Counsel for the Department on instructions submits that the Department has already passed Assessment Order, against which the petitioner has preferred an appeal and all questions raised in this petition can be adjudicated in those proceedings. In that case, we decline to keep this matter pending. For, there is no reason to doubt the correctness of the statement made by counsel for the Department. At the same time, we make it clear that if the petitioner states on affidavit that the statement so made was misleading or incorrect, the Court may consider to revive the petition for further hearing.
