GROVER, JJ.] Indian Income-tax Act (11 of 1922), ss. 34 and 16(3)-Assessee's return of income as individual not showing that other members of his' firm were his minor sons-Income of minors separately assessed-S. 34(1) and s. 34(l)(b), applicability of income of a minor son whether can be added under s. 16(3 )-Income of assessee after having been separately assessed. c The assessee and his minor sons separately held shares in a resident c firm. For assessment years 1952-53 to 1954-55, the assessee filed returns as an individual and therein stated under the head business income that the profit should be ascertained from the Income-tax Officer assessing the firm. The names of the partners were stated, but it was not stated in the return that some of the parties were his minor sons. The minors, through their mother as guardian, also filed returns for these assessment years, and they were atisessed to tax. The assessee was also assessed as an indi-D vidual, in respect of his share in the income of the firm and other sources, but the assessment order did not include the share of the minors from the firm. The Income-tax Officer issued notices Of reassessment to the assessee under s. 34(1)(a) of the Indian Income-tax Act, 1922 for the years 1952-53 and 1953-54 and under s. 34(1)(b) for the year 1954-55. The Income-tax Officer took the view that the .assessee had not disclosed the fact that his sons were minors and the income of the sons which mould have been included under s. 16(3)(a)(ii) had escaped assessment E n the assessee's hands and accordingly he brought that income to tax. The Appellate Assistant Commissioner confirmed this order. The Appellate Tribunal, in appeal held that for the first two years s. 34(l)(a) applied, that in respect of the third year there was no change of opinion but the assessment was made on information received within the meaning Of s. 34(1 )(b) and that the income of the minors could be assessed in the hands of the assessee notwithstanding the separate assessments already made on the minors. On reference, the High Court answered the ques· F tions against the assessee. In appeal, this Court, HELD·: Section 16(3) of the