Learned counsel for both the parties state that the first question is covered against the Revenue by the decision of this Court in the case of Commissioner of Income Tax V/s. Associated Cables P. Limited reported in [2006] 286 ITR 596 (Bom). 3.Similarly, the second question is also covered against the Revenue by the decision of the Apex Court in the case of Commissioner of Income Tax V/s. Lakshmi Machine Works reported in [2007] 290 ITR 667 (SC). 4.In this view of the matter, the appeal is dismissed with no order as to costs.
