Appellant Vs. Dwarkabai Trust, Mumbai .. Respondent Mr.R.A.Vaishampayan for the Appellant. None for the Respondent. CORAM :- DR.S.RADHAKRISHNAN & S.J.KATHAWALLA, JJ. CORAM :- DR.S.RADHAKRISHNAN & S.J.KATHAWALLA, JJ. DATE : 20th August, 2008 P.C. P.C. 1. On 17.7.2008 these Appeals were adjourned to 24.7.2008 to enable the learned Advocate for the Appellants to file vakalatnama and to serve the Respondents. Again on 24.7.2008 two weeks time was granted and the Appeals came to be adjourned to 7.8.2008. 2. Even on 7.8.2008, as a last chance both the Appeals were adjourned to 14.8.2008 as the vakalatnama was not filed on behalf of the Appellants and the Respondents were not served. However, on that day, it was made clear that in the event of the failure on the part of the Appellants to file the vakalatnama and to serve the Respondents, the Court would be constrained to dismiss the Appeals. Inspite of the same, the vakalatnama has not been filed on behalf of the Appellants till date, and no steps whatsoever have been taken to serve the Respondents. Hence, both the Appeals stand dismissed. (S.J.KATHAWALLA, J.) (DR.S.RADHAKRISHNAN,J.) (S.J.KATHAWALLA, J.) (DR.S.RADHAKRISHNAN,J.)
