Whether the judgment should be reported in the Digest? --- .Surya Kant, J(Oral) The petitioner has filed a statutory appeal againstthe assessment order for the year 2012-13. The said appeal ispending before the Appellate Authority, namely, theCommissioner of Income Tax (Appeals), Chandigarh. Thepetitioner also applied for stay but no order has been passedon its stay application. Meanwhile, the Assessing Authority hasissued final demand notice. Since the petitioner has sought interim stay, it isimperative upon the Appellate Authority to decide suchapplication in accordance with law. We thus dispose of thiswrit petition with a direction to the Appellate Authority todecide the stay application moved/to be moved by thepetitioner, uninfluenced of the rejection of the stay of demand by the Deputy Commissioner of Income Tax, Circle-I(Exemption), Chandigarh.
