The 2[nd] respondent filed I.T.A Nos.948 to 951/H/2002 before theHyderabad Bench ‘B’ of the Income Tax Appellate Tribunal, Hyderabad (forshort, ‘the Tribunal’) feeling aggrieved by the orders of assessment asconfirmed by the Commissioner of Income Tax (Appeals) – V, Hyderabad. Hehas also filed Stay Petition Nos.100 to 103/Hyd/2003. The Tribunal passedcommon order dated 30-05-2003 allowing those petitions. The said order ischallenged in this writ petition by the Income Tax Officer.
Heard Sri J.V. Prasad, learned counsel for the petitioner and Sri S.R.Ashok, learned Senior Counsel for the 2[nd] respondent.
Except that the writ petition was admitted on
20-11-2003, no interim order was passed by this Court. More than a decadehas elapsed. By any standard, the appeals may have been disposed of by thistime. Nothing remains to be decided at this stage.
The writ petition is accordingly dismissed as infructuous. Themiscellaneous petitions pending in this writ petition shall also stand disposedof. There shall be no order as to costs.
