ASN IN THE HIGH COURT OF JUDICATURE AT BOMBAY ORDINARY ORIGINAL CIVIL JURISDICTION INCOME TAX APPEAL NO. 1560 OF 2011 The Commissioner of Income Tax-II, Pune...Appellant. v. Smt. Padma S. Bora...Respondent. Mr. Vimal Gupta, Senior Advocate with Ms. Padma Divakar for the Appellant. Mr .S.N.Inamdar, Senior Advocate with Mr. Mihir Naniwadekar for the Respondent. CORAM : J.P. DEVADHAR AND M.S. SANKLECHA, JJ. DATE : 3rd December, 2012 PC: The present appeal filed by the revenue challenges the order dated 15/7/2010 of the Income Tax Appellate Tribunal(Tribunal) relating to assessment year 2005-06. The aforesaid order of the Tribunal dated 15/7/2010 has followed its own decision dated 9/2/2010 for the assessment year 2003-04 and 2004-05 in respect of the same respondent-assessee. 2)We have today by a separate order dismissed the revenue's Income Tax appeal No.29/2011 against the order dated 9/2/2010 of the Tribunal for the assessment year 2003-04 and 2004-05 as not giving rise to any substantial question of law. As the impugned order dated 15/7/2010 merely follows the order dated 9/2/2010, we dismiss this appeal also for the reasons given ASN in the order passed today in Income Tax appeal No.29/2011. 3) This appeal also raises no substantial question of law. Therefore this appeal is dismissed with no order as to costs. (M.S.SANKLECHA, J.) (J.P. DEVADHAR, J.)