Act imposed an obligation upon the Income-tax Offit,er to compute the total income of any individual for the purpose of assessment by including the items of income set out in els. (a)(i) to (iv) and (b), but thereby no obligation was imposed upon the tax-payer to disclose the income liable to be included in his assessment under s: 16( 3). For failing or omitting to disclose that income pro-G ceedings for reassessment could not be commenced under " 34(1)(a). Section 22( 5) required the assessee to furnish particulars of the names of the shares of the partners but imposed no obligation to mention or set out the income of the nature mentioned in s. 16( 3). In . the relevant years there was no head in the form of return prescribed under the rules under which income liable to be assessed to tax under s. 16(3)(a) & (b) could be disclosed. These assessments under s. 34(1)(a) for the years 1952-53 .and 1953-54 could not, therefore be upheld. [721 A] H (ii) 'The income of a minor can be included in the hands of an assessee under s. 16(3) of the Act, notwithstanding that an assessment has been made on the minor represented by his guardian. MUTHIAH CHETTIAR versus COMMISSIONER OF INCOME-TAX, MADRAS [[1969] 3 S.C.R. 715] (1969) ਵੀ. ਡੀ. ਐਮ. ਆਰ. ਐਮ. ਆਰ. ਐਮ. ਆਰ. ਮੁਥੀਆ ਚੇਟੀਆਰ ਬਨਾਮ ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਮਦਰਾਸ ਫਰਵਰੀ 14, 1969 [ਜੇ. ਸੀ. ਸ਼ਾਹ, ਵੀ. ਰਾਮਾਸਵਾਮੀ ਅਤੇ ਏ. ਐਨ. ਗਰੋਵਰ, ਜੇ.ਜੇ.] ਭਾਰਤੀ ਆਮਦਨ ਕਰ ਐਕਟ (11 ਦਾ 1922), ਧਾਰਾ 34 ਅਤੇ 16(3)—ਕਰਦਾਤਾ ਦੀ ਵਾਪਸੀ ਵਿੱਚ ਨਾਬਾਲਗ ਦੀ ਵਿਅਕਤੀਗਤ ਆਮਦਨ ਦਿਖਾਈ ਗਈ—ਜੇਕਰ ਨਾਬਾਲਗ ਜਿਸ ਫਰਮ ਵਿੱਚ ਗੁਪਤ ਭਾਗੀਦਾਰ ਹੈ ਉਸ ਨੂੰ ਆਕਲਨ ਕੀਤਾ ਗਿਆ ਹੈ—34(1)(ਅ) ਅਤੇ 34(1)(ਬੀ), ਨਾਬਾਲਗ ਲੜਕੇ ਦੀ ਆਮਦਨ ਦੀ ਵਿਅਕਤੀਗਤ ਆਕਲਨ ਅਧੀਨ 16(3)—ਨਾਬਾਲਗ ਦੀ ਆਮਦਨ ਜੋ ਵੱਖਰੀ ਨਹੀਂ ਹੈ ਜੋੜੀ ਜਾ ਸਕਦੀ ਹੈ। ਵਿਅਕਤੀ ਅਤੇ ਉਸ ਦੇ ਨਾਬਾਲਗ ਨੇ ਵੱਖ ਵੱਖ ਹਿੱਸੇ ਵਿੱਚ ਇੱਕ ਰਹਿਣ ਵਾਲੀ ਫਰਮ ਵਿੱਚ ਹਿੱਸੇਦਾਰੀ ਕੀਤੀ। ਆਕਲਨ ਸਾਲ 1952-53 ਤੋਂ 1954-55 ਲਈ, ਕਰਦਾਤਾ ਨੇ ਵਿਅਕਤੀਗਤ ਤੌਰ 'ਤੇ ਵਾਪਸੀਆਂ ਦਾਖਲ ਕੀਤੀਆਂ ਅਤੇ ਫਿਰ ਉਸ ਫਰਮ ਸਮੇਤ ਬੈਂਕ ਅਫਸਰਾਂ ਦੇ ਸਿਰ ਹੇਠ ਵੱਖ ਕੀਤਾ। ਭਾਗੀਦਾਰਾਂ ਦੇ ਨਾਮ ਦੱਸੇ ਗਏ ਸਨ, ਪਰ ਇਹ ਨਹੀਂ ਦੱਸਿਆ ਗਿਆ ਕਿ ਕੁਝ ਪਾਰਟੀਆਂ ਉਸ ਦੇ ਨਾਬਾਲਗ ਪੁੱਤਰ ਸਨ। ਨਾਬਾਲਗਾਂ ਨੇ, ਆਪਣੀ ਮਾਂ ਦੇ ਜ਼ਰੀਏ ਗਾਰਡੀਅਨ ਵਜੋਂ, ਉਹਨਾਂ ਆਕਲਨ ਸਾਲਾਂ ਲਈ ਵਾਪਸੀਆਂ ਵੀ ਦਾਖਲ ਕੀਤੀਆਂ, ਅਤੇ ਉਹਨਾਂ ਨੂੰ ਕਰ ਲਈ ਆਕਲਨ ਕੀਤਾ ਗਿਆ। ਕਰਦਾਤਾ ਨੂੰ ਵੀ ਵਿਅਕਤੀਗਤ ਤੌਰ 'ਤੇ, ਫਰਮ ਦੀ ਆਮਦਨ ਵਿੱਚ ਉਸ ਦੇ ਹਿੱਸੇ ਅਤੇ ਹੋਰ ਸਰੋਤਾਂ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਆਕਲਨ ਕੀਤਾ ਗਿਆ ਸੀ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਫਰਮ ਤੋਂ ਨਾਬਾਲਗਾਂ ਦੇ ਕੁਝ ਹਿੱਸੇ ਨੂੰ ਨੋਟ ਕੀਤਾ ਜਦੋਂ ਆਕਲਨ ਵਿੱਚ ਕਰਦਾਤਾ ਦੇ ਮਾਮਲੇ ਸ਼ਾਮਲ ਨਹੀਂ ਕੀਤੇ ਗਏ, ਤਾਂ ਕਿ ਵਿਅਕਤੀ ਕਰਦਾਤਾ ਦੇ ਕਰ ਦੇ ਹਿੱਸੇ ਨੂੰ ਸਾਲ 1952-53 ਅਤੇ 1953-54 ਲਈ ਧਾਰਾ 34(1)(ਬੀ) ਅਧੀਨ ਗਣਨਾ ਕਰਨ ਲਈ, ਜਿਸ ਲਈ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਇਹ ਵਿਚਾਰ ਕੀਤਾ ਕਿ ਭਾਰਤ ਆਮਦਨ ਐਕਟ ਦੀ ਧਾਰਾ 34(1)(ਅ) ਅਧੀਨ ਗੈਰ-ਘੋਸ਼ਿਤ ਕਰਦਾਤਾ ਦੀ ਆਮਦਨ ਕਰ, ਸਾਲ 1954-55 ਲਈ। ਅਪੀਲੀ ਬੈਂਚ ਨੇ ਗਲਤ ਤੌਰ 'ਤੇ ਇਸ ਨਤੀਜੇ ਉੱਤੇ ਪਹੁੰਚਣਾ ਸੀ ਕਿ ਆਮਦਨ ਕਰ ਦੀ ਸ਼ਿਕਾਇਤ ਨੂੰ ਧਾਰਾ 16(3)(ਬੀ)(ਦੂਜੀ) ਅਧੀਨ ਸ਼ਾਮਲ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਸੀ ਜੋ ਕਿ ਕਰਦਾਤਾ ਦੇ ਹੱਥਾਂ ਵਿੱਚ ਬਚ ਗਿਆ ਸੀ, ਇਸ ਤਰ੍ਹਾਂ ਉਹਨਾਂ ਨੇ ਆਦੇਸ਼ ਲਿਆਂਦਾ, ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ, ਅਸਾਮ ਅਤੇ ਮਣੀਪੁਰ ਸਰਕਲਾਂ ਨੂੰ ਇਸ ਮੁੱਦੇ ਨੂੰ ਯਾਦ ਕਰਨ ਲਈ। ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਦੋ ਸਾਲਾਂ ਲਈ ਧਾਰਾ 34(1)(ਅ) ਲਾਗੂ ਹੋਣ ਦੇ ਦਾਅਵੇ ਨੂੰ ਰੱਦ ਕੀਤਾ, ਕਿ ਇਹ ਅਪੀਲ ਸੀ ਕਿ ਪਹਿਲੇ ਦੋ ਸਾਲਾਂ ਦੀ ਬੈਠਕ ਦੇ ਨਾਬਾਲਗ ਆਮਦਨ ਦੇ ਆਕਲਨ ਨੂੰ ਮੁੜ ਕਰਦਾਤਾ ਦੇ ਹੱਥਾਂ ਵਿੱਚ ਲਿਆਂਦਾ ਜਾ ਸਕਦਾ ਸੀ। ਬਾਵਜੂਦ, ਨਾਬਾਲਗਾਂ ਖਿਲਾਫ ਪਹਿਲਾਂ ਹੀ ਕੀਤੇ ਗਏ ਵੱਖਰੇ ਆਕਲਨਾਂ ਦੇ ਬਾਵਜੂਦ ਇਸ ਹਾਈ ਕੋਰਟ ਨੇ ਕਰਦਾਤਾ ਦੇ ਸਵਾਲਾਂ ਨੂੰ ਅਪੀਲ ਵਿੱਚ ਜਵਾਬ ਦਿੱਤਾ, ਕੋਰਟ, ਸੀ ·: ਐਕਟ ਦੀ ਧਾਰਾ 16(3) ਨੇ ਆਮਦਨ-ਟੈਕਸ ਦਫ਼ਤਰ``ਤੇ ਇੱਕ ਜ਼ਿੰਮੇਵਾਰੀ ਲਗਾਈ ਕਿ ਉਹ ਮੁਲਾਂਕਣ ਦੇ ਉਦੇਸ਼ ਲਈ ਕਿਸੇ ਵੀ ਵਿਅਕਤੀ ਦੀ ਕੁੱਲ ਆਮਦਨ ਦੀ ਗਣਨਾ ਕਰੇ (a)(i) ਤੋਂ (iv) ਅਤੇ (b) ਵਿੱਚ ਨਿਰਧਾਰਤ ਆਮਦਨ ਦੀਆਂ ਵਸਤੂਆਂ ਨੂੰ ਸ਼ਾਮਲ ਕਰਕੇ, ਪਰ ਇਸ ਤਰ੍ਹਾਂ ਟੈਕਸ-ਦਾਤਾ``ਤੇ ਧਾਰਾ 16(3) ਦੇ ਅਧੀਨ ਆਪਣੇ ਮੁਲਾਂਕਣ ਵਿੱਚ ਸ਼ਾਮਲ ਕਰਨ ਯੋਗ ਆਮਦਨ ਦਾ ਖੁਲਾਸਾ ਕਰਨ ਦੀ ਕੋਈ ਜ਼ਿੰਮੇਵਾਰੀ ਨਹੀਂ ਲਗਾਈ ਗਈ। "34(1)(a)" ਦੇ ਤਹਿਤ ਆਮਦਨੀ ਦੀ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ, ਇਸ ਗੱਲ ਦਾ ਖੁਲਾਸਾ ਕਰਨ ਵਿੱਚ ਅਸਫਲ ਰਹਿਣ ਜਾਂ ਭੁੱਲ ਜਾਣ ਲਈ। ਧਾਰਾ 22(5) ਨੇ ਅਸੈਸਰੀ ਨੂੰ ਭਾਈਵਾਲਾਂ ਦੇ ਸ਼ੇਅਰਾਂ ਦੇ ਨਾਵਾਂ ਦੇ ਵੇਰਵੇ ਦੇਣ ਦੀ ਲੋੜ ਸੀ ਪਰ ਧਾਰਾ 16(3) ਵਿੱਚ ਦਰਸਾਈ ਗਈ ਪ੍ਰਕਿਰਤੀ ਦੀ ਆਮਦਨ ਦਾ ਜ਼ਿਕਰ ਕਰਨ ਜਾਂ ਨਿਰਧਾਰਤ ਕਰਨ ਦੀ ਕੋਈ ਜ਼ਿੰਮੇਵਾਰੀ ਨਹੀਂ ਲਗਾਈ। ਸੰਬੰਧਿਤ ਸਾਲਾਂ ਵਿੱਚ ਨਿਯਮਾਂ ਦੇ ਤਹਿਤ ਨਿਰਧਾਰਤ ਰਿਟਰਨ ਦੇ ਰੂਪ ਵਿੱਚ ਕੋਈ ਸਿਰਲੇਖ ਨਹੀਂ ਸੀ ਜਿਸ ਦੇ ਤਹਿਤ ਧਾਰਾ 16(3)(a) ਅਤੇ (b) ਦੇ ਤਹਿਤ ਟੈਕਸ ਲਗਾਉਣ ਯੋਗ ਆਮਦਨ ਦਾ ਮੁਲਾਂਕਣ ਕੀਤਾ ਜਾ ਸਕਦਾ ਸੀ ਦਾ ਖੁਲਾਸਾ ਕੀਤਾ ਜਾ ਸਕਦਾ ਸੀ। 