ORDER:(per Hon’ble Sri Justice Ramesh Ranganathan)
The proceedings, under challenge in this writ petition, are theorders dated 13.03.2014 provisionally attaching the properties of SriVaddineni Mahindra, S/o.Venkatappaiah Naidu and Sri VaddineniVenkatappaiah Naidu (the petitioners herein).
The schedule of properties, which were provisionally attached,are detailed in the proceedings dated 13.03.2014. On the ground thateven after an assessment order was passed, the appeal preferredthereagainst was disposed of, and a further appeal to the Income TaxAppellate Tribunal was also disposed of on 02.02.2015, theprovisional attachment has not been lifted, the petitioners haveinvoked the jurisdiction of this Court.
When the matter came up before us on 19.02.2016, SriB.Narasimha Sarma, learned Senior Standing Counsel for IncomeTax, sought time. Today the learned Senior Standing Counsel hasplaced copies of letters bearing F.No.AAOPV1122A/ DC17(2)/2015-16and F.No.AAVPV772K/DC17(2)/2015-16 dated 22.02.2016, whichshow that the provisional attachment, made earlier in respect of theproperties of both the petitioners, has been lifted with immediateeffect. Copies of the said letters have also been marked to the Sub-Registrars concerned.
Sri B.Narasimha Sarma, learned Senior Standing Counsel forIncome Tax, undertakes to furnish a photostat copy of both theproceedings to Sri V.Hari Haran, learned counsel for the petitioners,during the course of the day.
In view of the proceedings dated 22.02.2016, and as theprovisional attachment of the properties mentioned therein have beenlifted with immediate effect, the cause in the writ petition does not
survive necessitating adjudication by this Court.
The writ petition has become infructuous and is, accordingly,closed. The miscellaneous petitions pending, if any, shall also standclosed. There shall be no order as to costs.
