Petitioner's main grievance in this Petition was that, hisapplication made to the Chief Commissioner of Income Tax for waiver ofinterest, was not disposed of. In the meantime, the department wasproceeding further with the process of disposing of Petitioner's immovableproperties.
2Appearing in response to advance notice, learned Counsel Mr.Mohanty for the Department, placed on record a copy of a letter dated29[th] January, 2019, under which, Petitioner has been communicated thedecision of the competent authority to reject his request for waiver ofinterest. Reasons for such decisions are already cited.
3Under the circumstances, this Petition has becomeinfructuous. We make it clear that, we have not gone into the correctnessof the said order dated 29[th] January, 2019.
4In the result, Petition disposed of.