1952-53 ਅਤੇ 1953-54 ਦੇ ਸਾਲਾਂ ਲਈ ਧਾਰਾ 34(1)(a) ਦੇ ਤਹਿਤ ਇਹਨਾਂ ਮੁਲਾਂਕਣਾਂ ਨੂੰ ਬਰਕਰਾਰ ਨਹੀਂ ਰੱਖਿਆ ਜਾ ਸਕਦਾ ਸੀ, ਇਸ ਲਈ। (ii) 'ਇੱਕ ਨਾਬਾਲਗ ਦੀ ਆਮਦਨ ਐਕਟ ਦੀ ਧਾਰਾ 16(3) ਦੇ ਤਹਿਤ ਇੱਕ ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਹੱਥਾਂ ਵਿੱਚ ਸ਼ਾਮਲ ਕੀਤੀ ਜਾ ਸਕਦੀ ਹੈ, ਭਾਵੇਂ ਕਿ ਉਸਦੇ ਸਰਪ੍ਰਸਤ ਦੁਆਰਾ ਦਰਸਾਏ ਗਏ ਨਾਬਾਲਗ 'ਤੇ ਇੱਕ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਹੋਵੇ। ਸੀ. ਆਰ. ਨਾਗੱਪਾ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ-ਟੈਕਸ, ਮੈਸੂਰ, [1969] 1 ਐਸ.ਸੀ.ਆਰ. 979, ਦਾ ਪਾਲਣ ਕੀਤਾ ਗਿਆ। (ii) ਮੁਲਾਂਕਣ ਸਾਲਾਂ 1954-55 ਲਈ, ਇਸ ਦਲੀਲ ਦਾ ਕੋਈ ਆਧਾਰ ਨਹੀਂ ਸੀ ਕਿ ਇਨਕਮ-ਟੈਕਸ ਅਫਸਰ ਨੇ ਸਿਰਫ ਆਪਣੀ ਰਾਏ ਬਦਲੀ ਹੈ। ਮੁੜ-ਮੁਲਾਂਕਣ ਦਾ ਹੁਕਮ ਪਿਛਲੇ ਮੁਲਾਂਕਣ ਸਾਲ ਦੇ ਆਖਰੀ ਦਿਨ ਤੋਂ ਚਾਰ ਸਾਲਾਂ ਦੇ ਅੰਦਰ ਬਣਾਇਆ ਗਿਆ ਸੀ। ਇਸ ਲਈ, ਨੋਟਿਸ ਨੂੰ ਇਨਕਮ-ਟੈਕਸ ਅਫਸਰ ਦੁਆਰਾ ਬਿਲਕੁਲ ਸਹੀ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਸੀ। ਸਿਵਲ ਅਪੀਲ ਅਧਿਕਾਰ ਖੇਤਰ: 1958 ਦੇ ਸਿਵਲ ਅਪੀਲ ਨੰਬਰ 1457 ਤੋਂ 1459 ਤੱਕ। 21 ਅਗਸਤ, 1964 ਨੂੰ ਮਦਰਾਸ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਟੀ.ਸੀ. ਨੰਬਰ 75 ਆਫ 1962 (ਰੈਫਰੈਂਸ ਨੰਬਰ 50 ਆਫ 1962) ਦੇ ਫੈਸਲੇ ਅਤੇ ਹੁਕਮ ਤੋਂ ਅਪੀਲਾਂ। ਐਮ. ਸੀ. ਛਾਗਲਾ ਅਤੇ ਟੀ. ਏ. ਰਾਮਚੰਦਰਨ, ਅਪੀਲਕਰਤਾ ਲਈ (ਸਾਰੀਆਂ ਅਪੀਲਾਂ ਵਿੱਚ)। ਐਸ. ਕੇ. ਅਯਿਆਰ ਅਤੇ ਬੀ. ਡੀ. ਸ਼ਰਮਾ, ਜਵਾਬਦੇਹ ਲਈ (ਸਾਰੀਆਂ ਅਪੀਲਾਂ ਵਿੱਚ)। ਕੋਰਟ ਦਾ ਫੈਸਲਾ ਦਿੱਤਾ ਗਿਆ ਸੀ Case: V. The Judgment of the Court was delivered by Shah, J. Ramanathan Chettiar his son Muthiah Chettiar ~ailed hereinafter for the sake ·of brevity, Muthiah-and Rama-nathan, Annamalai and Alagappan, sons of Muthiah, constituted a Hindu undivided family. The family owned a 3 /5th share ijll M.R.M.S. Firm, Seramban in Malaya. The firm was assessed under the Indian Income-tax Act, 1922, in the status of a firm resident within the taxable territories. On September 16, 1950, Muthiah separated from the family taking his I/5th share in the M.R.M.S. Firm. On April 13, 195_1 the status of the family became completely disrupted and the three sons of Muthiah took in equal shares the remaining 2/5th share--the grandfather Rarna-nathan taking no share in the M.RM.S: Firm. D E For the ·assessment year 1952-53 Muthiah submitted a return of his income as an individual and stated under the head business income "Ki~dly ascertain his ( assessee's) share· of profit and remittances from the Income-tax officer, Second Additional Circle -I, Karaikudi, in F. 6098-m/1952-53". In Part III of the return M uthiah supplied the following informatio~ about his partners : F H. A