1.This petition was admitted on 26th October, 2016. It challenges a noticedated 23rd March, 2016 under Section 148 of the Income Tax Act, 1961 (theAct) seeking to re-open assessment for the assessment year 2010-11. At thetime of admission, interim reliefs restraining respondent revenue fromproceeding further with the impugned re-opening notice was also granted.
2.Ms. Shirke, learned Counsel appearing for the Revenue states that theimpugned notice dated 23rd March, 2016 seeking to re-open assessment for2010-11 has been withdrawn by letter dated 20th November, 2016.
3.In view of the above, Mr. Vimal Gupta, learned Senior Counselappearing for the petitioners states that nothing survives in the petition andtherefore he seeks to withdraw the petition.
4.Petition is dismissed as withdrawn.
