1.The revenue has filed the present appeal against the order dated 18[th]March, 2016 passed by the Income Tax Appellate Tribunal “A” BenchKolkata in I.T.A. No. 841/Kol/2013 and C. O. No.54/Kol/2013 for theassessment year 2009-10.2.Learned counsel for the appellant has produced a letter which hasbeen conveyed by the office of Principal Commissioner of Income Tax-2,Kolkata dated 15[th] May, 2019 specifying therein the C.B.D.T’s circular
no.03/2018 dated 11.07.2018 which, according to the learned counsel for theappellant, is applicable to this case and in view of that circular, he may bepermitted to withdraw the present appeal.
3.The present appeal is disposed of, however, keeping open thequestion of law raised therein.