For the assessment year 1953-54 in column 3 in section B of the retunn Muthiah stated: "Kindly ascertain the remittances from the Income-tax Officer, Fifth Additional, Karaikudi in F. 6098-m", and at p. 3 of the retum in column 3 ol. Section F it was stated : "Assessee has 60/303 share in Messrs. :MRMS Joint Se ram ban, (Malaya). Kindly ascertain share of profit ll or loss from the Income-tax Officer, Fifth Additional. Karaikudi in F. 6098." In Part ill of the retum he set out the names of the partners as were mentioned in the return for 1952-53. Against the names of Ramanathan Chettiar, A!agappan Chettiar and Annamalai c Chettiar it was not disclOsed that they were minors. For the assessment year 1954-55 at the foot of page 1 of the return Muthiah stated : ''The assessee has a remittance of Rs. 6,188-12-0 from R.R.M.S. Firm,· Seramban. His share of income D may be taken from the firm's file.", and in Part IIl the names of seven partners as mentioned in 1952 53 return were set-out-Ramanathan, A!agapp'an, Annamalai wer not shewn as minors. Ramanathan, A!agappan and Aannamalai-the three minor E sons of Muthiah represented by their mother allid guardian alw filed returns of their respective income for the years 1952-53, 1953-54 and 1954-55 and disclosed therein their shares in the profit from the 2/5th share in the M.RM.S. MUTHIAH CHETTIAR versus COMMISSIONER OF INCOME-TAX, MADRAS [[1969] 3 S.C.R. 715] (1969) ਸਿਵਲ ਅਪੀਲ ਅਧਿਕਾਰ ਖੇਤਰ: 1958 ਦੇ ਸਿਵਲ ਅਪੀਲ ਨੰਬਰ 1457 ਤੋਂ 1459 ਤੱਕ। 21 ਅਗਸਤ, 1964 ਨੂੰ ਮਦਰਾਸ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਟੀ.ਸੀ. ਨੰਬਰ 75 ਆਫ 1962 (ਰੈਫਰੈਂਸ ਨੰਬਰ 50 ਆਫ 1962) ਦੇ ਫੈਸਲੇ ਅਤੇ ਹੁਕਮ ਤੋਂ ਅਪੀਲਾਂ। ਐਮ. ਸੀ. ਛਾਗਲਾ ਅਤੇ ਟੀ. ਏ. ਰਾਮਚੰਦਰਨ, ਅਪੀਲਕਰਤਾ ਲਈ (ਸਾਰੀਆਂ ਅਪੀਲਾਂ ਵਿੱਚ)। ਐਸ. ਕੇ. ਅਯਿਆਰ ਅਤੇ ਬੀ. ਡੀ. ਸ਼ਰਮਾ, ਜਵਾਬਦੇਹ ਲਈ (ਸਾਰੀਆਂ ਅਪੀਲਾਂ ਵਿੱਚ)। ਕੋਰਟ ਦਾ ਫੈਸਲਾ ਦਿੱਤਾ ਗਿਆ ਸੀ ਸ਼ਾਹ, ਜੇ. ਰਾਮਨਾਥਨ ਚੇਟੀਆਰ ਉਸ ਦਾ ਪੁੱਤਰ ਮੁਥੀਆ ਚੇਟੀਆਰ ਨੂੰ ਇੱਥੇ ਸੰਖੇਪ ਵਿੱਚ ਮੁਥੀਆ—ਅਤੇ ਰਾਮਾ—ਆਨੰਦ ਅੰਨਾਮਲਾਈ ਅਤੇ ਅਲਗੱਪਨ, ਮੁਦੀਆ ਦੇ ਪੁੱਤਰ—ਨੇ ਇੱਕ ਹਿੰਦੂ ਅਵਿਭਾਜਿਤ ਪਰਿਵਾਰ ਬਣਾਇਆ ਸੀ। ਪਰਿਵਾਰ ਨੇ ਮਲੇਸ਼ੀਆ ਵਿੱਚ ਸੇਰੰਬਨ ਵਿੱਚ ਐਮ.ਆਰ.ਐਮ.ਐਸ. ਫਰਮ ਵਿੱਚ 3/5ਵਾਂ ਹਿੱਸਾ ਰੱਖਿਆ ਸੀ। ਫਰਮ ਨੂੰ ਸਤੰਬਰ 1950 ਵਿੱਚ ਭਾਰਤੀ ਇਨਕਮ-ਟੈਕਸ ਐਕਟ, 1922 ਅਧੀਨ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਸੀ, ਮੁਥੀਆ ਨੇ ਟੈਕਸਯੋਗ ਖੇਤਰ ਵਿੱਚ ਹਿੱਸਾ ਲਿਆ। ਫਰਮ ਦੀ ਸਥਿਤੀ ਐਮ.