction of the Appellate Authority. The High Court was, therefore. in error in the instant case in exercising ita jurisdiction by passing an order for stay of realisation under section 151 of the Code of Civil Procedure, 1908 in a pending reference. The High Court could have exercised its power if the Appellate Authority had not properly exercised its jurisdiction, not in reference jurisdiction but by virtue of its jurisdiction under Art. 226 or Article 227 of the Constitution of Indis in appropriate cases. In answering questions or disposing of references either under section 66 of 1922 Act or section 256 of 1961 Act, the liigh Courts do not exercise any jurisdiction conferred upon them by the Code of Civil Procedure or the Charters or by the Acts establishing the respective High Courts. In respect of certain matters jurisdictions exercised by the High Court muat be kept separate from the concept of inherent powers or incidental powers in exercising jurisdiction under section 66 of 1922 Act or section 256 of 1961 Act. Section 66 of Income-tax Act of 1961 ia a special jurisdiction of a limited nature conferred not by the Code of Civil Procedure or by the Charters or by the special Acts constituting such High Courts but by the special provisions of Income-Tax Act 1922 or 1961 for the limited purpose of obtaining lligh Court's opinion on questions of law. ln giving
that opinion properly if any question of incidental or ancillary power arises such as giving an opportunity or restoring a reference dismissed without hesring or giving some additional time to file paper book, such powers inhered to the jurisdiction conferred upon it. But such incidental powers can not be so construed as to confer the power of stay of recovery of taxes pending a reference which lie in the domain of an appellate authority. The concept of granting stay in a reference ex debito justitiae therefore, does not arise. That concept might""ilrise in case of the Appellate Authority exercising its power to • grant stay where there is no express provision. Ex debito justitiae is to do justice between the parties. 3. ਇਹ ਨਹੀਂ ਕਿਹਾ ਜਾ ਸਕਦਾ ਕਿ ਹਾਈ ਕੋਰਟ ਕੋਲ ਇੱਕ ਰਿਫਰੈਂਸ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਅਸਥਾਈ ਰੋਕ ਜਾਂ ਇੱਕ ਰੋਕ ਦਾ ਆਦੇਸ਼ ਦੇਣ ਲਈ ਅੰਤਰਨਿਹਿਤ ਸ਼ਕਤੀ ਜਾਂ ਗੈਰ-ਜ਼ਰੂਰੀ ਸ਼ਕਤੀ ਹੈ। ਉਹ ਅਪੀਲ ਅਧਿਕਾਰ ਖੇਤਰ ਦੇ ਅੰਦਰ ਰਹਿਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਇੱਕ ਰਿਫਰੈਂਸ ਦੀ ਲੰਬਿਤਾ ਉਸ ਅਧਿਕਾਰ ਖੇਤਰ ਤੋਂ ਘਟਾਉਂਦੀ ਨਹੀਂ ਹੈ। ਈ.