THE HON'BLE SRI JUSTICE V.V.S.RAOANDTHE HON'BLE SRI JUSTICE RAMESH RANGANATHAN W.P.No.12345 of 2007 ORDER:(Per Hon’ble Sri Justice V.V.S.Rao) The Agricultural Market Committee, Adilabad (AMC), filedthe instant writ petition assailing the letter dated 28.5.2007 issuedby the 2[nd] respondent - Deputy Director, District Treasury Office,Adilabad. By the impugned letter, which was addressed pursuantto the letters of the Income Tax Officer, Ward No.1, Adilabad,requesting remittance of Rs.1,78,51,465/- towards income taxpayable by the AMC, the Manager, State Bank of Hyderabad,Adilabad was requested to stop payment of cheques of AMC untilfurther orders. When the matter is taken upon for hearing, the StandingCounsel for AMC Sri K.Upender Reddy submits that the noticeissued by the ITO has been withdrawn after the AMC paid someamount. He also submits that, pursuant to the orders of thelearned Income Tax Appellate Tribunal, the said amount has beenrefunded. The cause of action, therefore, does not survive asrightly pointed out by the Standing Counsel. The writ petition is accordingly dismissed as infructuous.
