1.This Notice of Motion is taken out by the revenue for seeking condonation of delay of 457 days in filing the Notice of Motion.
2.Perusal of the affidavit filed in support of Notice of Motion does not show sufficient cause for condonation of delay. However, in the interest of justice, we condone the delay subject to payment of Costs of Rs. 5000/- to be paid by the appellant to the respondent within a period of 2 weeks from today.
Motion is made absolute in terms of prayer clause (a).