ਆਰ.ਐਮ.ਐਸ. ਨੇ ਪਰਿਵਾਰ ਤੋਂ ਵੱਖ ਹੋ ਕੇ ਆਪਣਾ 1/5ਵਾਂ ਹਿੱਸਾ ਮੁਥੀਆ ਫਰਮ ਵਿੱਚ ਲਿਆ। 13 ਅਪ੍ਰੈਲ, 1951 ਨੂੰ ਪਰਿਵਾਰ ਦੀ ਸਥਿਤੀ ਪੂਰੀ ਤਰ੍ਹਾਂ ਵਿਘਟਿਤ ਹੋ ਗਈ ਅਤੇ ਮੁਥੀਆ ਦੇ ਤਿੰਨ ਪੁੱਤਰਾਂ ਨੇ ਬਾਕੀ 2/5ਵਾਂ ਹਿੱਸਾ ਬਰਾਬਰ ਹਿੱਸਿਆਂ ਵਿੱਚ ਲਿਆ—ਦਾਦਾ ਰਾਮਨਾਥਨ ਨੇ ਐਮ.ਆਰ.ਐਮ.ਐਸ. ਫਰਮ ਵਿੱਚ ਕੋਈ ਹਿੱਸਾ ਨਹੀਂ ਲਿਆ। ਐ ਨੇ ਮੁਲਾਂਕਣ ਸਾਲ 1953-54 ਲਈ ਸੈਕਸ਼ਨ ਬੀ ਦੇ ਕਾਲਮ 3 ਵਿੱਚ ਮੁਥਿਆਹ ਨੇ ਕਿਹਾ: “ਕਿੰਗਸਲੀ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਪੰਜਵੀਂ ਵਾਧਿਕ, ਕਰਾਈਕੁਡੀ ਵਿੱਚ ਐਫ.ਜੀ. 6098 ਤੋਂ ਰਿਮਿਟੈਂਸਾਂ ਨੂੰ ਪੁਖਤਾ ਕਰੋ।” ਰਿਟਰਨ ਦੇ ਐ.3 ਵਿੱਚ ਸੈਕਸ਼ਨ ਐਫ ਦੇ ਕਾਲਮ 3 ਵਿੱਚ ਇਹ ਕਿਹਾ ਗਿਆ ਸੀ: “ਗੈਰਹਾਜ਼ਰੀ (ਦਾ) 60/303 ਹਿੱਸਾ ਮੈਸਰਜ਼ ਐਮ.ਆਰ.ਐਮ.ਐਸ. ਜੌਇੰਟ ਸਰੂਰਨਾਮਾ ਮਲੇ, ਕੋਂਡੀਆਕਲੀ ਪਤਾ ਕਰੋ, ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਪੰਜਵੀਂ ਵਾਧਿਕ ਅੰਕਮਨਾਲੇਸ ਕਰਾਈਕੁਡੀ ਵਿੱਚ ਐਫ. ਜੀ. 6098 ਤੋਂ ਮੁਨਾਫ਼ਾ ਜਾਂ ਘਾਟਾ ਦਾ ਹਿੱਸਾ।” ਰਿਟਰਨ ਦੇ ਭਾਗ II ਵਿੱਚ 1952-53 ਦੇ ਰਿਟਰਨ ਵਿੱਚ ਦੱਸੇ ਗਏ ਭਾਗੀਦਾਰਾਂ ਦੇ ਨਾਮ ਦੱਸੇ ਗਏ ਸਨ। ਰਾਮਨਾਥਨ ਚੇਟੀਆਰ, ਅਲਗੱਪਨ ਚੇਟੀਆਰ ਅਤੇ ਅੰਨਾਮਲਾਈ ਚੇਟੀਆਰ ਦੇ ਨਾਮਾਂ ਦੇ ਖਿਲਾਫ਼ ਇਹ ਨਹੀਂ ਦੱਸਿਆ ਗਿਆ ਸੀ ਕਿ ਉਹ ਨਾਬਾਲਗ ਸਨ। ਮੁਲਾਂਕਣ ਸਾਲ 1954-55 ਲਈ ਰਿਟਰਨ ਦੇ ਪੰਨਾ 1 ਦੇ ਪੈਰ ਵਿੱਚ ਮੁਥਿਆਹ ਨੇ ਕਿਹਾ: “ਆਰ.ਐਮ.ਐਸ.ਐਸ.ਈ. ਨੂੰ ਐ.ਈ. ਫਰਮ, ਸੇਰੇਮਬਨ ਤੋਂ ਰੁਪਏ 6,188-12-0 ਦੀ ਰਿਮਿਟੈਂਸ ਮਿਲੀ ਹੈ। ਫਰਮ ਦੀ ਵਿਕਰੀ ਤੋਂ ਰਾਮਾਥਨ ਦਾ ਆਮਦਨ ਦਾ ਹਿੱਸਾ।” ਅਤੇ ਭਾਗ III ਵਿੱਚ 1952-53 ਦੇ ਰਿਟਰਨ ਵਿੱਚ ਦੱਸੇ ਗਏ ਸੱਤ ਭਾਗੀਦਾਰਾਂ ਦੇ ਨਾਮ ਦੱਸੇ ਗਏ—ਰਾਮਨਾਥਨ, ਅਲਗੱਪਨ, ਅੰਨਾਮਲਾਈ ਨੂੰ ਨਾਬਾਲਗ ਵਜੋਂ ਨਹੀਂ ਦਿਖਾਇਆ ਗਿਆ। ਰਾਮਨਾਥਨ, ਅਲਗੱਪਨ ਅਤੇ ਅੰਨਾਮਲਾਈ—ਮੁਥਿਆਹ ਦੇ ਤਿੰਨ ਨਾਬਾਲਗ ਪੁੱਤਰ ਜਿਨ੍ਹਾਂ ਨੂੰ ਉਨ੍ਹਾਂ ਦੀ ਮਾਂ ਅਤੇ ਸਰਪ੍ਰਸਤ ਨੇ ਵੀ ਆਪਣੀ-ਆਪਣੀ ਆਮਦਨ ਲਈ ਰਿਟਰਨ ਭਰੇ ਸਨ, ਸਾਲਾਂ 1952-53, 1953-54 ਅਤੇ 1954-55 ਲਈ ਅਤੇ ਉਨ੍ਹਾਂ ਵਿੱਚ ਐਮ.ਆਰ.ਐਮ.ਐਸ. ਫਰਮ ਵਿੱਚ 2/5ਵੇਂ ਹਿੱਸੇ ਵਿੱਚ ਆਪਣੇ ਮੁਨਾਫ਼ੇ ਦੇ ਹਿੱਸੇ ਦਾਸੇ ਸਨ। ਮੁਲਾਂਕਣ ਸਾਲਾਂ 1952-53, 1953-54 ਅਤੇ 1954-55 ਲਈ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਮੁਥਿਆਹ ਦੁਆਰਾ ਫਰਮ ਅਤੇ ਤਿੰਨ ਨਾਬਾਲਗਾਂ ਦੇ ਹਿੱਸੇ ਅਤੇ ਸੰਯੁਕਤ ਕਾਨੂੰਨੀ ਮੁਥਿਆਹ ਦੇ ਆਮਦਨ ਦੇ ਹਿੱਸੇ ਅਤੇ ਹੋਰ ਸਰੋਤਾਂ ਤੋਂ ਆਮਦਨ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਮੁਲਾਂਕਣ ਕੀਤੇ। ਆਪਣੇ ਰਿਟਰਨ ਵਿੱਚ ਮੁਥਿਆਹ ਨੇ ਆਪਣੇ ਨਾਬਾਲਗ ਪੁੱਤਰਾਂ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਹਿੱਸੇ ਨੂੰ ਨਹੀਂ ਦੱਸਿਆ ਅਤੇ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਮੁਲਾਂਕਣ ਕਰਦੇ ਸਮੇਂ ਫਰਮ ਤੋਂ ਨਾਬਾਲਗਾਂ ਦੇ ਹਿੱਸੇ ਨੂੰ ਸ਼ਾਮਲ ਨਹੀਂ ਕੀਤਾ ਅਧੀਨ ਐਸ. 16(3) (ਏ) (ਦੁਤੀਯ) ਭਾਰਤੀ ਆਮਦਨ ਕਰ ਐਕਟ, 1922। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਮੁਥਿਆਹ ਅਤੇ 34(1) (3 ਏ) ਦੇ ਆਮਦਨ ਕਰ ਐਕਟ, 1922 ਲਈ ਸਾਲਾਂ 1952-53 5. 