1.Learned counsel for the petitioner after arguing at lengthrealising that there is a remedy of statutory appeal, is notpressing the petition with liberty to file an appeal within fourweeks from today along-with the stay application.
2.In the eventuality of an appeal being filed along-with thestay application within four weeks from today, the same shall beconsidered on merits.
3.Considering that an interim protection is operating in favourof the petitioner since filing of the petition, the same shall becontinued till the Appellate Authority takes up the stay application.
4.Further taking into account that the petition is pending since2008, the Appellate Authority shall make a sincere endeavor todecide the appeal within six months from the date of filing.5.The writ petition is disposed of as not pressed with liberty asprayed for.
