.on 21st August,2008, when the above matter wason board, on the application of the learned Counselfor the Appellant Mr.Sahadevan, we had adjourned thematter to 5th September,2008 to enable the Appellantto serve the Respondent. Again on 5th September,2008the matter was adjourned for today to serve theRespondent. However, today Mr.Sahadevan very candidlystates, that the Appellant has not given any papers tohim and the Respondent has not been served at all. Inview of the aforesaid callous attitude of theAppellant, we are constrained to dismiss the aboveAppeal. Hence, the Appeal stands dismissed.