ਆਰ.ਓ ਅਗਰਾਲੂ ਕੇਸ ਵਿੱਚ, ਹਾਈ ਕੋਰਟ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਲੰਬਿਤ ਰਿਫਰੈਂਸ ਵਿੱਚ ਸੈਕਸ਼ਨ 151 ਦੇ ਤਹਿਤ ਰਿਆਇਤੀਕਰਨ ਦੀ ਰੋਕ ਲਈ ਆਦੇਸ਼ ਪਾਸ ਕਰਦਿਆਂ ਆਪਣੀ ਅਧਿਕਾਰ ਖੇਤਰ ਦੀ ਵਰਤੋਂ ਕਰਦਿਆਂ ਗਲਤੀ ਕਰ ਰਹੀ ਸੀ। ਸਿਵਲ ਪ੍ਰੋਸੀਜ਼ਰ ਦੀ ਕੋਡ, 1908 ਹਾਈ ਕੋਰਟ ਨੇ ਆਪਣੀ ਸ਼ਕਤੀ ਦੀ ਵਰਤੋਂ ਕੀਤੀ ਹੋ ਸਕਦੀ ਸੀ, ਜੇਕਰ ਅਪੀਲ ਅਧਿਕਾਰੀ ਨੇ ਆਪਣੀ ਅਧਿਕਾਰ ਖੇਤਰ ਨੂੰ ਠੀਕ ਤਰ੍ਹਾਂ
ਵਰਤਿਆ ਨਾ ਹੋਵੇ, ਨਾ ਕਿ ਰਿਫਰਰਲ ਜਾਂ ਅਧਿਕਾਰ ਖੇਤਰ ਆਪਣੇ ਆਪ ਵਿੱਚ, ਬਲਕਿ ਕਲਾਂ ਦੇ ਅਧੀਨ ਭਾਰਤ ਦੀਆਂ ਸੰਸਥਾਵਾਂ ਦੁਆਰਾ ਉਚਿਤ ਮਾਮਲਿਆਂ ਵਿੱਚ। ਪਰ ਇਹ ਮਾਮਲੇ ਵਿੱਚ ਅਜਿਹਾ ਨਹੀਂ ਸੀ।
ਸ੍ਰੀਧਰ ਬਨਾਮ ਵੈਲਥ ਟੈਕਸ ਦੇ ਕਮਿਸ਼ਨਰ, 153 ਆਈ ਟੀ ਆਰ 543, ਐਟ 547 'ਤੇ; ਦੌਲਤ ਰਾਮ ਬੈਗ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇੰਕਮ ਟੈਕਸ, ਪੱਛਮੀ ਬੰਗਾਲ-12, 116 ਆਈ ਟੀ ਆਰ 219, ਦੀ ਪੁਸ਼ਟੀ ਕੀਤੀ ਗਈ।
ਪੋਲੀਸੇਟੀ ਨਾਰਾਇਣ ਰਾਓ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇੰਕਮ ਟੈਕਸ, ਹੈਦਰਾਬਾਦ, 29 ਆਈ ਟੀ ਆਰ 222, ਨੂੰ ਉਲਟਾਇਆ ਗਿਆ।
4. ਸਵਾਲਾਂ ਦੇ ਜਵਾਬ ਦਿੰਦਿਆਂ ਜਾਂ 1922 ਦੇ ਐਕਟ ਦੀ ਧਾਰਾ 66 ਜਾਂ 1961 ਦੇ ਐਕਟ ਦੀ ਧਾਰਾ 256 ਤਹਿਤ ਰਿਫਰੈਂਸਾਂ ਦਾ ਨਿਪਟਾਰਾ ਕਰਦਿਆਂ ਹਾਈ ਕੋਰਟਾਂ ਕੋਡ ਆਫ ਸਿਵਲ ਪ੍ਰੋਸੀਜ਼ਰ ਜਾਂ ਚਾਰਟਰ ਜਾਂ ਹਾਈ ਕੋਰਟਾਂ ਦੀ ਸਥਾਪਨਾ ਕਰਨ ਵਾਲੇ ਕਾਨੂੰਨਾਂ ਦੁਆਰਾ ਉਹਨਾਂ ਉੱਤੇ ਲਾਗੂ ਕੀਤੀ ਗਈ ਕੋਈ ਵੀ ਅਧਿਕਾਰ ਖੇਤਰ ਦੀ ਵਰਤੋਂ ਨਹੀਂ ਕਰਦੀਆਂ। ਕੁਝ ਮਾਮਲਿਆਂ ਬਾਰੇ ਅਧਿਕਾਰ ਖੇਤਰ ਜੋ ਹਾਈ ਕੋਰਟ ਦੁਆਰਾ ਪ੍ਰਦਾਨ ਕੀਤੇ ਗਏ ਹਨ ਉਹਨਾਂ ਨੂੰ ਧਾਰਾ 66 ਦੇ ਤਹਿਤ 1922 ਦੇ ਐਕਟ ਜਾਂ ਧਾਰਾ 256 ਦੇ ਤਹਿਤ 1961 ਦੇ ਐਕਟ ਦੁਆਰਾ ਪ੍ਰਦਾਨ ਕੀਤੀ ਗਈ ਸ਼ਕਤੀ ਦੀ ਵਰਤੋਂ ਤੋਂ ਵੱਖ ਰੱਖਣਾ ਚਾਹੀਦਾ ਹੈ। ਆਮਦਨ-ਕਰ ਐਕਟ 1961 ਦੀ ਧਾਰਾ 166 ਇੱਕ ਵੱਖਰੇ ਤਰ੍ਹਾਂ ਦੀ ਵਿਸ਼ੇਸ਼ ਅਧਿਕਾਰ ਖੇਤਰ ਹੈ ਜੋ ਕੋਡ ਆਫ ਸਿਵਲ ਪ੍ਰੋਸੀਜ਼ਰ ਜਾਂ ਚਾਰਟਰ ਜਾਂ ਹਾਈ ਕੋਰਟਾਂ ਦੀ ਸਥਾਪਨਾ ਕਰਨ ਵਾਲੇ ਵਿਸ਼ੇਸ਼ ਕਾਨੂੰਨਾਂ ਦੁਆਰਾ ਪ੍ਰਦਾਨ ਨਹੀਂ ਕੀਤੀ ਗਈ ਹੈ, ਸਗੋਂ ਹਾਈ ਕੋਰਟ ਦੀ ਰਾਏ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਸੀਮਤ ਉਦੇਸ਼ ਲਈ ਆਮਦਨ-ਕਰ ਐਕਟ 1962 ਜਾਂ 1961 ਦੇ ਵਿਸ਼ੇਸ਼ ਪ੍ਰਾਵਧਾਨਾਂ ਦੁਆਰਾ ਪ੍ਰਦਾਨ ਕੀਤੀ ਗਈ ਹੈ। ਕਿ ਰਾਏ ਠੀਕ ਤਰ੍ਹਾਂ ਜੇ ਕੋਈ ਗੌਣ ਜਾਂ ਸਹਾਇਕ ਸ਼ਕਤੀ ਦਾ ਸਵਾਲ ਉੱਠਦਾ ਹੈ ਜਿਵੇਂ ਕਿ ਇੱਕ ਮੌਕਾ ਦੇਣਾ ਜਾਂ ਬਿਨਾਂ ਸੁਣਵਾਈ ਕੀਤੇ ਹਟਾਏ ਗਏ ਰੈਫਰੰਸ ਨੂੰ ਬਹਾਲ ਕਰਨਾ ਜਾਂ ਕਾਗਜ਼ਾਂ ਦੀ ਕਿਤਾਬ ਦਾਇਰ ਕਰਨ ਲਈ ਕੁਝ ਅਤਿਰਿਕਤ ਸਮਾਂ ਦੇਣਾ, ਅਜਿਹੀਆਂ ਸ਼ਕਤੀਆਂ ਇਸ 'ਤੇ ਦਿੱਤੀ ਗਈ ਅਦਾਲਤ ਦੀ ਅਧਿਕਾਰਤਾ ਵਿੱਚ ਸ਼ਾਮਲ ਹਨ। ਪਰ ਅਜਿਹੀਆਂ ਗੌਣ ਸ਼ਕਤੀਆਂ ਨੂੰ ਇਸ ਤਰ੍ਹਾਂ ਵਿਆਖਿਆ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ ਕਿ ਇਹ ਟੈਕਸਾਂ ਦੀ ਰਿਕਵਰੀ ਨੂੰ ਰੋਕ ਰੱਖਣ ਦੀ ਸ਼ਕਤੀ ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ ਜੋ ਕਿ ਇੱਕ ਅਪੀਲ ਅਧਿਕਾਰੀ ਦੇ ਅਧਿਕਾਰ ਖੇਤਰ ਵਿੱਚ ਆਉਂਦੀ ਹੈ। ਇੱਕ ਰੈਫਰੰਸ ਵਿੱਚ ਰੋਕ ਦੇਣ ਦੀ ਇਜਾਜ਼ਤ ਦੇਣ ਦੀ ਧਾਰਨਾ ਇਸ ਲਈ ਉੱਠਦੀ ਹੀ ਨਹੀਂ। ਇਹ ਧਾਰਨਾ ਉਸ ਮਾਮਲੇ ਵਿੱਚ ਉੱਠ ਸਕਦੀ ਹੈ ਜਿੱਥੇ ਅਪੀਲ ਅਧਿਕਾਰੀ ਆਪਣੀ ਸ਼ਕਤੀ ਦਾ ਪ੍ਰਯੋਗ ਕਰਕੇ ਰੋਕ ਦੀ ਇਜਾਜ਼ਤ ਦਿੰਦਾ ਹੈ ਜਿੱਥੇ ਕੋਈ ਵਿਸ਼ੇਸ਼ ਪ੍ਰਬੰਧ ਨਹੀਂ ਹੈ ਨਿਆਂ ਦੇ ਫਰਜ਼ ਤੋਂਪਾਰਟੀਆਂ ਵਿਚਕਾਰ ਨਿਆਂ ਕਰਨਾ ਹੈ।

