1. Heard the learned Counsel for the parties. By
this Notice of Motion, the Appellant is seeking
condonation of 1310 days’ delay caused in filing the
Appeal. The learned Counsel for the Respondent-assessee
has no objection for condonation of delay. We have also
perused the affidavit-in-support of the Notice of
Motion. For the reasons stated therein and in view of
no objection of the learned Counsel for the
Respondent-assessee for condonation of delay, the Notice
of Motion is made absolute in terms of prayer clause
(a).
