ORDER
Learned counsel for the petitioner, after arguing for a while, seeks leave
of this Court to withdraw this petition with liberty to file an appeal againstassessment order dated 17.3.2023.
He may do so.
Accordingly, the instant writ petition is dismissed as withdrawn with the
aforesaid liberty.
In case, the appeal is filed within a period of 15 days, the AppellateAuthority shall not insist upon the question of limitation and adjudge the appeal,on merits.
It is made clear that we have not expressed any opinion on merits of thecase.