s. In an appropriate case, if the assessee feels that a
stay of recovery pending disposal of the reference is necessary or is in the interest of justice, then the assessee is entitled to apply before the Appellate Authority to grant a stay until disposal of reference by the High Court or until such time as the Appellate Authority thought fit. But. in case the Appellate Authority acted without jurisdiction or in excess jurisdiction or in improper exercise of the jurisdiction, then the decision of such Appellate Authority can be corrected by the High Court by issuing appropriate writs under Articles 226 and 227 of the Constitution. 6. Prior to 1918, there was no provision for reference to the High Court at all in respect of any decision by the revenue authorities. In Act VII of 1918, section 51 contained this provision under which the Chief Revenue Authority was empoWE~ed to refer a case to the High Court when any question aro~e regarding the interpretation of any of the provisions of the Act or of any rule made thereunder. 7 • Section 66 of the Act of 1922 provides that within certain time either at the instance of the assessee or at the • instance of the Revenue, the Tribuual. might refer a question of law for the opinion of the High court, It also empowered the assessee to make an application to the High Court in case' the Tribunal refused to refer the question after drawing up a statement of case. Once certain words in an Act of Parliament bad received a judicial construction in one of the superior courts, and the legislature repeated these without any alteration in a subsequent statute, the legislature must be taken to have used them according to the meaning which a court of competent jurisdiction had given to them. This rule of interpretation affords only a valuable presumption as to the meaning of the language employed in a statute. The main question involved in these appeals, is the question of jurisdiction of the High Court, to grant stay or pass interim orders in pending references under ""c.tion 66 of the Indian Income-Tax Act, 1922 (hereinafter called the Act of 1922) and section 256 of the Income Tax Act, 1961 (hereinafter called the 'Act of 1961'). These appeals are by special leave from the judgments