9. 03.04.2019 Petitionerin this writ petitionchallenges the letter dated 09.06.2017 rejecting application of the petitioner for waiver of penalty under Section 273A of the Income Tax Act, 1961 for the assessment year 2014-15. Since alternate remedy is available, i.e., appeal, learned counsel for the petitioner prays for and is permitted to withdraw the writ petition so as to prefer statutory appeal against the order impugned herein. In case such an appeal is filed within a period of four weeks hence, the period of pendency of the writ petition herein, i.e., from 07.07.2017 till date shall be taken into consideration while considering the application for condonation of delay by the appellate forum. For a period of four weeks interim protection granted by this Court vide order dated 08.01.2018 shall be in force. Original documents, if any annexed to the writ petition may be substituted with attested photocopy of the same. With the aforesaid observation the writ petition stands disposed of.
