6. 03.04.2019 ss Heard learned counsel for the parties. Petitionerin this writ petitionchallenges the order dated 08.09.2017 (Annexure-1) passed by the Commissioner of Income Tax (Appeals-), Bhubaneswar in I.T. Appeal No.0023 of 2016-17 relating to assessment year 2013-14. Since alternate remedy is available, i.e., appeal, learned counsel for the petitioner prays for liberty so as to prefer statutory appeal against the order impugned herein. In case such an appeal is filed within a period of four weeks hence, the period of pendency of the writ petition herein, i.e., from 30.01.2018 till date shall be taken into consideration while considering the application for condonation of delay in filing the appeal by the appellate forum. Original documents, if any annexed to the writ petition may be substituted with attested photocopy of the same. With the aforesaid observation the writ petition stands disposed of.
