In the present writ application, challenge has been made to an order dated 9th March, 2015 passed by the Income Tax Officer (O.P.2), by which order the petitioner was directed to deposit a sum of Rs.10,000/- on or before 25th of every month till payment of the total outstanding amount of Rs.3,00,500/-. It is submitted on behalf of the petitioner that by virtue of the aforesaid order, he has made six instalments amounting to Rs.60,000/-. Considering the above, we modify the order of the Income Tax Officer to the extent that the petitioner shall go on complying with the said order for a further period of four months or deposit a sum of Rs.40,000/- (Forty thousand) at a time and once an amount of Rs.1,00,000/- (One lakh) is deposited totally, no further demand shall be enforced against the petitioner till disposal of the 1st Appeal pending before the Commissioner of Income Tax (Appeal), Cuttack.
