1.There is a delay of 369 days in filing the appeal. The delay has been explained in paras 3 and 4 of the affidavit in support. Sufficient cause has been shown. However, in our view the delay should be condoned subject to the payment of costs, quantified at Rs.3,000/- which shall be a condition precedent. Costs shall be paid within a period of three weeks from today. The Notice of Motion is made absolute in terms of prayer clause (a). Upon payment of costs, time for removal of office objections shall stand extended for a period of four weeks thereafter.