34(1) 5.54 ਅਤੇ 34(1) (3 ਲਈ ਸਾਲ 1954-55 ਲਈ ਇਲਾਜ ਦੇ ਕਾਰਨਾਂ ਨੂੰ ਦੱਸਿਆ। ਮੁਥਿਆਹ ਨੇ ਵਿਰੋਧ ਵਿੱਚ ਰਿਟਰਨ ਭਰੇ ਜਿਸ ਵਿੱਚ ਉਸੇ ਆਮਦਨ ਨੂੰ ਸੰਯੁਕਤ ਰੂਪ ਵਿੱਚ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਸੀ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੇ ਨਜ਼ਰੀਏ ਅਨੁਸਾਰ ਮੁਥਿਆਹ ਨੇ ਰਿਟਰਨ ਦੇ ਭਾਗ III ਕਲਾਜ਼ (ਸੀ) ਵਿੱਚ ਹੋਰ ਭਾਗੀਦਾਰਾਂ ਬਾਰੇ ਪੂਰੀਆਂ ਜਾਣਕਾਰੀਆਂ ਨਹੀਂ ਦਿੱਤੀਆਂ ਅਤੇ ਕਾਲਮ 2 ਵਿੱਚ ਉਸ ਨੇ ਸਿਰਫ ਇਹ ਦੱਸਿਆ ਸੀ ਕਿ ਰਾਮਨਾਥਨ, ਅਲਗੱਪਨ ਅਤੇ ਅੰਨਾਮਲਾਈ ਨਾਬਾਲਗ ਸਨ: ਕਿ “ਕਾਰਵਾਈ ਪੂਰੀ ਨਹੀਂ ਸੀ ਇਸ ਅਰਥ ਵਿੱਚ ਕਿ ਉਸ ਨੇ ਨਹੀਂ ਦੱਸਿਆ ਸੀ ਕਿ ਨਾਬਾਲਗ ਭਾਗੀਦਾਰ ਮੁਥਿਆਹ ਦੇ ਪੁੱਤਰ ਸਨ। ਇਸ ਅਨੁਸਾਰ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਮੁਥਿਆਹ ਦੇ ਪੁੱਤਰਾਂ ਦੀ ਆਮਦਨ ਜੋ ਕਿ ਐਸ. 16(3)(ਏ)(ਦੁਤੀਯ) ਦੇ ਅਧੀਨ ਮੁਲਾਂਕਣ ਵਿੱਚ ਸ਼ਾਮਲ ਹੋਣੀ ਚਾਹੀਦੀ ਸੀ, ਮੁਥਿਆਹ ਦੇ ਹੱਥਾਂ ਵਿੱਚ ਬਚ ਗਈ ਸੀ ਅਤੇ ਉਸ ਨੇ ਉਸ ਆਮਦਨ ਨੂੰ ਕਰ ਵਿੱਚ ਲਿਆਂਦਾ। ਅਪੀਲੇਟ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਇਨਕਮ-ਟੈਕਸ ਅਫਸਰ ਦੁਆਰਾ ਬਣਾਈ ਗਈ ਆਦੇਸ਼ ਨੂੰ ਪੁਸ਼ਟੀ ਕੀਤੀ। ਟ੍ਰਿਬਿਊਨਲ ਵਿੱਚ ਅਪੀਲ ਦੌਰਾਨ ਮੁਥਈਆ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਸ ਨੇ ਆਪਣੀ ਆਮਦਨ ਦੇ ਤਿੰਨ ਸਾਲਾਂ ਦੇ ਰਿਟਰਨਾਂ ਵਿੱਚ ਉਹ ਸਾਰੇ ਵੇਰਵੇ ਪੂਰੀ ਤਰ੍ਹਾਂ ਅਤੇ ਸੱਚੀ ਤਰ੍ਹਾਂ ਦੱਸੇ ਸਨ ਜੋ ਉਸ ਨੂੰ ਦੱਸਣ ਦੀ ਲੋੜ ਸੀ, ਅਤੇ ਸ. 34(1)(ਅ) ਦਾ ਲਾਗੂ ਨਹੀਂ ਹੋਣਾ ਚਾਹੀਦਾ ਸੀ ਅਸੈਸਮੈਂਟ ਸਾਲਾਂ 1952-53 ਅਤੇ 1953-54 ਲਈ ਅਤੇ 1954-55 ਲਈ ਮੁੜ ਖੋਲ੍ਹਣਾ ਸਿਰਫ ਗੈਰ-ਖੁਲਾਸੇ ਦੇ ਦੋਸ਼ ਉੱਤੇ ਆਧਾਰਿਤ ਸੀ ਅਤੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਸ. 40 ਆਮਦਨ ਟੈਕਸ ਐਕਟ ਵਿੱਚ ਜਿਸ ਨੂੰ ਮੁਥਈਆ ਨੇ ਵੀ ਨਿਸ਼ਾਨਾ ਬਣਾਇਆ ਸੀ ਉਸ ਨੇ ਮਾਈਨਰਾਂ ਦੀ ਵੱਖਰੀ ਅਸੈਸਮੈਂਟ ਕੀਤੀ ਜਿਨ੍ਹਾਂ ਨੂੰ ਉਨ੍ਹਾਂ ਦੀ ਮਾਂ ਦੁਆਰਾ ਪੇਸ਼ ਕੀਤਾ ਗਿਆ ਸੀ, ਨਾ ਹੀ ਸ. 16(3) ਅਧੀਨ ਕੋਈ ਅਸੈਸਮੈਂਟ ਕੀਤੀ ਜਾ ਸਕਦੀ ਸੀ, ਦੋ ਸੈਕਸ਼ਨ ਆਪਸ ਵਿੱਚ ਵਿਰੋਧੀ ਹਨ। Case: V. Ramanathan, A!agappan and Aannamalai-the three minor E sons of Muthiah represented by their mother allid guardian alw filed returns of their respective income for the years 1952-53, 1953-54 and 1954-55 and disclosed therein their shares in the profit from the 2/5th share in the M.RM.S. Firm. For the assessment years 1952-53, 1953-54 and 1954-55 the· Income-tax officer completed the assessments separately on the firm. The Income-tax Officer issued notices of reassessment to Muthiah under s. 34(1) (a) of the Income-tax Act, 1922 for the years 1952-53 and 1953-54 and under s. 34(1) (b) for the year 1954-55. Muthiah