of the High Courts. The main judgment is the judgment of the Delhi High Court in the case of L. Bansi Dhar and Sons v. CommissioDer of Income-Tax, New Delhi (C.A. No. 1668/78). The question arose in applications filed by the assessee under section 151 of CPC in two Income-tax References Nos. 8l and 83 of 1973 relating to the assessment years 196cr61 and 1962-63 respectively praying that the High Court might be pleased to grant an order of inJuction for restraining the Commissioner of Income-tax ll), Central Revenue Building, and/or his subordinate officers including the Income-tax Officer, Company Circle (III), from enforcing and/or realising the demand raised in the aforesaid assessment years 196cr61 and 1962-63, and from taking any steps for the recovery thereof till the disposal of the references pending in the High Court.
The asses see is a Hindu undivided family. The Karta of the HUF is Lala Bansi Dhar. His father, Lala Murlidhar, died in the year 1949 in an air crash. On the.death of the father, a sum of Rs.2,49,874 was received by Lala Bansi Dhar from the insurance company on account of an aceident insurance policy covering the risk of the life of the deceased. The. income derived from the said amount was treated as the income of'· Lala Bansi Dhar and was assessed in his personal assessment •. February, 1956. The illCOllle from the ioaurance amount continued to be assessed in the personal assessment of Lala Banai Dhar even after formation of the llllF on his marri"8e and the birth of a son, and continued to be so assessed till the assessment year 1959-60.

In the assessment year 1960-61 for the first time, the Income-tax Officer treated the income from the ioaurance amount as that on the llllF and assessed the income in the bands of the HUF. On appeal by the assessee, HUF, the Appellate Assistant Comnissioner set aside the assessment holding that the income was the personal income of Lala Baoai Dhar and not of the llllF. Against that order, the revenue preferred an appeal to the Income-tax Appellate Tribuoal. A similar appeal was also pref erred to the Tribunal by the revenue for the assessment year 1962-63. Both the appeals were disposed of by the Tribunal by a cOlllllOD order on 23rd November, 1970 whereby it was held that the income in question was that of the HUF and the liable to be assessed as such.