filed returns under protest declaring the same income as originally assessed. In the view of the Income-tax Officer Muthiah had not furnished in Part IIl clause ( c) ol. the return full facts regarding B the other narties and in column 2 he had merely disclosed that Ramanathan, Alagappain and Annamalai were minors : that "information was not full in the sense that he had not stated that LIOSup./69-11 they were minors sons" of Muthiah. Accordingly the Income-tax · A Officer held that the income of the sons of Muth1ah which should have been included .under s. 16(3)(a)(ii) of the linlcome-tax Act had escaped assessment in Muthiah's hands and he brought that income to tax. The Appellate Assistant Commissioner· confirmed the order made by the Income-tax Officer. In appeal to the TribunaJ it was contended by Muthiah that he had fully and truly disclosed all the particulars he was required to disclose in the returns of his income for the three years in question, and "s. 34(a)(a) had no application to the assessment years 1952-53 and 1953-54 and for 1954-55 the re-opening was based o.nly on a change of opinion". Muthiah also conteiOOed that s. 40 of the Income-tax Act was mandatory and since the Income-tax Officer had made separate assessments on the minors represented by their mother, no further assessment under s. 16 ( 3) could be made, the twr sections being mutually exclusive. B c The Tribunal obsc;rved that for the first two years s. 34 ( l) (a) applied, that in respect of the year 1954-55 there was no cha.ngc of opinion but the assessment was made on information received within the meaning of s. 34(1)(b) of the Income-tax Act and that sc;parate assessment of the minors did :not stop the Income-tax Officer from assessing the income received by the minor sons in the hands of Muthiah. The Appellate Tribunal accordingly confirmed the order of the Appellate Assistant Commissioner. D E At the instance of Muthiah the following questions were refer-red to the High Court of Madras : '(i) Whether on the facts and in the circumstances of the case, the re-assessment made on the asses-see under s. 34 of the Act is valid in Jaw for 1952-53 to 1954-55?
